PLANNING & DEVELOPMENT REPORT PD 39-03 DRAFT PLAN OF SUBDIVISION APPLICATION 18T-88059 (REVISION 2) ZONING BY-LAW AMENDMENT APPLICATION A 3/02 711053 ONTARIO INC. & 562503 ONTARIO LIMITED PART OF lOT 4, CONCESSION 5, PART 2, PLAN 40R-4159 EAST SIDE OF SIDELINE 4 SOUTH OF HIGHWAY 7 Approved See Recommendation #1 - 1 - Planning Committee Meeting Minutes Tuesday, October 14, 2003 7:45 pm Chair: Councillor Ryan 1. Margaret Williamson, 3360 Balsam Road, emphasized the need for written assurance that her well would not be affected by the development of 35 homes across the street. She stated her concern with the condition of the road and the understanding that there is no intention of paving it after construction is complete. She stressed the need to have the hours of operation adhered to and assurance that the property beside her is not becoming a landfill. 2. Dana Anderson, Planning Consultant, advised that the well monitoring program was provided to staff and can be put in place as part of the subdivision agreement. 2. PLANNING & DEVELOPMENT REPORT PD 36-03 DRAFT PLAN OF SUBDIVISION APPLICATION SP-2002-02 ZONING BY-LAW AMENDMENT APPLICATION A 9/99 (R2) NICOU INC. SOUTH PART OF lOT 34, CONCESSION 2, PART 1, 40R-11934 (100 FINCH AVENUE - NORTH SIDE OF FINCH AVENUE, OPPOSITE WOODVIEW AVENUE) Approved See Recommendation #2 1. Norman Collier, Townline, stated his concern with the possible drainage of Amos Pond and traffic congestion this development may cause. 2. Otto Stock, 1960 Woodview Avenue, advised that this development would help area residents by alleviating the problem of garbage being dumped on this property and would enhance the area. 3. Mrs. McCullough, advised of her concern the affect this development may have on her well water stating that they have had no problems for 34 years. She questioned if this development will be on sewers. 4. Bonnie Littley, 1499 Sandhurst Crescent, advised that the area has a shortage of parkland and open space and she stated the need for sustainable development. Bryce Jordan, Planner representing the applicant, advised that they have spent two years working with staff of the City of Pickering and Toronto & Region Conservation Authority to prepare this proposal which is in full conformity with the Official Plan. He further advised that two thirds of the property will be transferred to public ownership. He requested Committee support of this application. 3. PLANNING & DEVELOPMENT REPORT PD 37-03 ZONING BY-LAW AMENDMENT APPLICATION A 14/03 MONTESSORI lEARNING CENTRE OF PICKERING (750985 ONTARIO LIMITED) 401,409,417 KINGSTON ROAD & 4 EVELYN AVENUE . (PART OF lOTS 17,18 AND 19, PLAN 230) SOUTH-WEST CORNER OF KINGSTON ROAD & EVELYN AVENUE Approved See Recommendation #3 1. John McDermott, representing the Montessori learning Centre, advised that this application conforms with the Regional Official Plan and the Pickering Official Plan. They have agreed to a traffic study and requested Committee's adoption of staff recommendations. III OTHER BUSINESS Moved by Councillor Pickles Seconded by Councillor Holland That Council move In-Camera at 7:38 PM. CARRIED Moved by Councillor Johnson Seconded by Councillor Brenner That the recommendation set out in Report PD 38-03 be adopted. SOUTH OF HIGHWAY 7 1. That Draft Plan of Subdivision Application 18T-88059 submitted by 711053 Ontario Inc. & 562503 Ontario Limited, on lands being Part of lot 4, Concession 5, Part 2, Plan 40R-4159, City of Pickering, be APPROVED to permit the development of a plan of subdivision of 35 country residential lots with frontages ranging from 32.0 to 68.0 metres, four public open space blocks and a new local road, subject to the conditions outlined in Appendix I to Report PD 39-03; 2. That Zoning By-law Amendment Application A 3/02, submitted by 711053 Ontario Inc. & 562503 Ontario Limited on lands being Part of lot 4, Concession 5, Part 2, Plan 40R-4159, City of Pickering, be APPROVED, to establish performance standards to allow the implementation of the draft plan of subdivision 18T-88059 (Revision 2), subject to the conditions outlined in Appendix" to Report PD 39-03. 2. PLANNING & DEVELOPMENT REPORT PD 36-03 DRAFT PLAN OF SUBDIVISION APPLICATION SP-2002-02 ZONING BY-LAW AMENDMENT APPLICATION A 9/99 (R2) NICOU INC. SOUTH PART OF lOT 34, CONCESSION 2, PART 1, 40R-11934 (100 FINCH AVENUE - NORTH SIDE OF FINCH AVENUE, OPPOSITE WOODVIEW AVENUE) 1. That Draft Plan of Subdivision Application SP-2002-02 submitted by Nicou Inc., on lands being the South Part of lot 34, Concession 2, Part 1, Plan 40R- 11934, City of Pickering as revised by the applicant in April, 2003, be APPROVED to permit the development of a plan of subdivision of 39 lots for detached dwellings with frontages ranging between 12.0 and 15.0 metres, a -5- Appendix I Planning Committee Report PC 2003-8 parkland block, an open space block, a new local road and a road widening block, subject to the conditions outlined in Appendix I to Report PD 36-03; and 2. That Zoning By-law Amendment Application A 9/99 (R2) submitted by Nicou Inc. on lands being the South Part of lot 34, Concession 2, Part 1, Plan 40R- 11934, City of Pickering, be APPROVED to establish performance standards to allow the implementation of the draft plan of subdivision, subject to the conditions outlined in Appendix" to Report PD 36-03; and 3. That Zoning By-law Amendment Application A 14/03, be APPROVED to permit commercial, office, institutional and residential uses, on lands being Part of lots 17, 18 and 19, Plan 230, City of Pickering, submitted by McDermott & Associates Limited on behalf of 750985 Ontario Limited, (Montessori learning Centre of Pickering). 2. PLANNING & DEVELOPMENT REPORT PD 38-03 DECLARATION OF SURPLUS LANDS FOR THE PURPOSE OF SALE PART OF lOT 28, RANGE 3, B.F.C., PICKERING (PART 1. PLAN 40R-2767) 1. That Report PO 38-03, concerning Declaration of Surplus lands for the Purpose of Sale, from the Director, Planning & Development, be received; and 2. That the Council of the City of Pickering declare the lands described as that part of lot 28, Range 3, B.F.C., Pickering, designated as Part 1, Plan 40R- 2767 surplus to the needs of the Corporation for the purpose of sale; and 3. That the CAO negotiate the sale of the subject lands exclusively with Intracorp/M.H. Strathmore ltd. For incorporation into their proposed townhouse development on adjacent lands; and 4. That the CAO report back to Council detailing the negotiated terms and conditions and to seek authorization to effect the sale of the subject lands. - 7-
