HomeMy WebLinkAboutBy-law 2336 ~ ~ a Municipal By-Law Respecting Licences for Nursing Homes The Council of the Corporation of the of PTC*(~FTVq enacts as follows: ~ 1. In this By-law (a) "Board" means the Local Board of Health for the T~¢alIh of e~t~rio Coquets' ,,(qouthcr%, l~.,~ (b) "nursing home" means any premises in which persons are cared for or lodged for hire where, in addition to sleeping accommodation and meals, personal care, nursing services, medical care and treatment are provided or made a~ailable, (c) "occup£er" means the person who operates a nursing home under this By-law, (d) "personal care" means personal services such as the provision of aid to residents in walking or in climbing or descending stairs, in getting in or out of bed, in leeding, dressing, bathing or in other matters of personal hygiene, and includes the preparation of spccial diets, the provision of tray service for meals, the supervision of medication and other similar types of personal assistance, (e) "resident" means a person who is cared for or lodged for hire in a nursing home. 2. No person shall, within the limits of the of PT~PT¥~ operate a nursing home unless or until he has obtained a licence therefor from the I~!~.'~'~, ~f, 4. Each licence shall be issued in respect of a specified locetion and the licenca shall not be used by the occupier for a location other than the om~ specified therein. '~·, ~ ~.~ ,, 5. Each licence shall be issued in respect of a specified .. ' number of persons and the occupier shall not permit a number of persons greater than that specified in the licence to be cared for or lodged for hire at the location in respect of which the licence is issued. 6. Every applicant for a licence or renewal of a licence to operate a nursing home shall submit a written application in which he shall state: (a) the name and address of the applicant; (b) location of the premises for which the licence is sought; (c) the number of rooms used for sleeping acco~odation by the residents and the number of beds in each; (d) the maximum number of residents which the applicant proposes to accommodate at one time; (e) the number of bath-tubs or showers, wash-basins and flush toilets available for use by the residents; (f) such other information as the Board may require. 7. Each application for a licence or renewal of a licence shall be accompanied by (a) a certificate of an officer authorized to inspect buildings under The Fire Marshals Act certifying that the premises have been inspected by him within 3 months of the date of application and that they are reasonably safe from fire hazard; and (b) a certificate of the Medical Officer of Health certifying that the premises have been inspected by him or his representative within thr~e months of the date of the application, and that, in his opinion, they are in reasonable compliance with the requirements of this By-law. 8. The occupier shall provide sleeping accomraodation for residents in rooms with a minimum of (a) 400 cubic feet of air space and fifty square feet of floor space for each person under sixteen years of age, (b) 600 cubic feet of air space and seventy-five square feet of floor space for each person sixteen years of age and over, and each room so used shall contain at least one window opening directly to the outside air, and the size of the window shall be not less than 10 per cent of the floor area of the room and shall be capable of being opened or closed at all times. 9. Sleeping accommodation shall not be provided in any space in the premises used as a lobby, hallway~ closet, bathroom, stairway or kitchen. 10. The occupier shall provide toilet and bathing facilities which are readily accessible to all residents with a minimum of one wash-basin and one flush toilet for every eight residents and one bath-tub or shower for every twelve residents· 11. The occupier shall not admit or retain as a resident any maternity case~ or any person who requires treatment for alcoholism, drug addiction, mental illness or disease, or any person who reqhires active medical or surgical care or treat- ment of a kind usually provided in a hospital. 12. The occupier shall (a) provide for nursing services for residents by or under the supervision of a registered nurse, and (b) ensure that medical care and attention are made available by a duly qualified medical practitioner to residents as required. (4) ~ ~.t~ 13. The occupier shall employ such persons who are in the opinion of the Board or the Medical Officer of Health sufficient in number and qualified to provide the nursing 'services and personal care required by the residents. 14. The occupier shall provide (a) nourishing meals at regular intervals and special diets, where required, prepared by or under the supervision a competent person, and (b) adequate and sanitary supplies of milk and drinking  ~ 15. The occupier shall keep or cause to be kept a register · of persons resident in the nursing home which shall set forth (a) the name, age, sex and former place of abode of each resident, (b) the date and circumstances of his admission to the home, (c) a record of ail medical examinations after admission, the diagnoses and orders of duly qualified medical practitioners, and the medicines, medications and treatments prescribed or administered, (d) the date, the circumstances of his discharge from the home and the name and address of the person or institution in whose care or to which he was discharged, (e) in the event of the death of the resident, a record of the circumstances of the death and the name and address of the person claiming the body, and (f) such other additional information as may be re- quired by the Medical Officer of Health. (5) 16. The occupier shall maintain the nursing home in a thoroughly clean, safe and sanitary condition, and without limiting the generality of the foregoing, he shall (a) eliminate fire hazards including the provision and maintenance of (i) protection from radiators or other heating equipment, (ii) water supplies adequate for all normal needs including those of fire protection, and (iii) at least two separate means of egress to the outside from floors with sleeping accommodation; (b) maintain a minimum temperature of 68 degrees ~~ Fare~h~it in th~.~sing home~o~-'~he la.t~f October ~the 31s~ of'May; (c) have the premises inspected at least once in every -~~I-%-~- months by an officer authorized to inspect buildings under The Fire Marshals Act; (d) have the premises inspected at least once in every~I~--- months by the Medical Officer of Health or his representative; (e) keep all parts of the building free from rubbish, garbage, ashes, flammable materials and other debris; (f) keep the cellar of the nursing home well drained and ventilated; (g) keep the nursing home weatherproof, free from dampness, adequately heated, and all heating equipment in good repair;/~~ (h) maintain adequate kitchen equipmeat~and facilities to ensure the proper preparation and protection of food; (i) take all necessary steps to keep the building free from vermin, insects and pests. (6) . 17. The Medical Officer of Health or his representative, an officer authorized to inspect buildings under The Fire Marshals Act or any employee of the Corporation required to administer or enforce the provisions of this By-law may enter a nursing home at any and all reasonable times for the purpose of inspecting the premises and every part thereof to ascertain whether the provisions of this By-law are being or have been complied with and it shall be an offence for any person to prevent or obstruct any such official from carrying out his duties under this By-law. 18. In every nursing home, the licence shall be posted in a conspicuous place in the lower hallway and a printed copy of this By-law shall be made available by the occupier for examination upon the request of any resident in the nursing home. under this By-law, and notice thereof shall be given by the Board by registered letter mailed to the occupier at the address in respect of which the licence was issued. 20. Each licence shall be in force for one year from the 1st day of J?~T'I*.~P¥ to the 31st day of 21. Any occupier or other person concerned in the management of a nursing home who is guilty of an offence under this By~law shall on summary conviction be liable to a penalty of not more than $ ] 0o...- for each offence. ~A~ 22.
