MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES MOTION: Moved by Bill Utton, seconded by Marie Billinger and resolved unanimously, that the minutes of the 7th meeting of the Committee of Adjustment held Wednesday, May 26, 2004, be adopted. CARRIED 3. ADOPTION OF AGENDA MOTION: Moved by Marie Billinger, seconded by Bill Utton and unanimously that the agenda for the June 16, 2004 meeting be adopted. CARRIED resolved P/CA 33~04 to P/CA 35~04 - D. & M. Cartier 1895 Sprucehill Road Part of Lot 74, Plan 1041 (Part 3, Plan 40R-3363) City of Pickering The applicant requests relief from Section 10.2.1 of Zoning By-law 3036, to permit the establishment of minimum lot frontages provided by the three proposed severed parcels on the subject property as follows: P/CA 33~04 - minimum 14 metre lot frontage P/CA 34~04 - minimum 11 metre lot frontage P/CA 35/04- minimum 10 metre lot frontage whereas the by-law requires a minimum lot frontage of 15 metres. requests approval of these variances in order to facilitate severances. The applicant the proposed The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department and from the City's Fire Prevention Officer expressing no concerns. Written comments were received from William & Sunday Baird of 1814 Grayabbey Court, both opposed to the application. D. & M. Cartier, owners, were present to represent the application and David Donaldson of 1963 Spruce Hill Road, in support of the application. Also present were Klm Hogan of 1815 Grayabbey Court, Jeffrey Quinton of 1806 Grayabbey Court, David Vieira of 1804 Grayabbey Court and Joan Rumohr of 882 Voyager Ave., all expressing concerns with the application. Mr. Cartier stated that his intent is to provide premium lots on the street and to construct homes that are compatible with the streetscape and design of the neighbourhood. They will be in keeping with the Dunbarton Development Guidelines. Jeffrey Quinton requested that the builder construct dwellings with all brick exteriors and that they stay in keeping with similar homes in the neighbourhood. He expressed concerns with potential grading and drainage issues and requested that the City provide assurances that the proposed lots would not cause drainage concerns. David Vieira requested that the builder provide similar home designs as existing homes in the neighbourhood. Klm Hogan stated that currently them is a drainage problem on her property and requested that it be corrected prior to any future development. She expressed concerns with the siting of a new home having a negative impact on her property. Jeff Quinton and Kim Hogan inquired as to driveway access and both agreed that the orientation of a dwelling on Part 3 of the applicant's proposed plan may greatly impact the adjacent house. They both stated that they would be in support of the creation of two lots rather than three lots as proposed by the applicant. David Johnson encouraged the applicant to work with the community and to ensure that the builder site the dwelling on Part 3 of the proposed plan so that it doesn't face the property at 1815 Grayabbey Court. DECISION: Moved by Bill Utton, seconded by David Johnson and resolved unanimously that - Applications P/CA 33~04 to P/CA 35~04, by D. & M. Cartier, be APPROVED on the grounds that the proposed reduced lot frontages are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law subject to the following conditions: 1. That these variances apply only to the proposed lots, as generally sited and outlined on the applicants' submitted plans with this application. 2. That the applicant receive approval and finalize the associated Land Severance Applications or this decision shall become null and void. 3. That the applicant acquire ownership of Part 6, 40R-19693 and Block 26, 40M-1987 and provide proof of ownership. That the applicant submit an architectural design statement for Part 3 of the applicant's submitted plan to the satisfaction of the Director, Planning & Development. CARRIED P/CA 37~04 to P/CA 38/04 - 1608204 Ontario Ltd. 166 Twyn Rivers Drive (Part of Lot 1, Plan 282) City of Pickering The applicant requests relief from the following provisions of Zoning By-law 3036: Section 10.2.1 to permit minimum 13.7 metre lot frontages provided by the proposed severed and retained parcels on the subject property, whereas the by-law requires a minimum lot frontage of 15 metres. Section 10.2.3 to permit a minimum 1.2 metre side yard width to be provided by the proposed dwellings on the severed parcel and on the retained parcel, whereas the by-law requires a minimum side yard width of 1.5 metres. Section 6.4 to permit a minimum 4.0 metre flankage side yard width to be provided by the proposed dwelling on the retained parcel, whereas the by-law states that no part of any main building shall be erected closer to the lot line of the flanking street than 4.5 metres. The applicant requests approval of these variances in order to facilitate the proposed severance and to obtain building permits for the proposed construction. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Comments were received from the City's Fire Prevention Officer expressing no concerns. Written comments were received from CN Railway Properties outlining their Principal Main Line Requirements and expressing concerns with rail noise, vibration and safety. Charlie Barone, owner, was present to represent the application. Also present were Paul Modica and Mike Modica, both in support of the application. Committee ensured that the applicant was made aware of the comments and requirements by CN Rail. Mr. Barone stated that he was aware of the comments by CN Rail and that he was provided a copy of their requirements. DECISION: Moved by Bill Utton, seconded by Marie Billinger and resolved unanimously that - Applications P/CA 37~04 to P/CA 38/04, by 1608204 Ontario Ltd., be APPROVED on the grounds that the proposed minimum 13.7 metre lot frontages, minimum 1.2 metre side yard width to be provided by the proposed dwellings on the severed and retained parcel, and minimum 4.0 metre flankage side yard width to be provided by the proposed dwelling on the retained parcel are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That the applicant finalize associated Land Severance Application LD 98~04, or this decision shall become null and void. That these variances apply only to the proposed lots and dwellings as generally sited and outlined on the applicant's submitted plans with this application. That building permits shall be obtained and the proposed dwellings shall be constructed within three years of the date of this decision, or this decision shall become null and void. 4. That the property owner ensures that all future purchasers are made aware of CN Rails Principal Main Line Requirements. CARRIED 6. ADJOURNMENT MOTION: Moved by Marie Billinger, seconded by Bill Utton and resolved unanimously that- The 8th meeting of the Committee of Adjustment be adjourned at 8:00 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, July 7, 2004.
