Being a Restricted Area By-law to amend By-law
3436, as amended to implement the Official Plan
of the Town of Pickering District Planning Area,
Region of Durham in Part Lot 24, Concession 1,
Town of Pickering.

WHEREAS By-law 3036 implements the Official Plan, in part of the I
Town of Pi.ckerinq District Planning Area;

AND WHEREAS By-laws 4166/72 and 4205/72 amend the provisions of
By-law 3036, as amended, placing' holding zones on certain
properties including the subject lands outlined herein;
AND-WHEREAS it is deemed expedient to permit development to now
occur on the subject lands;`
NOW THEREFORE THE COUNCIL OF THE CORPORATION OI' THE ':01%-, Gil`
PICKERING HEREBY ENACTS AS FOLLOWS:
SECTION 1: SCHEDULES

Schedule "A" and "B" attached hereto with notations and
shown thereon are hereby declared to be part of this By-law and are'
described as follows:
Schedule "A" - Walnut Lane - Kingston Toad Zoning Mal.
Schedule "B" Standards and Provisions
SECTION 2: AREA RESTRICTED
The provisions of this By-law shall apply to all lands hatciied
on Schedule "A" attached hereto.
SECTION 3: 'GENERAL PROHIBITION
No building, land or part thereof shall hereafter be used,
occupied, erected, moved or structurally altered, except in conformity
with the provisions of this By-law.
SECTION 4 PROVISIONS
The standards and previsions as set out on Schedule "B" hereto
shall apply to the area restricted by this By-law.
SECTION 5: BY-LAW 3036
By-law 3036, as amended, is hereby further amended only to the
extent necessary to give effect to the provisions of this By-law as
it applies to the area set out in Schedule "A" hereto. Definitions
and subject matters not specificially dealt with in this By-law shall
be governed by the provisions of By-law 3036, as amended.
SECTION 6: ENFORCEMENT
Any person convicted of a breach of any provision of this By-law
shall forfeit and pay, at the discretion of the Court, a penalt_{ not
exceeding (exclusive of costs) the sum of one Thousand Dollars fSl,OG .UVj
for each offence, recoverable under The Summary Convictions Act-

SECTION 7: EFFECTIVE DATE
No part of this By-law shall come into force without the approval
of the Ontario Municipal Board, but subject to such approval, the
By-law shall take effect from the date of the passing hereof.

PROVISIONS:
1. When the property boundary abuts a King's highway, or a street other than a King's Highway,
a strip of land not less than 15 feet, or 10 feet, in width respectivoly, as the, case may be,
adjacent to the boundary shall not be used for any purpose other than landscaping suffering, but
this shall not prevent the provision of entrances and exits across such landscaped area.
2. A site plan agreement is to be entered into between the owner and the Municipality. The agreement
shall include but not be limited to controls such as exterior material of, buildings, :lighting, lan6scaping
plan, traffic design and municipal servicing requirements.
3. Combined floor area of any Restaurant and Financial institution shall not exceed 15% of the total
gross floor area.
