HomeMy WebLinkAboutBy-law 2620 THE CORPORATION ,(~F THE TOWNSHIP OF PICKERING BY-LAW No. ~ ~ ~ ~ A By-law to acqaire an easement across certain lands in the Township of Pickering for storm drainage purposes WHEREAS by Section 333 of The ~4unicipal Act i~.S.O. 1960, Chapter 249 as amended, the Council of The Corporation of the Township of Pickering may pass by-laws for entering on land and for expropriating an easement or other right in the nature of an easement for the purposes of the said Corporation and more particularly for the purposes of providing for storm drainage in the Municipality. AND ~EHEAS the said Council dee~s it desirable that the said Corporation should expropriate an easement for the purposes herein- after set out affecting the lands described in Schedule "A" to this by- law. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TO~JNSHIP OF PICKEi{ING HF.%EBY ENACTS AS FOLLOWS: 1. An easement for the purposes hereinafter set out be and the same is hereby expropriated affecting the lands described in Schedule "A" annexed hereto. 2. The purposes for which this easement is expropriated are as follows: (a) To construct, instal, lay, maintain and operate or any cue or more of them on or under the lands described in Schedule "A" annexed hereto a storm ditch or storm ditches or a storm sewer or storm sewers forming part of the drainage system of the said Corporation including all pipes, mains~ conduits, connections, valves, manholes, and fixtures necessa_~y or incidental thereto. (b) To inspeot, repair, replace, remove and close up or any one or more of them such ditch or sewer and for such purposes to enter on the said lands described in Schedule "A" with or without equipment at all reasonable times. (c) To discharge through or permit to be discharged through such ditch or sewer at all times ~.11 storm and other natural run-off as the said Corporation deems requisite. 3. No person shall without the written consent of the said Corporation erect or permit to be erected any construction whatsoever on the lands described in Schedule "A" annexed hereto. 4. The Engineer of the said Corporation and persons claiming through him are hereby authorized to enter on the said lands described in Schedule "A" annexed hereto for the purposes aforesaid. 5. DESCRIPTI0~ Q~~ Q~q~k PART OF LOT 3, BLOGK "B", ~~ NO. 65, (GARDINER'S PLAN), TOWNSHI~ ~ ~:~Q~/~TY C~ ONTARIO, ALL AND SINGULAR that certain parcel or tract of land and premises stt~te~ lying and being in the Township of Picketing, in the County and Pro¥ince of Ontario, being composed of part of Lot 3, Block B, as shown on a plan filed in the Registry Office for the Registry Division of said County of Ontario as No. 65, said plan being more commonly knowh as "Gardinerls Plan of the Millage of Fairport." The said parcel is composed of a strip of land 15.OO feet in width lying 7. 50 feet in perpendicular width on either side of a centre line and centre line produced, which said centre line may be described as follows: PP~SING that all bearings used herein are astronomic and are referred to the meridian through the North East angle of Lot 21, in the Third Range of the Broken Front Concession in said Township of Picketing; COM~LENCING at a point in the Northern limit of said Lot 3~ distant 42.28 feet Easterly therein from the North West angle thereof; [~ENCE South 04° 20~ 00" East, 150.84 feet ~re or less to a point in the Southern limit of said Lot 3, distant 7.72 feet Easterly therein from the South West angle thereof. Being the lands outlined in red and shown on the annexed Survey prepared by F.E. Lansby, O.L.S. of Marshall,Macklin and Monaghan dated March 30, 1960.
