To regulate the operation of pits and quarries
THE COUNCIL of the Corporation of the Township of Pickering
ENACTS as follows;
1. No person shall operate a pit or quarry in the Township of
Pickering except in compliance with the Laws of the Province of Ontario
and in compliance with this by-law and the other by-laws of the Township
of Pickering respecting pits, quarries, zoning and nuisances.
2. (i) No person shall excavate a pit.ef quarry so that any part
of the edge, rim or side thereof is at a point less than a distance of
20 feet measured in a straight line from any point in the nearest limit
of the lands of any highway, road or road allowance in the Township of
Pickering.
(ii) Where in the case of a pit or quarry existing at the date
of the passing of this By-law any part of the edge or rim thereof is
less than a distance of 20 feet measured in a straight line from any point
in the nearest limit of the lands of a highway, road or road allowance
in the Township of Pickering, that part of the pit or quarry shall not be
further excavated so as to lessen the distance of the rim or edge thereof
from the nearest limit of the lands of the highway, road or road allowance
that exists at the date of the passing of this by-law and the provisions
of subsection (i) above shall apply to the remainder of such pit or quarry.
(iii) No person shall excavate any pit or quarry so that the

slope of any side thereof shall have a greater vertical rise than 2rw-feet
for every 100 feet horizontal distance excavated being at a ratio of 1
vertical to- horizontal.
ERECTION OF FENCES
3. Every owner and occupant of a pit or quarry shall erect and main-
tain on the surface of the land that surrounds a pit or quarry a 9 strand
farm-type mesh fence at least 4 feet in height sufficient to completely
enclose the pit or quarry except for entrances and exits, such entrances
and exits to be protected by gates constructed of similar or equivalent
material and design as the fence where the gates are located which gates
shall be closed and secured when the pit is not in operation.

4. Emery owner of a pit or quarry located within 300 feet of a
highway, road or road allowance in the Township of Pickering that has
not been in operation for a period of 12 consecutive months shall level
and grade the floor and sides of such pit or quarry and the area within
300 feet of the edge or rim thereof so that no such pit or quarry will
be dangerous or unsightly to the public.
PENALTY
5. Every person who contravenes any of the provisions of this
by-law shall upon conviction thereof, forfeit and pay at the discretion
of the convicting Magistrate a penalty not exceeding, exclusive of costs,
the sum of Three Hundred Dollars for each offence.
