That Zoning By-law Amendment Application A 24/03 be APPROVED, subject to

with minimum frontages of 13.5 metres, on lands being Part of Lot 33, Range 3
B.F.C., City of Pickering, submitted by Rose Catania on behalf of the owners,
Winston and Nancy Ford.
That the amending zoning by-law to implement Zoning By-law Amendment
Application A 24/03, as set out in Appendix II to Report PD 13-04 be
FORWARDED to City Council for enactment.
Executive Summary: The applicant proposes to amend the existing 'R3' -
Detached Residential zoning on the property, which requires a minimum frontage of
18.0 metres, to 'S2' - Detached Dwelling, in order to permit the creation of two lots with
minimum frontages of 13.5 metres, fronting onto Fawndale Road (see Location Map and
Applicant's Submitted Plan, Attachments #1 and #2). The subject property currently
supports a detached dwelling and detached garage, fronting Altona Road.
Approval of this application will establish a zoning for the subject property, which is
consistent with the zoning that has been established for a majority of the properties
along the east side of Fawndale Road. The proposed development is compatible with
the surrounding neighbourhood and conforms to the Pickering Official Plan.
The City's requirements respecting development of the subject property will be
addressed through conditions of the associated land severance application.

Discussion:
The proposed development is compatibie with surrounding development,
and the subject property is to be zoned 'S2'
It is recommended that the subject property be zoned the same 'S2' residential
zoning as the existing development located on the east side of Fawndale Road.
This zoning would permit the development of lots with minimum frontages of
13.5 metres and minimum areas of 400 square metres. The applicant proposes
to sever the subject property in order to allow for the future development of two
detached dwellings. A site plan showing the proposed severance is provided for
reference (see Attachment #2). The applicant has recently submitted land
severance application LD 35/04 to the Durham Region Land Division Committee.
Zoning the property a category identical to that of the properties located on the
east side of Fawndale Road provides the opportunity for future development that
is compatible with surrounding lands, and maintains the design and character of
the area.
All matters of development, of concern to the City, can be addressed
through the land severance process
In order to ensure appropriate development, all requirements of the City will be
included as conditions of approval for the related land severance application
LD 35/04. These conditions are generally outlined in Appendix I, and will address
requirements of the Development Control, Municipal Properly & Engineering, and
any other additional comments received. These conditions will address matters
such as frontage onto Fawndale Road, grading, architectural design and
securities.
The City's interests can be appropriately addressed and protected through the
conditions of land severance approval, as outlined in AppendiX I to this report.
By-law to be forwarded to Council
The attached by-law, included as Appendix II to this report, implements Staff's
recommendation to approve the requested 'S2' residential zoning. It is further
recommended that the attached by-law be forwarded to Council for enactment
(see Appendix II).

That the subject property be rezoned from an "R-3" zone in Zoning By-law 3036, as
amended, to an "S2" zone, to permit development of two detached dwellings on lots
with minimum frontages of 13.5 metres.
That the following requirements be included in the comments to the Land Division
Committee regarding the related land severance application;
a) That the newly created lots front onto Fawndale Road, and that a reserve along
Altona Road be established in order to restrict access onto Altona Road;
b)
That lifting of the reserve on Fawndale Road be conditional on payment of
downstream cost sharing for storm sewer oversizing, and roadworks for
Fawndale Road;
c)
That the applicant satisfy the City with respect to matters of development such
as, but not limited to: grading and drainage, road widening for Fawndale Road,
boulevard improvements and sidewalk on Fawndale Road, servicing, fencing,
architectural design, and parkland dedication;
d)
The applicant will be required to post security to ensure the completion of
required works;
e)
That the City and the Region of Durham be satisfied with regards to
appropriate noise attenuation features for the proposed lots.

WHEREAS the Council of the Corporation of the City of Pickering deems it desirable to
rezone the subject property, being Part of Lot 33, Range 3 B.F.C, to a 'S2' zone in order to
permit the creation of two lots with minimum lot frontages of 13.5 metres;
AND WHEREAS an amendment to By-law 3036, as amended by By-law 1701/83, is
therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
SCHEDULE "1" AMENDMENT
Schedule '1" to By-law 1701/83 is hereby revoked and replaced with Schedule "1"
attached hereto.
EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval
of the Ontario Municipal Board, if required.

PROPERTY LOCATION AND DESCRIPTION
- the subject property is located on the west side of Altona Road and the east
side of Fawndale Road, south of Littleford Street (see Location Map,

- the subject property is considered to be a through lot, and has frontage onto
both Altona Road and Fawndale Road;
- the subject property has an area of approximately 1393 square metres, and a
lot frontage of approximately 29 metres, and currently supports a detached

120 square metre accessory retail store to the existing commercial automotive use,
on lands being Block B, Plan M-1024, City of Pickering, submitted by Sunoco Inc.
That the amending zoning by-law to implement Zoning By-law Amendment
Application A 15/03, as set out in Appendix I to Report PD 12-04, be FORWARDED
to City Council for enactment.
Executive Summary: The applicant is requesting a change to the existing
CNA-Commercial Automotive zoning on the subject lands to permit the establishment of
a convenience retail use, associated with the eXisting gas bar facility, as an additional use
on the site. The subject property is located on the southwest corner of Pickering Parkway
and Brock Road (see Location Map, Attachment #1).
The proposed convenience retail use associated with the gas bar will be compatible
with the existing development of the subject property and consistent with the
development of service stations with associated retail throughout the City of Pickering.

At the November 20, 2003, Public Information Meeting
Numerous residents appeared at the meeting to raise concerns regarding traffic
safety issues associated with the proposed By-law amendment (see text of
Information Report and Meeting Minutes, Attachments #3 and #4).

Written submissions following the Information Meeting
Residents in the neighbourhood west of the subject property and business
owners directly abutting the property expressed objection to the application.
Along with individual submissions, a petition was submitted with approximately
300 signatures opposing the application (see Attachment #5).
All submissions received cited variations of the following reasons for opposing
the proposal:
· Large volumes of traffic already associated with Sunoco Service Station and
Tim Horton's;
· Safety issues associated with increased traffic volumes;
· On-site pedestrian danger associated with cars queuing at the Tim Horton's;
· Already severe traffic issues caused by the redevelopment of the Metro East
Trade Centre.

The proposal complies with the City's Official Plan designation
The City's Official Plan designates the subject property "High Density Area",
within the Village East Neighbourhood. This designation permits, amongst other
uses, retailing of goods and services.
The proposed by-law amendment to add retail use (which would permit a
convenience store) implements the City's Official Plan policies and contributes to
the retail / commercial nature of the designation.
Modernizing and Updating the service station to current standards
Current zoning on the property limits the permitted use to an Automobile Service
Station - Type 'A' and Restaurant Drive-Thru Take Out. This zoning was
established in 1984 and does not fully implement the current Official Plan
designation or provide appropriate flexibility of uses.
Within the City of Pickering and throughout Ontario, service stations have
evolved to now include an associated convenience store as a standard
component of a gasoline retail outlet.
Proposed development will not further disrupt existing traffic movements
on or off the site
A traffic report, prepared by the applicant's consultant, supports the proposal and
concludes that the addition of an associated convenience store use will not
further impact the already congested site. The report was reviewed by Municipal
Property & Engineering staff who concur with the findings of the report. A retail
use will not generate sufficient additional traffic to merit the refusal of the
application based on safety and traffic requirements. A retail use, though minor,
at approximately 50 square metres, is currently operating from the gas station
'kiosk' and does not appear to be impacting the function of the property.

Both the Region of Durham and City Staff acknowledges that the current site
conditions are not ideat in terms of traffic congestion and pedestrian and vehicle
interaction. However, introduction of an expanded retail facility will require the
reconfiguration of buildings on the site. This change will require site plan
approval and will provide the opportunity to better address existing traffic
conditions. Existing high traffic volumes will remain after construction of the
proposed expanded facility, but should not worsen.
The Site Plan Review process will address appropriate site functioning
A Site Plan Application has recently been received by the City and has been
reviewed at a Development Application Review Team (DART) meeting. Through
the DART meeting it has been determined that the proposed site reconfiguration
will assist in improving internal traffic problems by clearly defining drive-thru
lanes, relocating the garbage enclosure, and generally formalizing traffic flow
routes (see Attachment #2),
The existing By-law requires that the site provide a minimum of 5 parking spaces.
The applicant does not propose to provide additional parking spaces for the
increased retail floor area. The consultant report indicates that additional parking
is not required due to minimal increase of customers attending the site solely for
shopping needs. Staff concurs with this position.
On-site movement of vehicles may be improved through a revised site plan which
the proposed 120 square metre development. However, any floor area increases
over 120 square metres may result in traffic flow issues. As such, the By-law
should restrict the area Of any retail / convenience use to 120 square metres.
It is recommended that the application be approved and the amending by-law be
forwarded to Council for enactment.

WHEREAS the Council of the Corporation of the City of Pickering deems it desirable to
change the zoning of the lands to permit a retail store, on the subject land, being;

AND WHEREAS an amendment to By-law 3036, as amended by By-law 1840/84, is
therefore deemed necessary;

Mike Duff, Planner II, provided an explanation of the application, as Outlined in
Information Report #19-03.
Steve Lerner, Suncor Energy Products Inc., advised that the items to be added
would be those similar to what is sold in most service stations. He further
advised that new pumps are being installed that will provide the convenience of
paying at the pump rather than having to enter the store, this speed up the
process and alleviate some of the traffic problems.
Paul Hill, Traffic Consultant, advised that a traffic study ahs been completed
which concludes that 85% of the traffic is due to Tim Horton's. Reorganization of
the site should help the traffic flow and lessen the traffic on Pickering Parkway.
Preet Singh, 25 Rotherglen Road North, advised that this development will create
more traffic congestion on Brock Road which will inevitably cause more accidents
and back-up. Another convenience store is not required in the area and with the
build-up of businesses across the street all needs are addressed.
CarolYn Oliver, 1655 Pickering Pkwy., Unit 514, advised that there is a solid
stream of traffic on Brock Road now and another convenience 'store is not
needed which will just increase the problem.
Raymond Ada, 1655 Pickering Parkway, advised of his opposition to the
convenience store stating that the service station will loose business if the traffic
congestion gets any worse.
Percell Thompson, 1566 Alwin Circle, stated his opposition to the application
adding that the traffic is already overly congested.
Lynda Taylor, Manager, Development Review, advised that comments are still to
come from Property & Engineering, Development Review and various agencies.

We, the undersigned, oppose the construction of a convenience store by
Sunoco on their property at Brock Road and Pickering Parkway because:
· there are already tremendous traffic congestion problems at the site
involving both Sunoco and Tim Horton's customers;
this congestion already sometimes endangers other motorists and
pedestrians using Pickering Parkway and other adjacent streets;
· customers will face potential danger while entering and departing the
convenience store by being forced to navigate between automobiles
awaiting service at Tim Horton's drive-through service;
· construction of the larger retail complex at the site of the former
Metro East Trade Centre already exaggerates traffic problems in the
community, and this store will simply contribute to difficulties
without delivering any substantial benefit to customers or the
neighbourhood;

Sun Oil/Sunoco's proposed convenience store on their property at Brock
Road and Pickering Parkway will contribute to further major traffic
congestion and endanger pedestrians and drivers alike as a result.
Safety will continue to be further compromised, with the potential for
personal injuries and property damage escalating greatly. It is not a question
of if accidents will happen but, as with the redesigned nearby intersection
dealing with much greater traffic volumes and changes, only a question of
how many accidents and how bad.
Residents in the immediate area emotionally oppose the expansion of the
retail cluster because there is no apparent advantage and numerous
dangerous and frustrating results that will evolve from the development.
Local politicians also oppose the development and police voice personal
concerns about growing traffic hazards in the immediate area.
It is time that politicians and business leaders in the community recognize
the cause-and-effect results that follow decisions permiting development that
everyone wants ... but which must meet the needs and desires of the larger
community.
The residential streets streaming off Pickering Parkway already suffer from
higher traffic flow and dangerous driver complacency that is a result of the
growing truck and automobile flow that accompanies growth.
The Tim Horton's retail outlet akeady on the site daily creates stand-still
overflow traffic at all hours of the day that unpredictably (1) stops traffic
altogether on Pickering Parkway, (2) blocks traffic flow as a result, (3) often
backs up traffic turning from Brock Road and (4) has repeatedly caused
accidents and near-accidents that sometimes has involved pedestrians.

I could not attend the hearing last Thursday at)out the rezoning application
submitted by Sunoco for construction of a convenience store at Picketing
Parkway and Brock Road.
Any suggestion, as stated by a consultant on behalf of the company, that
there are no traffic problems associated with the property due to the Tim
Hortons outlet other than peak periods is absOlutely wrong.
The congestion, and resulting accidents and potential to personal injury, can
and do occur at all hours of the day due to the existing traffic volumes.
This neighbourhood is also enduring traffic problems brought about by the
development of the First Pro shopping centre on the northeast comer of
Brock Road and Pickering Parkway. These problems will be expanded by
the Sunoco construction.
There is also no visible need for the convenience store, other than great
profit for the company.
The neighbourhood must come first.

I am a homeowner at 1655 Gem Circle, a town house complex adjacent the intersection of Brock
and Pickering Parkway. As it pertains to the application to place another convenience store at the
aforementioned intersection, I humbly submit my disapprove.
~ have resided at my cra-Tent address for the iast five years and m the last two years, i have seen
the Iraffic situation =orow to an tmm~ageable impediment. Oftentimes, it takes minutes to ieave the circle
to go north unto Pickering ParkwaY. Outside of the inconvenience, the increased traffic poses a
considerable risk to pedestrians, many of which are small children. Within the last six months I have heard
of two accidents, involving motor vehicles, one involving a small boy, and have witnessed several close
calls. I am wary of the safety of my own children, in regards to the seemingly growing vehicle abundance
in the area. A~'~other convcnicnt store in the area would surely worsen the problem.

The following resolution was passed by the APTA Board at its meeting held February 23rd,

"That the APTA Board of Directors endorse the recommendations as set out in
Report APTA-01-04:

FINANCIAL IMPLICATIONS:
Adoption of interim capital expenditure appropriations does not constitute approval of a
formal budget, but rather is required to provide funding authorization for the payment on
such routine capital repair and maintenance accounts as may be necessary to maintain
APTA's existing assets in a state of good repair for normal day-to-day operations of the
Transit Authority. At the conclusion of the Budget process, all interim capital
appropriations are nullified and replaced with the detail appropriations as apprOved by
the Board and Councils.

BACKGROUND:
Each year, pending approval of the annual Capital Budget, it is necessary to provide
expenditure authority respecting the payment of repair and maintenance capital
accounts for the interim period from January 1 until the Budgets are adopted. Such
authority is in the form of interim capital appropriations to meet estimated expense
requirements of the authority.
We are seeking approval to provide for interim capital spending authority for up to the
first six months of 2004 or when the 2004 Budgets are approved, whichever occurs first.
The amounts below represent 50% of the proposed capital amounts for 2004.
Capital accounts that require interim spending authority to maintain APTA's existing
assets in a state of good repair include the following:

* The Midlife Vehicle Refurbishing interim request of $100,000 provides for two of three

turnaround by our suppliers.

Origin:
AS the attached activity report indicates, PAW can boast that for the second.
consecutive year no adoptable pets had to be euthanised. With the
assistance of the general public and the local animal rescue organizations
PAW was successful in finding a home for every adoptable pet taken in at the
Animal Services Centre in 2003.
Analysis:
The adoption success of PAW is in no small measure attributable to a number
of InltlaUves introduced by the PAW Committee to, '
promote and develop responsible pet ownership; and,
o adopt out as many homeless animals as possible.
The initiatives include,
customer service training and development for the animal services
staff to equip them with the skills required to provide qualib/animal
services;
the development of an animal services website to better promote and
publicize animal services available to the citizens of the three
communities;
an advertising program to promote the importance of responsible pet
ownership, publicize the plight of homeless pets~, find good, loving
homes for unwanted pets and seek the public's assistance in
combatting pet overpopulation;
exploring new ways and means of improving communication and
working relationships with local pet fanciers such as veterinarians,, pet
store owners, animal shelter operators, rescue groups, etc.; to fine!

Attached to this Report is a copy of the PAW Committee Treasurer's Report 4-04 for
your information.
The City of Pickering entered into an Agreement with .Ajax and Whitby respecting the
operation of the Animal Services Centre that allocates operating expenses on a per
capita basis and capital expenses on an equal basis. Therefore, in 2004, Pickering is
responsible for 33.08% of the total operating costs of $732,300.00 being $242,244.84
and is responsible for 33.33% of the total capital costs of $21,000.00 being $7,000.00
for a total of $249,244.84.
The 2004 Animal Services budget, including current and capital expenditures is an
increase of 6.3% over 2003. It should be noted that because of population increases in
the Towns of Ajax and Whitby, Pickering's total share of the animal services expenses
has decreased from $250,799.65 to $249,244.84.
The population figures used in the Committee Treasurer's Report are based on
population data gathered by the Municipal Property Assessment Corporation in 2003 for
the election.

Recommendation:
That the Pickering-Aj ax-Whitby Joint Animal Services Committee adopt the
2004 animal services budget estimates as set out in the Treasurer's Report,

Executive Summary:
The purpose of the proposed by-law is to ensure that hawkers and peddlers are
operating safely and are not causing an unfair competition for permanent shop owners.
Financial Implications:
Approximately $1,500.00 in revenue from the issuance of licences.
Background:
Please be advised that Council passed By-law Number 4437/94 on June 6, 1994 to
licence and regulate hawkers and peddlers. This By-law was passed at that time in an
effort to control the establishment of "chip trucks" that were proliferating in various
locations at that time. Although the goal of the By-law was accomplished at that time,
over the years, conditions have changed and it is has now been proven that By-law
Number 4437/94 does not provide sufficient regulations to govern the various types of
hawkers and peddlers that are selling goods in the City today.

With respect to refreshment vehicles that are established at one location such as "chip
trucks" and "hot dog carts", this by-law will restrict such operations to the following
instances:
to locations where the zoning by-laws permit the sale of food from that location
where the operator of the "chip truck" or "hot dog cart" have the written
permission of the property owner to locate their vehicle.
· the vehicle and equipment within it that is used to sell the foodstuffs from
complies with the regulations of the Regional Department of Health and Fire
Department.
· the licencee pays a fee of $250.00 per calendar year.
This proposed by-law exempts catering trucks and other mobile vehicles such as the
"Dickie Dee" that stop for very short periods of time because they are regulated under
the Parking By-law which prohibits any food vehicle stopping on a road allowance for a
period longer than 15 minutes.
The proposed by-law will also restrict the sale of non-food items such as flowers, etc. to
privately owned lands that are zoned to permit the sale of such items, where the
permission of the property owner has been given in writing and upon the payment of a
licence fee of $20.00 for each day of operation. Council will recall that the City has
Special Legislation that prohibits the sale of goods from the road allowance and allows
a Municipal Law Enforcement Officer or Police Officer to confiscate the goods being
sold from a road allowance.
Again, the main goal of the proposed by-law is to ensure that permanent restaurants
and retailers do not face unfair competition from individuals who are able to purchase
refreshment vehicles at very little cost and set them up at locations were they are able
to attract customers that would normally patronize the permanent location. This by-law
will also ensure that the owners of refreshment vehicles and.the sellers or retail goods
such as flowers that are able to sell from a particular location are paying a licence fee
that will be somewhat comparable to a property tax.
The following hawkers and peddlers will be exempted from this by-law:
· door-to-door salespersons
· vendors in a flea market
· persons raising money for a charitable organization
· farmers who are selling their produce from their property
· permanent businesses who are holding a sidewalk-type sale
· vendors of fireworks because they are regulated under a separate by-law
Like all licensing by-laws, the fine for contravening this by-law is up to $25,000.00 for
individuals and up to $50,000.00 for corporations.

Being a by-law to licence and regulate Hawkers and
Peddlers within the geographic limits of the City of
Pickering.

WHEREAS pursuant to Section 150(1) of the Municipal Act, S.O. 2001, c.25, a local
municipality may licence, regulate and govern any business wholly or partly carried on within
the municipality; and
WHEREAS it is the intent of the council of the Corporation of the City of Pickering to regulate
Hawkers and Peddlers within the municipality to protect and promote the health and safety of
its residents and the Hawkers and Peddlers by regulating the goods and merchandise sold, the
manner in which those items are sold and the locations from which they are sold;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING
HEREBY ENACTS AS FOLLOWS:
DEFINITIONS
1. In this By-law;

"Charitable Organization" and "Non-profit Organization" shall include an
organization if no part of its income is paid to or otherwise made available for the
personal benet'~ of any of its proprietors, members or shareholders, and if one of
the main aims and normal activities includes projects and undertakings that have
a charitable object or purpose including:
i) the relief of poverty,
ii) the advancement of education,
iii) the advancement of religion,
iv) other charitable purposes beneficial to the community not included
in subsections (i), (ii) or (iii) above.
"Cit~' shall mean the Corporation of the City of Picketing.
"City Clerk" shall mean the Clerk of the Corporation of the City of Pickering or his
or her designate.
"Council" shall mean the Council of the Corporation of the City of Picketing.
"Door-To-Door Salesperson" shall include a person who goes door-to-door within
the City with goods, wares or merchandise for sale or cardes or exposes for sale
samples, patterns, or specimens of any goods, wares or merchandise that are to
be delivered in the City afterwards.
"Flea Market" shall include an area, whether enclosed by a building or not, in
which individual stalls are rented to one hundred (100) or more vendors, other
than the owner, for the purpose of individually exposing or offering new or used
articles, foodstuffs, fruits and vegetables or services for sale.

or to a particular place, with goods, wares, merchandise or foodstuffs for sale, or
who carries or displays samples, patterns or specimens of any goods, wares or
merchandise for which orders are taken and that are to be delivered in the City
afterwards.
(j) "Licence" shall mean a licence issued by the Corporation of the City of Picketing
pursuant to the provisions of this by-law.
(k) "Licence holder" shall mean a person named as licensee in a licence issued by
the Corporation of the City of Pickering pursuant to the provisions of this by-law.
(Il "Person" shall include an individual, a sole proprietorship, a partnership, an
unincorporated association, a trust, a body corporate, and a natural person.
(m) "Refreshment Vehicle" shall include premises in which foodstuff is :sold from
vehicles or temporary structures or places where food is prepared within a
structure capable of being moved but within which no patrons or consumers of
the foodstuffs can enter for the purpose of consuming the foodstuffs or premises
which do not meet the definition of a restaurant as set out in the City's zoning by-
laws.
(n) "Sell" shall include to offer, keep, expose, transmit, send, convey or deliver for
sale or have in possession for sale goods, wares or merchandise. "Sells~ and
"selling" have corresponding meanings.
LICENCE APPLICATION
(a)
A licence issued pursuant to the provisions of this by-law shall be valid for the
pedod of time specified in the licence.
(b) A licence issued pursuant to the provisions of this by-law shall not be
transferable.
(c)
A licence for a continual period of time and/or for a stationary use, and its
accompanying application, shall take the form as prescribed by the City Clerk.
(d)
"Continual period of time and/or for a stationary use" shall include vending that
takes place at a certain location for extended periods of time, such as hot dog
carts and refreshment vehicles.

A licence for a temporary use and/or location, and its accompanying application,
shall take the form as prescribed by the City Clerk.

"Temporary use and/or location" shall include vending that takes pJace on a
single day or for a limited period of time at a location, such as specia~ occasion
sales of goods.

Notwithstanding subsections 2(c) and 2(el, no licence shall be issued, unless the
applicant complies with Section 3 and 4 of this By-taw.

NO person shall operate or carry on or allow to operate or carry on as ~ Hawker
and Peddler without hotding a current valid licence issued under the provisions of
this by-law.
(b) No person who is licenced to sell from one location shall sell from place to place
under the auspices of that licence.
(c) No person who is licenced to sell from place to place shall establish a display in
one location and/or sell from that location for a period longer than fifteen (15)
minutes under the auspices of that licence.
(d) No person shall sell any goods, wares, merchandise or foodstuffs other than
those indicated on the licence.
(e) Any person required to be licenced pursuant to this by-law shall, at all times while
carrying on the business of a Hawker and Peddler, have the licence displayed in
a conspicuous place and shall, upon demand, exhibit it to any Municipal Law
Enforcement Officer, Peace Officer, or to any person to whom the Hawker and
Peddler is offering goods for sale.
(f) Any employee, assistant, agent or helper of a person licenced pursuant to the
provisions of this by-law shall have the said licence in their possession for the
purpose of displaying it or producing it upon demand as required in subsection
3(e).
(g) Any person who fails to produce a licence as required by subsection 3(e) is guilty
of an offence.
FEES
All fees payable under this by-law are required to be paid in full prior to the issuance of
a licence.
(a) The fee for a licence issued under Section 2(c) is $250.00 per calendar year.
(b) The fee for a licence issued under Section 2(e) is $20.00 per day per location.
GENERAL
Hawker and Peddler licences shall not be issued for a particular location unless:
(a) i)
with respect to refreshment vehicles, the City's zoning by-laws permit the
sale of foodstuffs at that location;
ii)
with respect to all other vendors other than refreshment vehicles, the
City's zoning by-laws permit the sale of goods, wares, merchandise or
foodstuffs from that location;
(b)
the applicant has provided a copy of the current deed to the property or other
written proof, satisfactory to the City Clerk, that they are the owner of the
property where the selling will take place or, alternatively, that they have the
authority from the owner and/or manager of the property, to sell from the site;
the applicant shall clearly indicate in the application whether 1hey intend to setl
from place to place or from one location only. The licence issued shall clearly
specify whether the licensee is entitled to sell from place to place or from a
specified location;

(e) the applicant has complied in all respects with any standards or regulations
under the jurisdiction of the Picketing Fire Department, Region of Durham Health
Unit, the Durham Region Police Services and any other applicable laws or
regulations.
(f) Failure to comply with applicable laws or regulations may result in the revocation
of a licence issued under this By-law.
EXEMPTIONS
A Hawker and Peddler's licence is not required to be obtained by the following
individuals:
(a) door-to-door salespersons or vendors in a flea market;
(b) persons who are agents or employees of non-profit or charitable organizations,
who are selling for the benefit of the charitable organization;
(c) if the goods for sale are grown by a farmer, resident in Ontado, who offers for
sale or sells only the produce of his own farm, from his own farm; or,
(d) established businesses within properly zoned premises if the goods are sold from
such premises
(e) vendors of fireworks.
APPEAL
(a) Where the City Clerk believes that the applicant applying for the Hawker and
Peddler licence would be disentitled to a licence or renewal thereof for any of the
reasons set out in this by-law, the City Clerk shall not issue the licence. Any
applicant so disentitled may appeal in writing for a headng before Council. The
applicant shall have the dght to make submissions in support of an application or
renewal of said licence.
(b) At the conclusion of the headng, the City Clerk shall, as soon as' practicable,
prepare a written report on the headng, which shall summarize the evidence and
the arguments presented by the parties at the headng, set out the findings of fact
and the decisions made by the Council and set out the reason for the decision.
(c) If the applicant sets out in writing that he is prepared to accept conditions upon
the licence and to make no objection to such conditions, Council may grant a
licence or the renewal of a licence on such conditions as Council consider
appropriate.
PENALTIES
Any person who contravenes any provision of this by-law is guilty of an offence and
upon conviction is ~iable to a fine or penalty for each offence, exciusive of costs, as
prescribed by the Provincial Offences Act, R.S.O. 1990, as amended.
if a court of competent jurisdiction dectares any provision, or any part of a :3rovision of
'~his by-taw to be invalid, or to be of no force and effect, it is the intention of Council in
enacting this by-iaw that each and every other provision of this by-law authorized by law
be applied and enforced in accordance with its terms to the extent possible according to
SHORT TITLE
10. This by-law may be referred to as the Hawker and Peddler By-law.
REPEAL OF EXISTING BY-LAWS
11. By-law 4437/94 is hereby repealed.

Re: Proclamation of Ali-Terrain Vehicle (ATV) Safety Week
On behalf of the Durham Region ATV Safety Coalition, I am asking you to
help ~ncrease awareness of ATV safety by bringing this to the attention of your
municipal council and requesting that the council proclaim the week of
May 10 to May 16, 2004 as ATV Safety Week.
The Durham Region ATV Safety Coalition is planning a region-wide ATV
safety awareness campaign for the week of May 10 to May 16, 2004. Part of
the campaign is requesting Regional Council and each Municipal Council to
proclaim May 10 to May 16, 2004, ATV Safety Week. The campaign will
include media information, distribution of resources in the community (a copy
of the information poster and brochure are included with this letter) and a
community event in the Ganaraska Forest highlighting the week.
The following are important facts about ATV use:
· There has been a dramatic increase in the recreationa use of ATVs.
From 1996 to 2001 Canadian ATV sales have tripled to 75,000.
· ATV injury-related hospitalizations are the only type of injury-related
hospitalization that has increased dramatically in the past five years.
· 36% of ATV-related injuries are in persons between 5 and 19 years.
· The rate of hospitalizations due to off-road vehicles is higher in Durham
Region than the Ontario rate.
The Durham Region ATV Safety Coalition has representatives from Durham
Region Police Service, Durham Region Health Department, Durham Region
Works Department, Ontario Ministry of Transportation, Municipality of
Clarington, Township of Brock, Township of Scugog, Ganaraska Region
Conservation Authority, Outback ATV Club, and the Perfect Getaway-ATV
Guided Tours. The goal of the coalition is to reduce the number of injuries
related to ATV use by promoting safety.
We appreciate your support ~n raising awareness of ATV safety by proclaiming
the week of May 10 to May 16, 2004 as ATV Safety Week.

Whereas:
ATV injury-related hospitalizations are the only type of
injury-related hospitalization that has increased
dramatically in the past 5 years, and the rate of
hospitalizations due to off-road vehicles is higher in
Durham Region than the Ontario rate.
Whereas:
Research indicates that increasing the public's awareness
of the risks associated with an activity will increase their
knowledge and their motivation to avoid the risk
behaviours related to that activity.
Whereas: Public awareness is the first step in decreasing the
number of ATV-related injuries in Durham Region.

On behalf of the Pickering Advisory Committee on Race Relations & Equity, please
accept this as a formal request that the City of Pickering proclaim March 21, 2004 as
the International Day for the Elimination of Racial Discrimination.
Since 1966, March 21st has been recognized by the United Nations as the International
Day for the Elimination of Racial Discrimination in response to the killing of 70 peaceful
demonstrators in Sharpeville, South Africa in 1960.
On February 14, 2004, the Pickering Advisory Committee on Race Relations & Equity
commemorated Heritage Day with a lively community celebration of Pickering's rich
heritage and cultural diversity. On this occasion, Councillor David Pickles, Chair,
Pickering Advisory Committee on Race Relations & Equity and committee members
would like to commemorate March 21st by way of proclamation so that our community
can continue to be aware of the harmful effects of racism and discrimination and be
aware of the leadership of the municipal government to foster equality, respect and
diversity.
