THE CORPORATI ,ON OF THE TOWN OF PICKERING
BY-LAW NO. 5104/97
Being a By-Law to authorize the execution of
agreements relating to devetopmenl ~' lands and
the acquisition of lands by the Town required as a
condition ora consent to sever lan&, site plan
approval or a minor variance.
WHEREAS, pursuant to the provisions of the Planning Act, R.S.O. 1990 c. P. 13, Council can require as
conditions of development approvals, that applicants enter into agreements with the Corporation and
convey lands to the Corporation for Town purposes.
NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
1. The Mayor mid Clerk are hereby authorized to execute all necessary agreements on behalf of The
Corporation of the Town of Pickering which have been prepared in a form acceptable to the
Town Solicitor and which are required by the Town to satisfy a condition of the Region of
Durham Land Division Committee approval of a consent to sever lands, or to satisfy a condition
of the approval of a site plan or t~ satisfy a condition of the granting of a minor variance by the
Town's Committee of Adjustments.
2. That the To~vn is authorized to accept the conveyance of those lands, (free and clear of all
encumbrances at no cost to the Town), which have been identified by Town staff to be required
for Town purposes as a condition of site plan approval or as a condition of an approval by the
Region of Durham of a severance of lands or related to the granting of a minor variance.
3. That the Mayor and Clerk are hereby authorized to execute all necessary easement documents on
behalf of The Corporation of the Town of Picketing which have been prepared in a form
acceptable to the Town Solicitor and which are in favour of The Corporation of the Town of
Picketing and required by the Town as a condition of site plan approval, the granting of a minor
variance or the granting of a consent to sever lands by the Regional Municipality of Durham.
BY-LAW read a first, second and third time and finally passed this 15th day of September, 1997.
