(V) NOTICE OF MOTION Moved by Councillor McLean Seconded by Councillor Holland 24 WHEREAS studies have shown that motorists travel up to 70 kilometers per hour on residential streets that are relatively long and straight; and WHEREAS speeding on residential streets is not conducive to safe pedestrian activities; NOW THEREFORE the Council of the Corporation of the City of Pickering hereby directs staff to prepare a by-law that will reduce the speed limit on Rawlings Drive, Heathside Crescent, Walnut Lane and Longbow Drive to 40 kilometers per hour; and FURTHER THAT said by-law be included on the Agenda for the Council Meeting of May 5, 2003. AS such, on behalf of Durham Region EMS, I ask that you bring to the attention of Municipal Council a request to proclaim the week of May 19-23, 2003 as EMS Week. The applicant has reviewed the draft by-law and has advised of a concern regarding parking area setbacks. The applicant expressed the opinion that excess road allowance exists within the Old Kingston Road right-of-way, and there is no need to set the parking area 3.0 metres from this right-of-way. The applicant may address Council on this matter. The requirements to set parking areas back from the lot line, a minimum of 3.0 metres is to ensure adequate area is available for landscaping. The applicant has the option to explore the right-of-way width of the road to determine if excess is available for sale. Until such review is completed and/or the excess land sold, it is premature to change the standard 3.0 metre setback requirement. The draft by-law is attached for the consideration of City Council at their meeting scheduled for May 5, 2003. A Statutory Public Meeting was held for this application on August 8, 2002. The purpose and effect of this by-law is to permit additional retail and commercial uses: bakery, commercial school, dry cleaning depot, financial institution, laundromat, personal service shop, restaurant (without drive-thru), and retail store, subject to the following conditions: (i) (ii) that the implementing by-law include an (H) Holding Symbol; and that prior to the removal of the (H) Holding Symbol the owner will be required to enter into an appropriate development agreement and receive site plan approval from the City of Pickering. (A 10/02) WHEREAS the Council of the Corporation of the City of Pickering deems it desirable to change the zoning of the lands to permit additional retail and commercial uses on the subject property, being Lot 40, Plan 1051, City of Pickering; AND WHEREAS an amendment to By-law 3036, as amended by By-law 2498/87, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. TEXT AMENDMENT Section 5. PROVISIONS of By-law 2498~87 is hereby further amended by adding thereto the following: (5) (a) Uses Permitted ("SC-36" Zone No person shall within the lands designated "SC-36" on Schedule 'T' attached hereto use any lot or erect, alter or use any building or structure for any purpose except the following: (i) bakery (ii) business office (iii) commercial school (iv) dry cleaning depot (v) financial institution (vi) laundromat (vii) personal service shop (viii) professional office (ix) restaurant - type A [subject to Section (5)(c)] (x) retail store (5) (b) Zone Requirements ("SC-36" Zone) No person shall with the lands designated "SC-36" on Schedule "1" attached hereto, use any lot or erect, alter or use any building or structure except in accordance with the following provisions: (i) FRONT YARD DEPTH (minimum): A For the purpose of this by-law, Old Kingston Road shall be deemed to be the front lot line. B 4.5 metres (ii) REAR YARD DEPTH (minimum): 0.5 metres INTERIOR SIDE YARD WIDTH (minimum): 0.5 metres -2- (iv) FLANKAGE SIDE YARD WIDTH (minimum): 3.5 metres (v) BUILDING HEIGHT (maximum): 10 metres (vi) OPEN STORAGE: no open storage shall be permitted in any yard (vii) PARKING REQUIREMENTS: A There shall be provided and maintained on the lands designated "SC-36" on Schedule 'T' attached hereto, a minimum of 12 parking spaces for business office and professional office uses. B There shall be provided and maintained on the lands designated "SC-36" on Schedule 'T' attached hereto, a minimum of 16 parking spaces for all other permitted uses. C Sections 5.21.2a) and 5.21.2b) of By-law 3036, as amended, shall not apply to the lands designated "SC-36" on Schedule 'T' attached hereto. D All parking areas shall be set back a minimum of 3.0 metres from all read allowances. E Notwithstanding Section 5.21.2g) of By-law 3036, as amended, all parking areas shall be surfaced with brick, asphalt or concrete, or any combination thereof. (5) (c) Special Regulations ("SC-36" Zone) Despite Section (5) (a) (ix), a restaurant - type A shall not include a drive-thru. (5) (d) Uses Permitted ("(H)" Holding Symbol) Despite the provisions of Section 5. (5) (a) of this By-law, while the "(H)" Holding Symbol is in place preceding the "SC-36" Zone designation as outlined on Schedule 'T' attached hereto, no person shall use any lands for any purpose other than business office and/or professional office. (5) (e) Removal of the "(H)" Holdin.q Symbol 2. SCHEDULEI Prior to an amendment to remove the "(H)" Holding Symbol preceding the "SC-36" Zone, on the area so zoned, the owner shall enter into an appropriate agreement with the City and receive site plan approval to address, such matters as, site function (access/egress, traffic aisles, parking locations), site improvements (landscaping, paved surfaces, road improvements), and stormwater management. Schedule 'T' to By-law 2498/87, as amended by By-law 2923/88, is hereby further amended by adding thereto the zone designation "(H)" SC-36 as shown on Schedule 'T' attached hereto. 009 01.0 -3- 3. TEXT AMENDMENT M2 is hereby amended by adding the following after subsection 17.4.2: 17.4.3 - Part of Lot 1, Plan 40M-1347 (1) Definitions (a) For the purpose of this subsection "Commercial-Recreational Establishment" shall mean a commercial establishment in which recreational facilities such as bowling alleys, miniature golf courses, bingo facilities, gymnastics facilities, roller skating rinks, squash courts, swimming pools, batting cages, indoor skateboarding/in-line skate park, and other similar recreational facilities are provided, and which may include an athletic or recreational club, but shall not include a place of amusement or entertainment as defined herein, a room or an area used for any video lottery terminal use as governed by the Gaming Services Act, an adult entertainment parlour as defined herein or a body rub padour as defined in the Municipal Act, R.S.O. 1990, Chapter M.45, as amended from time-to-time or any successor thereto; (b) For the purpose of this subsection "Adult Entertainment Parlour" shall mean a building or part of a building in which is provided, in pursuance of a trade, calling, business or occupation, services appealing to or designed to appeal to erotic or sexual appetites or inclinations; (c) For the purpose of this subsection "Place of Amusement or Entertainment" shall mean a building or part of a building in which facilities are provided for amusement or entertainment purposes, and which may include a billiard or pool room, a dance hall, a music hall, or a theatre, but shall not include a room or area used for any video lottery terminal use as governed by the Gaming Services Act, and adult entertainment parlour as defined herein or a body rub parlour as defined in the Municipal Act, R.S.O. 1990, Chapter M.45, as amended from time-to-time or any successor thereto; (2) Provisions In addition to the provisions of Section 17.1 hereof, the lands designated M2 on Schedule 'T' to By-law may be used for the purpose of a Commercial-Recreational Establishment in accordance with Section 17.2 provided that the following requirements are met: (a) that despite the definition of a Commercial-Recreational Establishment, a Bingo Facility shall not be permitted; (b) the gross leaseable floor area of all Commercial-Recreational establishments shall not exceed 1600 square metres, and the parking ratio shall be 1 space per 56 square metres of gross leaseable floor area, or portion thereof. 2. BY-LAW 2511 By-law 2511 is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as set out in Section 1 above. Definitions and subject matter not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 2511, as amended. 3. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required. Being a by-law to amend By-law 264/75 to establish a 50 kilometers per hour speed limit on Rosebank Road WHEREAS, By-law Number 264/75 allows Council to authorize speed limits on highways under the jurisdiction of the City of Pickering; AND WHEREAS it is deemed expedient to establish the speed limit on Rosebank Road at 50 kilometers per hour; NOW THEREFORE, the Council of the Corporation of the City of Pickering HEREBY ENACTS AS FOLLOWS: 1. WHEREAS, pursuant to the Municipal Act, R.S.O. 1990, Chapter H.8, the Council of The Corporation of the City of Pickering enacted By-law 2632/88 provide the erection of stop signs at the intersections on highways under its jurisdiction. NOW THEREFORE, the Council of the City of Pickering HEREBY ENACTS AS FOLLOWS: Stop signs shall be erected at the intersection of highways set out in Column I of Schedule A attached hereto, facing the traffic bound in the direction set out in Column II of the Schedule. 2. Schedule A to By-law 2632/88, as amended, is hereby further amended by adding hereto the following item: Column I Column II Intersection Facinq Traffic Pickering Parkway and Valley Farm Road Eastbound and Westbound on Pickering Parkway BY-LAW read a first, second and third time and finally passed this 5th day of May, 2003.
