BY-LAW NU~ER. ~5~
WHEREAS S.&O1 of The Municipal Act provides for the
licensing and regulating of Plumbers, Master Plumbers, Journeyman
Plumbers, Drain Contractors, Drain Layers and Apprentices.
BE IT ENACTED by the Council of the Township of
Pickering that:
1. In this By-law whenever the terms hereinafter defined
are used they shall have the meaning hereinafter ascribed to them;
(a) "Apprentice" means any person who is in the employ of a
Master Plumber but has not had five years experience.
(b) "Board" means the Plumbers' Licensing Board.
(c) "Drain Contractor" means a person concerned with all
drainage work not included in plumbing.
(d) "Drain Layer" means a person employed by a drain contractor
who understands the principles of drain laying.
(e) "Journeyman Plumber" means a person other than a Master
Plumber who has been employed by a Master Plumber in the
performance of plumbing, for not less than five years
or who holds a certificate in plumbing of a trade school
recognized by the Board, following at least two years
tuition and who desires to follow plumbing as his calling.
(f) '~aster Plumber" means a person who is skilled in the
Planning, superintending and installation of plumbing,
is familiar with the laws, rules and regulations governing
the same and who himself or by journeyman plumbers in his
employ performs plumbing.
(g) "Plumbing" means the art of installing in buildings the
pipes for distributing the water supply, the fixtures for
using water, and the soil and waste pipes for removing
waste water and sewage, together with fittings and
appurtenances of various kinds within or adjacent to the
building and the house sewer.

(1) The Plumbers' Licensing Board shall consist of four
persons:
(a) Reeve;
(b) The Plumbing Inspector;
(c) One Master Plumber and one Journeyman Plumber,
appointed from time to time by the Council of
the Township of Pickering who shall hold office
during the pleasure of the said Council.
(2) The Council shall appoint the Secretary of the Board
and the Board shall elect one of its members to be Chairman thereof.

3. The Secretary of the Board shall keep a register in
which shall be entered the names and addresses of all
persons to whom registration as Master Plumbers,
Journeyman Plumbers, Drain Contractor, Drain Layers
or Apprentices is granted under this By-law.
4- Every applicant for registration as an Apprentice
shall be granted registration upon the recommendation
of the holder of a Master Plumber's license and payment
of the appropriate fee.
5. Every applicant for registration as a Master Plumber,
Journeyman Plumber, Drain Contractor or Drain Layer
shall be granted registration i~' he obtains at least
seventy percent (70%7 standing in an examination as
to his skills conducted by the Board, and he pays the
appropriate fee. To qualify for examination as a
Master Plumber, applicant shall have worked at the
trade a m~nimum of Five (5) years "with a sworn
declaration of same", or have proof of apprenticeship
as approved by the Department of Labour. In either
case, applicant must hold a current Journeyman's
License.
6. Any applicant for registration who has failed to obtain
the required standing in respect of part only of his
examination shall be entitled on application made to the
Board within sixty days of such failure, and upon payment
of the appropriate fee, to be re-examined as to such part
of such original examination.
7. Every application for registration under this By-law
shall be in writing signed by' the Applicant in suct~ form
as the Board may fro~ time to time prescribe.
8. The Secretary of the Board shall issue a license as a
Master Plumber, Journeyman Piumber, Drain Contractor or
Drain Layer to any person who is registered as such and
who has paid the appropriate fee for such license.
9. Every license issued pursuaut to this By-law shall expire
on the 31st day of Decembe~~ in the year for which it is
issued.
10. On the 1st day of March in each year the registrations
of all persons other than Apprentices who have not
obtained their licenses for such year shall lapse.
ll. T~e Board may' cancel the registration of any person who
has committed a wilful violation of any By-law pertaining
to plumbing.
12. When the registration of any person lapses or is cancelled
the Secretary of the Board shall forthwith delete the name
of smch person from the register.
lS. When the registration of any person is cancelled the
license of such person shall cease and determine.
14. No person shall in the Township o~ Picketing:
(a) Assume responsible charge and direction of plumbing
or engage himself or hold himself out as being qualified
to undertake on his own behalf to perform plumbing work
unless he is the holder of a Master Plumber's license.
(b) Employ, whether for gain or otherwise, any person
other than a licensed Master Plumber to do plumbing work
unless he is himself the holder o~ a Master Plumber's
license, or employs for such work a Master Plumber.
(c) Engage himself in employment as a Journeyman
Plumber unless he is the holder of a Journeyman
Plumber's license.
(d) Engage himself in employment as a Drain Layer
unless he is the holder of a Drain Layer's license.
(e) Engage himself in employment as an Apprentice unless
he is registered as an Apprentice.
(f) Being a ~aster Plumber, cause or permit an Apprentice
or helper or other unlicensed person to perform any
plumbing work or install any plumbing material or
appliance within the meaning of this By-law except as
an assistant to and in the presence of and under the
direct personal supervision of a licensed Master Plumber
or Journeyman Plumber, continuously employed on the
same contract or job.
(g} Engage in business as a Drain Contractor unless he is
the holder of a Drain Contractor's license.
15. The Secretary of the Board shall on the application of any such
person registered under this By-law and the payment by such
applicant of the proper fee, issue to such applicant a certificate
of such registration.
16. The Board may require any person registered under this By-law
other than an Apprentice to submit to examination by the
Board as to his competency should the Board at any time have
reason to doubt his competency, and should such person fail to
obtain at least seventy percent (70%} standing in such examina-
tion the registration of such person shall be cancelled.
17. Notwithstanding anything to the contrary herein contained the
Board may without examination register under this By-law any
person engaged in the trade of plumbing or drain-laying in the
Township at the time of passing of this By-law.
18. The fees payable under this By-law shall be as follows:

19. Any person convicted of a breach of the provisions of this
By-law shall forfeit his licence, and pay at the discretion
ofthe convicting ~iagistrate, a penalty not exceeding the
sum of Three Hundred Dollars ($300.00~ for each offence,
exclusive of costs.
20. By-laws Number 2636 and 3159 be and the same is hereby repealed.
21. This By-law shall come into force on the 1st day of January,
1968.
