BY-LAW NUMBER 3877/91
Being a by-law to adopt Amendment Number 70 to the District Plan for the Town of
Picketing
WHEREAS pursuant to the Planning Act, 1983, S.O. 1983, c. 1, subsections 17(6) and 21(1),
the Council of the Corporation of the Town of Pickering may by by-law adopt amendments to
the District Plan for the Town of Pickering, being an officml plan, and submit them to the
Minister of Municipal Affairs for approval;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
Amendment Number 70 to the District Plan for the Town of Pickering, attached hereto
as Exhibit "A" and including the Explanatory Text, is hereby adopted.
The Clerk of the Town of Pickering is hereby authorized and directed to submit
Amendment Number 70 to the District Plan for the Town of Pickering to the Ministry of
Municipal Affairs for approval.
3. This By-law shall come into force and take effect on the day of the final passing hereof.
By-law read a first, second and third time and finally passed this 15th day of
1991.

AMENDMENT NO. 70
TO PART I OF THE
TOWN OF P1CKERING DISTRICT PLAN
AMENDMENT NO. 70 TO PART I OF
THE TOWN OF PICKERING DISTRICT PLAN
PURPOSE:
The purpose of this amendment is to establish new provisions in Part I of
the Picketing District Plan for temporary use zoning by-laws.
LOCATION:
The amendment applies to all lands within the Town of Pickering.
BASIS:
The amendment has been determined to be appropriate because it
clarifies the circumstances and conditions under which the Town could
consider enacting temporary use by-laws under section 38 of the Planning
Act.
ACTUAL
AMENDMENT:
Part 1 of the Town of Picketing District Plan is hereby amended by:
Deleting in its entirety Subsection 6C3 of Section 6 and replacing it
with the following:
6C3. Temporary Use By-laws
(a)
Pursuant to section 38 of the Planning Act, 1983, or any
successor thereto, Town Council may pass a by-law to
permit the temporary use of any land, building or
structure, for a use which is otherwise prohibited by the
by-law, whether or not the use conforms to the official
plan, without an amendment to this Plan.
(b) A by-law to permit the temporary use of any land,
building or structure, may be considered under one or
more of the following circumstances:
(i) when a use is intended to exist for only a limited
period of time;
(ii)
when a use must be monitored for a temporary
period of time prior to it being considered for
permanent zoning; and
(ii/)
when a use can exist for a temporary period of time
within an area that is undergoing a land use study,
without influencing the outcome of that study.
(c) To determine whether to enact a by-law under clause (b)
of this section, Town Council must oe satisfied that:
(i)
the site can adequately accommodate the proposed
use, considering such matters as site layout,
building design, parking, traffic circulation, access,
landscaping and servicing;
(ii)
the use will be compatible with, and not adversely
affect, any surrounding land uses that currently
exist; and
that the use will not prejudice the future
development or redevelopment of the subject lands
and the surrounding area.

IMPLEMENTATION: The provisions set forth in the Town of Pickering District Plan, as
amended, regarding the implementation of the Plan shall apply in
regard to this Amendment.
INTERPRETATION:
The provisions set forth in the Town of Pickering District Plan, as
amended, regarding the interpretation of the Plan shall apply in
regard to this Amendment.
