HomeMy WebLinkAboutBy-law 2208B Y- L A W N U M B E R 2 2 0 8 A BY-LAW OF THE TOWNSHIP OF PICKERING TO TAKE OVER AND ASSUME AS A TOWNSHIP ROAD A CERTAIN ROAD IN PLAN 284. BE IT ENACTED by the Municipal Council of the Township of Pickering that: THAT proposed road which will comprise Block C in Plan 284 as widened to a width of 66 feet, and the approach to said Block C from the present Township road at easterly end of Taylor Road, which will also be 66 feet in width, be and it is hereby declared a Township road as of the date of the passing of this By-Law. The conditions of payment and signatures requesting such roads to be taken over, as set out on Schedule "A" shall form a part of this By-Law. ..b BY-LAW read a First and Second time this 1.41 day of xv_? 1957 BY-LAW read a Third time and PASSED this Aw day of ?-/ 1957 A?f Reeve S C H E D U L E " A" Attached to and Forming Part of By-Law Number 2208 A G R E E M E N T made this Thirty-First day of December, 1956, B E T W E E N All OWNERS whose land abuts the proposed road herein described OF THE FIRST PART - and - THE MUNICIPAL CORPORATION OF THE TOWNSHIP OF PICKERING in the Province and County of Ontario, herein called the CORPORATION OF THE SECOND-PART WHEREAS, by petition, the Owners have requested this Corporation to create cebtain improvements upon the following road and assume same as a Township of Pickering Public Road: THAT proposed road which will comprise Block C in Plan 284 as widened to a width of 66 feet, and the approach to said Block C from the present Township road at easterly end of Taylor Road, which will also be 66 feet in width; AND WHEREAS that said Corporation has agreed to make such improvements upon the terms hereinafter set out; NOW THIS AGREEMENT WITNESSETH That FIRSTLY: The said Corporation will extend on its own authority and in its own manner so as not to exceed the sum of $ 5,000.00 (Five Thousand Dollars) upon the building of the road foundation and culverts upon the said road, and providing suitable drainage for same. SECONDLY: The said Corporation will extend on its own authority and in its own manner so as not to exceed $2,200.00 (Two Thousand, Two Hundred Dollars) upon the building of a 4-inch cast iron watermain from Taylor Road to the east limit of Block C, with service connections to lot line at such places as are staked by the Owners. AND THE SAID CORPORATION will levy upon the Owners of Lots 58-59-60-61 in Plan 284 the cost of such work on the basis of four equal portions spread out equally over the years 1957-1958-1959-1960 and 1961; that each of the said Owners covenant that he, she, or they are owners in fee simple of their respective lands, and that the said Corporation may, if it wishes, register this Agreement, or a copy of same, in the Registry Office for the Registry Division of the County of Ontario at Whitby, as notice to subsequent purchasers that the lands of the Owners are charged with the aforesaid five levies. It is also agreed by and between the said parties hereto that the manner and method of carrying out the aforesaid improvements on the said roads will be in the absolute dis- cretion of the Corporation, the officers, servants or agents of the Corporation; !nd that the said Owners shall have no right of action against the said Corporation resulting from nonfeasance or malfeasance. AND THE SAID OWNERS agree to convey to the Party of the Second Part deeds of land which, with Block C. Plan 284, will give a road width of 66 feet and includ in above cost any necessary guard rails. AND THE SAID OWNERS agree to the installation by the said Corporation of a Johns-Manville culvert at least 18 feet in length to be placed on the road, in the ditch at the driveway of each Owner, and at a place staked by the Owner, im,mediately on completion of the work. The Cor- poration agrees to install said culvert at cost price, and to put gravel thereon, and the same will be added to the Ownerst tax bills in the year 1957. - 2 - AND THE SAID OWNERS for themselves, their respective heirs, executors, administrators, successors or assigns, covenant to carry out and put into effect the terms of this agreement.
