Recommendation:
That the refusal of the Sign Permit Application #03-016 submitted by Shoeless Joe's
respecting property at 1725 Kingston Road be upheld.

That Application #03-016 for a Sign Permit submitted by Shoeless Joe's respecting
property at 1725 Kingston Road be approved.
Executive Summary:
The Manager of Shoeless Joe's that is located at 1725 Kingston Road has appealed
the decision of the Municipal Law Enforcement Officer to refuse the issuance of a Sign
Permit. .Such an appeal is allowed under Section 6(3) of By-law 2439/87 (Sign By-law).

Background:
Please be advised that a representative of Shoeless Joe's Restaurant and Pub, which
is located in the plaza at 1725 Kingston Road, applied for a Sign Permit to locate an
additional sign above the established sign band for the building contrary to the
approved Site Plan. A copy of a rendition of the requested sign is attached hereto for
your information.

Pursuant to Section 6(1) of By-law 2439/87 (Sign By-law), the application was
circulated to the Fire Chief, Chief Building Official and Director, Planning &
Development to determine if there were any deficiencies in the application. The Fire
Chief and Chief Building Official responded that there were no deficiencies within their
areas of jurisdiction, however, the Director, Planning & Development reported that the
proposed sign would be in contravention of the approved Site Plan for this plaza. A
copy of the report of the Director, Planning & Development is attached hereto for
information.
Based on the report of the Director, Planning & Development, the application for the
Sign Permit was refused.
Pursuant to Section 6(3) of the Sign By-law, an applicant may appeal to Council a
refusal of a Sign Permit Application. In a letter dated March 6, 2003, a copy of which is
attached hereto, the Manager of Shoeless Joe's has submitted an appeal.
Section 6(3) merely states "that Council shall hear any representations from the
applicant and make a determination."

Application for Sign by-law Variance
This letter is to formally apply for a sign by -law variance,
The application for a sign pennit for Shoeless Joe's at 1725 Kingston Road, Unit #14,
Pickering, Ontario L1V 4L9 was refused and now I need to appeal to City Council for a
sign permit approval.
The grounds for appeal, is based on the site line limitations at the plaza location.
I hope to be able to appeal the decision at the next meeting scheduled for early April '03.

The sign permit for Shoeless Joe's restaurant at the Brockington Plaza
(permit no. 03-016) was refused, by the Planning & Development Department, under
the Director's delegated Site Plan Approval authority. The applicant proposed to locate
an additional sign above the established sign band for the building contrary to the
approved site plan. Shoeless Joe's restaurant is presently identified by a sign within
the existing sign band and additional signage within a pylon sign on the Kingston Road
frontage. The proposed additional sign is considered excessive, unattractive and
unwarranted.
Section 13.15(b) of the Pickering Official Plan indicates, "City Council shall, encourage
the use of an appropriate variety of signage types,.. .which complement building
designs rather than dominate them;". The applicant's proposal is not representative of
co-ordinated signage, would result in a disjointed, unbalanced design, and would
establish an unacceptable precedent. Approval of this sign permit would likely result in
a competition amongst tenants for signage exposure, with additional signage requests
being made to the City.
If the applicant feels that signage opportunities are inadequate for this building, the
Planning & Development Department recommends that the applicant discuss this issue
with the landowner to explore opportunities to improve the overall building façade so
that more attractive and effective signage can be achieved for all tenants.
