A BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF PICKERING TO
PROVIDE FOR THE LICENSING AND REGULATING OF PLUMBERS, MASTER
PLUMBERS, JOURNEYMAN PLUMBERS, DRAIN CONTRACTORS, DRAIN LAYEBS
AND APPRENTICES.
~ IT ENACTED by the Municipal Council of the Township of Picketing:
) in %nls ~y-Law whenever the te~ns hereinafter defined are
used they shall have the meaning hereinafter ascribed to
them:
(a) "Plumbing" shall mean the art of installing in buildings
the pipes for distributing the water supply, the fix-
tures for using water, and the soil and waste pipes
for removing waste water and sewerage, together with
fittings and appurtenances of various kinds within
or adjacent to the building and the house sewer.
(b) "Master Plumber" is hereby defined to be a person who
is skilled in the planning~ superintending and install-
ation of plumbing, is familiar with the laws, rules
and regulations governing the same, has a regular place
of business in the municipality and who himself, or by
Journeyman plumbers in his employ, performs work.
(c) "Journeyman Plumber" shall mean a person other than a
master Plumber who has been in the employ of a master
plumber for not less than five years or who holds a
certificate of a recognized trade school following at
least two years tuition and desire to follow plumbing
as his calling.
(d) "Apprentice" er "improver" shall mean any person who
is in the employ of a master plumber but has not had
five years experience and works only under the direct
supervision of a master or Journeyman plumber and is
not eligible for a license. Direct supervision within
the meaning of this by-law shall be and mean the contin-
uous presence on the work of a master or Journeyman
plumber exercising direct control and authority over
the work and over any apprentice or improver engaged
in the work.
(e) "Maintenance man" is defined as a person employed to
ma:[ntain and keep in good condition all plumbing,
sewerage and drainage lines and to repair cocks,
valves and leaks within the building or buildings or
upon the premises occupied and used by the employer
of such maintenance man. "Maintenance" means to keep
or preserve a thing in its present state without adding
to it or changing the location of it. A maintenance
man shall not be entitled to undertake plumbing on
behalf of any person other than his employer or to
engage himself as a master plumber or journeyman
plumber or both unless he holds a certificate of regis-
tration qualifying him to do so under this by-law.
(2) In order to safeguard life and property any person
engaged in or working at the business as a drain contractor,
drain layer or as a master plumber or journeyman plumber,
shall hereafter be required to submit evidence to the
Plumberst Licensing Board as hereinafter defined that he
is qualified and shall be required to register and to submit
to such examination as the Plumbers' Licensing Board may
require and if approved by such Board to obtain a license
as hereinafter provided, and all apprentices and improvers
shall be registered with the Licensing Boar~ but not
licensed until eligible for journeyman's license.

(3) The Plumbers~ Licensing Board shall be composed of the
following persons:
(a) A chairman who shall be the Township Engineer.
(b) The Plumbing Inspector who shall also act as Secretary
of the Board.
(e) One registered Master Plumber and one registered
journeyman plumber~ each of whom has been engaged at
least five years continuously preceding his appointment
in the pl~nbing trade. Such master plumber and
journeyman plumber shall be appointed from time to
time by the Licensing Board and either or both of them
may be dismissed or replaced by the Licensing Board
at any time.
(4) It shall be the duty of the Board to provide and conduct the
examination of applicants, which examination may be in part
written but must include a practical test. No applicant
shall be certified as satisfactory who does not obtain at
least 60% standing on his examination.
(5 Before taking the examination for a master or journeyman's
certificate or drain contractor or drain layers certificate
an applicant shall apply in writing to the Board upon the
form to be provided by the Board. In the case of a firm or
corporation the application must show all the names and
addresses of the members of such firm or the officers of
such Corporation as the Case may be. Any change in partner-
ship must be reported to the Secretary of the Board. No
Certificate of license shall be issued to a firm or corpor-
ation but only to the person or persons being a member or
members of any such firm or an officer or officers of such
corporation as may be nominated on behalf of such firm or
corporation for such purpose. Any rerson holding a certif-
icate or license as a member of any such firm or an officer
of any such corporation shall be obliged to secure a
new certificate of registration and a new license upon
severing his connection with any such partnership or corp-
oration if he intends to carry on as a master plumber.
(6 Applicants upon successfully completing such examination
shall be issued a certificate of registration by the Board.
Upon production of such certificate to the Township Plumbing
Inspector the holder of such certificate shall be entitled
to be licensed as a master or journeyman plumber as the case
may be according to such certificate. A master plumber's
certificate of registration shall be prominently displayed
in his place of business, A journeyman plumber's certificate
shall be carried by the holder at all times. Apprentices
shall also apply for registration with the Board and obtain
a card of identification which they must carry at all times.
(a) Any master plumber failing so to display his certificate
in his place of business and any journeyman or apprentice
failing to carry his certificate or card of identification
as the Case may be and to produce it upon request~ shall
be guilty of an offence under this by-law.
(b) "Place of Business" shall mean an office accessible to
the public which may be entered from the street, having
displayed outside thereof a si&n bearing the name or
names of the person, firm or corporation carrying on
the plumbing business, clearly designating that it is
a master plumberrs shop~ store, or place of business.

(7) The fees for examination for a certificate of registration
shall be as follows:
For master plumber examination and certificate $ 10.00
For a Drain contractor " " " 10.00
For journeyman plumber " " " 5.00
For a drain layer " " " 5.00
Renewal certificates shall be ~equired to be
obtained on January 1st in each year and there shall be no
fee for such renewal certificates. The Board may at any
time require the applicant to submit to re-examination. Fees
for such examinations and certificates shall be payable to
the Secretary of the Board and shall accompany the application
for examination and shall not ~e returned. If an applicant is
required to submit to a re-ex~nination he shall be obliged to
pay the same fee again for such subsequent examination. If an
applicant is required to submit to a partial examination on
any section thereof the fee for such re-examination for each
section shall be:
For master plumber $ 5.00
For a Drain Contractor 5.00
For journeyman pllunber 2.00
For a Drain layer 2.00
[~on obtaining a certificate or renewal certi-
ficate either as a master or journeyman plumber, the holder
thereof shall be entitled to obtain his license as a master
or journeyman plumber as the case may be from the Plumbing
Inspector upon payment of the proper fee. The annual fee of
such licence shall be as follows:
For master plumber $ 15.00
For journeyman plumber 2.00
For a drain contractor 10.00
For a drain layer 2.00
(8) Applications fo~ renewal certificates of registration not
made within the month of January in each year shall require
the re-examination of the applicant and the payment of the
proper fee for such ~e-examination.
(9) Certificates of ~egistration as master or journeyman plumber
shall not be renewed ii' the Plumberst Licensing Board is sat-
isfied that the applicant is incompetent or has been guilty
of improper trade practices or of a second wilful violation
of any of the clauses of this or any other by-law pertaining
to plumbing.
(10) The certificate of registration of a master plumber who
discontinues his place of business and is no longer assessed
on the Township of Picketing ikssessment Roll as in business
shall not be renewable. However, at the discretion of the
Plumbers' Examining Board a certificate of registration may
be re-issued without examination upon payment of the regular
fee, if the applicant desires to reinstate himself in business.
(ll) A master plumber, who has an outside licence recognized by the
Township of Picketing and whose Firm or Corporation has its
place of business outside the Township of Picketing shall be
required to register his Firm o~ Corporation with the Township
of Picketing Works Department;
In addition to the normal annual fees, for the
licensing of plumbers, and annual charge for registration of
Fifty Dollars ($50.00) for each such Firm or Corporation
wishing to install plumbing or drains within the Township of
Picketing. Every such registration shall expire on the 31st
December of each yea,.
(12) Ail master plumbeps shall be held responsible for the acts of
thei~ agents or employees in respect to all plumbing, water
system, drainage and sanitary matters.

(13) The master plmnber and journeyman plumber being members of
the Examining Boa~l shall be reimbursed for the time spent
while acting as examine~ at the time of examinations, as
follows: One dolla~ and fifty cents for each journeyman
plumberls examination, and Three dollars for each master
plumber's examination. The Township Engineer and the Plumbing
Inspector, being paid employees of the Township of Picketing,
shall not be entitled to examination reimbursement.
(14) Any person who
(a) assumes responsible charge and direction of plumbing or
engages himself or holds himself out as qualified to
undertake on his own behalf to perform plumbing work
without being licensed as a master plumber;
(b) employs~ whether for gain or otherwise, any person other
than a licensed maste~ plumber to do plumbing work and is
not himself licensed as a master plumber;
(c) engages himself in employment as a journeyman plumber or
apprentice or improver without being licensed or registered
as such under this by-law;
(d) being a maste~ pll~nber shall cause or permit an
apprentice or helper or other unlicensed person to per-
form any plumbing work or install any plumbing material
or appliance within the meaning of this By-Law except
as an assistant to and in the presence of and under the
direct personal supervision of a licensed Master Plumber
o. journeyman plumber, continuously employed on the
same contract or job, shall be guilty of an offense
under this by-law and shall be liable to the penalties
hereinafter provided.
(15) All master plumbers who are so licensed by the Township of
Picketing and engaged in the trade of plmnbing at the time of
the passing of this by-law shall be exempted from taking the
examination hereinbefore described. Any journeyman plumber
employed as such at the time of the passing of this by-law
who supplies to the Examining Board a letter from his
employer certifying to the competence of his work may at the
discretion of the Examining Board be exempted from the
examination hereby described.
(16) Any person convicted of a breach of the provisions of this
By-Law shall forfeit his licence, and pay at the discretion
of the convicting Magistrate, a penalty not exceeding the
sum of Three~ Hundred Dollars ($300.00) for each offence,
exclusive of costs.
(l?) That By-Law Number 2454 be and the same is hereny repealed.
