MATTERS ARISING FROM THE MINUTES That the minutes be amended to reflect a minor change. 2. ADOPTION OF MINUTES MOTION: Moved by Marie Billinger, seconded by Chris Braney and resolved unanimously, that the minutes of the 6th meeting of the Committee of Adjustment held Wednesday, May 5, 2004, be adopted, as amended. CARRIED 3. ADOPTION OF AGENDA MOTION: Moved by Bill Utton, seconded by Marie Billinger and unanimously that the agenda for the May 26, 2004 meeting be adopted. CARRIED resolved P/CA 31/04 - Fampa Holdings Ltd. 940 Kingston Road Part Lot 26, Range 3, B.F.C. (Part 1 to 57, 60, 61, 69 to 78, Plan 40R-11259) City of Pickering The applicant requests relief from the following provisions of Zoning By-law 3036, as amended by By-law 6111/03. Section (2)(a)(i)B to permit two vehicle sales and service buildings location outside of the required build-to-zones, whereas the by-law states that a building or part of a building must be located within a build-to-zone, as illustrated on Schedule 1 to Zoning By-law 6111/03. Section (2)(a)(i)C to permit two vehicle sales and service buildings location outside of the required build-to-zones, whereas the by-law states that a building, part of a building, or structure may be located outside the build-to-zone, provided a building or part of a building is situated within both of the build-to-zones identified on Schedule 1 to Zoning By-law 6111/03. The applicant requests approval of these variances in order to obtain site plan approval and building permits to construct two vehicle sales and service establishments on the subject property. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Fire Prevention Officer expressing no concerns. Paul Rycroft, agent, was present to represent the application. Also present was the easterly-abutting property owner, representative of Century Gold Pins Ltd., in support of the application but expressing concerns with traffic access. Mr. Rycroft offered a brief history of the property and outlined reasons for the proposed location of the buildings being in the rear of the property. He advised the members that he is currently working with Planning Staff to resolve issues and that he concurred with Staff's recommendation to table the item. A representative of Century Gold Pins Ltd. stated that he was in support of the variances. He expressed concern with traffic access from Merriton Road and suggested a traffic study to address those concerns. MOTION: Moved by Bill Utton, seconded by Marie Billinger and resolved unanimously that - Application P/CA 31104, by Fampa Holdings Ltd., be TABLED to a future date on the grounds that the application is premature. CARRIED After the adoption of the Motion to Table the application, Phil Vieira of 890 Sheppard Avenue expressed concerns with traffic. Since the matter was already dealt with, Mr. Vieira was advised by the Committee to provide comments in writing and/or return to a future meeting to express his concerns. He would be advised of the date and time when the matter will be reconsidered by the Committee. P/CA 32/04 - 489349 Ontario Ltd. 1675 Bayly Street North Part of Lot 19, Range 3, B.F.C. (Part 2, Plan 40R-10527) City of Pickering The applicant requests relief from Section 2.56 of Zoning By-law 2511 to permit the interpretation of "Public Parking Lot" to also mean the temporary outdoor storage of two years, for vehicles associated with an automobile sales establishment, whereas the by-law defines "Public Parking Lot" as a lot or portion thereof other than an automobile sales lot, used for the temporary storage or parking of six (6) or more motor vehicles for hire and gain. The applicant requests approval of this variance in order to permit temporary outdoor storage of vehicles for two years on the subject property. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Fire Prevention Officer expressing no concerns. Written comments were received from Andy Zrnec, Director of Property management Golfour Property Services Inc., on behalf of an abutting property owner expressing concerns with grading and fencing. Joe Bessada, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. David Johnson stated that the property had demonstrated poor property maintenance and is currently used for the storage of derelict vehicles and abandoned trucks. He asked the applicant to provide assurances that the property will be maintained and that only new vehicles will be stored on the site. Mr. Bessada stated that fencing will be in place to secure all vehicles and that he would accommodate the Committee's request to store only new vehicles on the site. DECISION: Moved by David Johnson, seconded by Chris Braney and resolved unanimously that - Application P/CA 32~04, by 489349 Ontario Ltd., be APPROVED on the grounds that the proposed variance to permit temporary outdoor storage of two years, for vehicles associated with an automobile sales establishment, under the "Public Parking Lot" definition on the subject property is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: That this variance apply only to the outdoor storage of vehicles on the subject property that are associated with the automobile sales establishment located at 1644- 1698 Bayly Street. That the applicant obtain site plan approval from the City of Pickering within one year of the date of this decision, or this variance shall become null and void. That the temporary outdoor storage of vehicles shall be for a two-year period only and this decision shall become null and void two years from the date the decision becomes final & binding. That only new vehicles and vehicles in certified condition under the Ontario Highway Traffic Act be stored on the subject site, and further, no derelict vehicles be stored on the subject property. CARRIED 6. ADJOURNMENT MOTION: Moved by Bill Utton, seconded by David Johnson and resolved unanimously that- 4] The 7th meeting of the Committee of Adjustment be adjourned at 7:35 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, June 16, 2004.
