height of fences in the Township of
Picketing in all Residentially zoned
WI~REAS it is not the intention of the Municipality
to require the construction of fences in residentially zoned areas;
and
WHEKEAS IT IS CONSIDERED DESIRABLE that where fences
are constructed, same should be regulated with respect to height in
order to maintain the ameneties of the area and the free movement of
light and air.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF PICKERII~G ENACTs AS FOLLOWS:
For the purpose of this By-law, the following meanings
shall apply:
a) "BUILDINGHAIN" shall mean a building in which is conducted
the principle uses of the lot on which it is situated. In
any residential zone, a building containing one or more
dwelling units shall be deemed to be the main building of
the lot on which it is situated;
b) "FENCE" shall mean any linear barrier erected or growing
on a lot~
c) (i) "CORNER LOT" shall mean a lot situated at the intersection
of two streets or two parts of the same street of which
two adjacent sides upon the street line or street lines
include an angle of not more than one hundred and thirty-
five degrees (135°) and where such adjacent sides are
curved, the angle included by the adjacent sides shall
be deemed to be the angle formed by the intersection
of the tangents of the street lines drawn through the
extremeties of the interior lot lines, provided that
l) in the latter case the corner of the lot shall he
deemed to be that point on the street line nearest to
to the point of intersection of the said tangents, and
2) any portion of a corner lot distant more than one
hundred feet (100') from the corner, measured along the
street line, shall be deemed to be an inside lot.
(ii) "FRONT LOT LINE" shall mean the line that divides a lot
from the street provided that in the case of a corner
lot the shorter lot line that abuts a street shall be
deemed to be thr front lot line and the longer lot line
that so abuts shall be termed the 'Flank' of the lot.
(iii) "PEAR LOT LINE" shall mean the lot line opposite the
Front Lot Line.
d) "MAIN FRONT WALL" shall mean the wall of the main building,
located nearest the front lot line;
e) "STREET' shall mean a public highway, public road allowance
or private thoroughfare which affords a principle means of
access to abutting lots;

f) "YARD FR~' shall ~ean a yard extending across the full
width of the lot between the front lot line and the nearest
wall of any main buildin~ or structure on the lot;
g) "HEICHT OF A FENCe-" shall mean the distance measured
perpendicular from the level of the ground on which it is
situated to the top of the fence;
h) "DIVISIO~ FENCE" for the purpose of this By-la~ shall ~ean
any fence dividing two or ~ore property o~nerships;
2. SCOpe.
The provisions of this By-la~ shall apply to all lands
within the To~mahip of Picketing aoned for reaidential uses;
except that these restrictions shall not apply ~aere such
fence is contiguous to e non-residentially zoned area, but
but shall apply ~,'here a street is the boundary between t~o
or more zones,
3. ,OBSTI~CTIOI/ OF STREETS
No person shall place or maintain any fence either permenantly
o~ temporarily on any street except for emergency protection
measures with the approval of Council.
a) The maximum height of any fence between the front wall of
the main building and the street line for the full width
of the lot shall he 42 inches;
b) The maximum height of any fence between the front wall
of the main building and the rear lot line for the full
width of the lot shall be six (6) feet;
c) The maximum height of division fences separating residential
uses from institutional, conmercial, open space or industrial
uses shall be eight (8) feet.
5. HEIGHT OF FEI/CE - CORNEI~ LOTS
a) The maxim,-- height of fences along street lines on corner
lots in residential areas shall not exceed 36 inches.

b) In the case of corner lots where a portion of the flank,
side or rear lot lines project nearer to the same street
/than the front wall of the next adjacent structure, the
maximum heigh~ of any fence or hedge in the front, side
or rear yard eO projecting shall be 36 inches; except as
limited by the; foregoing; the maximum height of any fence
shall be s .i~,.:(6) feet;

a) No person shall uae barbed wire or any o~her barbed
material or ~y material of a nature which could be
injurious ~o the public ~ ~y co~ec~ton w/th s~h
fence;
b) No person shall use any device designed for or capable
of projec~zng electric curren~ ~hro~h such fence.
8. By-l~ N~ber 3522 be and ~he s~ is hereby repealed.
