HomeMy WebLinkAboutBy-law 2576 T~ CORPORATION ?( A BY-LAW TO DESIGNATE AN AREA OF PART LO~ CONTROL WHEREAS Section 26 of The Planning Act, R.S.O. 1960, C.296, provides as follows: 26. - (1) The Council of a ..,.4 cipality may by by-law designate an~ area within the municipality as an area of subdivision contrel, and thereafter no person shall convey land in the area by way of a deed or transfer on any sale, or enter into an agreement of sale and pur- chase of land in the area, or enter into any agreement that has the effect of granting the use of or right in / land in the area directly or by entitlement to renewal for a period of twenty-one years or more, unless the land is described in accordance with and is within a registered plan of subdivision, and the council may, in the bT-law designate a registered plan of subdivision or part thereof which shell be deemed not to be a registered plan of subdivision for the purposes of this subsection. (2) The by-law may provide that where land is (a) within a registered plan of subdivision; or (b) within a registered plan of subdivision, or a part thereof, designated in the by-law, no person shall convey a part of any lot or block of the lan by way of a deed or transfer on any sale, or enter into an agreement of sale and purchase of a part of any lot or black of the land, or enter into any agreement that has the effect of granting the use of or right in a part of any lot or block of the land directly or by entitlement to renewal for a period of twenty-one years or more; and when the by-law con- rains any such provision, no person shall contravene the provision. (3) Nothing in subsection 1 or 2 prohibits any conveyance or agreement respecting land; (a) if the land is ten acres or more in area and the remnant, if ar~, remaining in the grantor is also ten acres or more~ or (b) if the land is the whole part remaining to the grantor of one parcel described in a registered conveyance to him; or (c) if the consent, (i) of the plann1~ board ef the planning area in which the land lies, or (ii) where the land lies in more than one planning area, of the planning board designated by the Ni~ister from time to time, or (ill'hers there is no planning board, of the Ninister, is given to the conveyance or agreemente -2- (4) Two certified copAes of the by-law sh~ll be lodged in the office of the Minister where they . shall be available for public inspection during office houre~ and the by-law shall be registered in the proper registry office where it shall be made available to the public as a production. (~) Where a registered plan of subdivision or a part thereof is deemed under the by-law not to be a i'~ registered plan of subdivision, the clerk of the ,wm~cipality shall, within ten d~vs after the by-law ,~ is passed, send notice of the passing of the b-law by mail to the last known address of each person appearing by the last revised assessment roll to be the owner of land within the plan of subdivision or part. (6) ~%.ere the by-law contains provisions authorized by subsection 2, the clerk of the ww,~ictpality shall, ~'~, within ten days after the by-law is passed, send \~'~ notice of the passing of the by-law by mail to the ~' last known &ddra~s of each person appaar~ by the last revised asses_-me_ut roll to be the owner of land within ar~ registered plan of subdivision, or within any part of ~ reg~tered plan of subdivision, to which such provisior~ apply. ~(\"~(7) When an area is designated as an area of ~ subdivision control, it shall not be altered or ' dissolved without the approval of the Minister. ~:(8) Every person who contravenes this section is ~ guLlty of an offence and on summary conviction is liable to ~ 7f~n~ ~ of not more than $~00; AND ~, pursuant to Section 26, the Council of the said Township deems it desirable to designate the lots and blocks of ]~nds hereinafter d~scribed as iota or blocks no part of which shall be conveyed other than the whole of such lot or block. ~ THEREFORE, the Council of The Corporation of the Township of Pickering hereby enacts as follows: 1. All of the lets and blocks according to the following plans of subdivision ara hereby designated as Area of Part Lot Control Number 1. ALL AND SINGULAR those certain parcels or tracts of lands situate lying and being in the Township of Pickering in the County of Ontario and being all of the lots and blocks according to the following plans filed at the Office of Land Titles at Whitby. ~ M - II '72 M- 12 '73 M-13 - M - 15 76 M - 17 M - 18 79 M-20 -3- 2. No person shall convey a part of any lot or block of the lands included in Area of Part Lot Control Number 1 by way of deed or tremsfer on any sale or enter into an agreement of sale and purchase of a part of any lot or block of the said lands or enter into any agreement that has the effect of granting the use of or right in a part of any lot or block of the said lands directly or by entitlement to renewal for a period of twenty-one years or more. 3. Nothing in this by-law shall be deemed to affect any conveyance or agreement affecting one or more whole lots or blocks included in the said plans or affecting any of the lots or blocks included in the said lands where subsection (3) of section 26 has been complied with. This by-law shall come into force and take effect on the date on which it is finall~ passed. By-law read a third time and finally passed this/.~4..~., day ~,1961
