Beln~ a By-law to amend (Zoning) By-law 4508/94 which amended Restricted
Area (Zoning) By-Law 3036, to implement the Official Platt of the Town of'
Pickering District Planning Area, Region of Durham in Part of Lot 31,
Concession 1, in the Town of Pickcrln8. [18T-96009 and A22/96]
WHEREAS the Ontario Municipal Board deems it desirable to permit development of a range of'
medium density types on the subject lands being Part of` Lot 3 i, Concession !, in the Town of`
Pickering.
AND WHEREAS an amendment to (Zoning) By-law 4508/94 which amended Restricted Area
(Zoning) By-Law 3036, is deemed necessary by the Ontario Municipal Board.
NOW THEREFORE THE ONTARIO MUNICIPAL BOARD ENACTS AS FOLLOWS:
Schedule I attached hereto with notations and references shown thereon is hereby declared
to be part of this By-law.
2. AREA RESTRICTED
The provisions of this By-law shall apply to those lands in Part of Lot 31, Concession 1, in
the Town of Pickering, designated "fII)RJVI2-1" on Schedule 1 attached hereto.
3. GENERAL PROVISIONS
No building, land or part thereof shall hereafter be used, occupied, erected, moved or
structurally alt~ed except in conformity with the provisions of this By-law.
4. TEXT AMENDMENTS ..
(!) Subsection 5.($)(b)(i) of By-law 4508/94 is hereby amended and replaced with the
following:
(i) YARD SETBACKS (minimum):
A- For semi-detached dwelling residential and single attached dwelli~

I1) 7.5 metres from any zone line,
(2) Subsection 5.(5)(bXvi) orBy-law 4508/94 is hereby amended and replaced with the
following:
(vi) SPECIAL REGULATIONS: -
A- tire horizontal distance between semi-detached dwellings, multiple
dwellings-horizontal and/or single attached dwellings shall be a
minimum of 1.8 metres, except where such dwellings are attached in
whole or in part.
B - the interior sideyard between abutting semi-detached dwellings and/or
single attached dwellings shall be a minimum of 0.9 metres.
C - where dwellings on abutting lots share a common wall, no interior side
yard shall be required adjacent to that wall on either lot.
SCHEDULE AMENDMENT
That Schedule I to By-law 4508/94 be amended such that all lands designated thereon as
(H)EIVI2-1 be replaced by Schedule I attached hereto.

By-law 4508/94 which mnended By-law 3036, as amended, is hereby further amended only
to the extent necessa~ to 8ire effect to the provisions of this By-law as it applies to the area
see. out in Schedule ! attached hereto. Definitions and subject matters not specifically dealt
with in this By-law shall be 8ovemed by the relevant provisions of By-law 4508/94 and By-
law 3036, as amended.
7. EFFECTIVE DATE
This By-Iai', shall take effect from the date of the order of the Ontario Municipal Board (in
its file number Z960136 & S970007) mnendin8 By-Law 4508/94, which further amends By-
law 303~, as amended, in accordance with this By-law.
