A BY-LAIN OF THE MUNICIPALITY Ors' THE TOWNSHIP OF PICKERING TO ESTABLISH
A NEW SCHOOL SECTION TO REPLACE THE TOWNSHIP OF PICKERING LANDS WHICH
FORMERLY COMPRISED A PART OF SCARBORO SCHOOL AREA NO. 2.
WHEREAS the owners in the Township of Pickering, which comprise a part
of Scarboro School Area No. 2 did petition Council to form a School
Section of their own.
AND WHEREAS the Councils' of the Townships of Pickering and Scarboro
appointed an arbritrator each, who,with the Public School Inspector's
and the Judge of the County of York presented their Award on March 10,
1953, which gave the sum of 08,067.57 to the proposed new School
Section as their assets in the Area No. 2.
BE IT THEREFORE ENACTED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF
PICKERING:
1. THAT all the lands west of the Large Rouge River, north of Lake
Tntario and east of the Scarboro Town Line shall be, after
January 1, 1954, a ne,, School Section, and the said School
Section shall be numbered Number 18, of the Township of Pickering.

IN THE COUNTY OF ONTARIO FOR FORv[ATION OF A SCHOOL SECTION
AWARD OF THE BOARD OF ARiI'TRATION
On the 25th day of December 1914, Union Public School erection No. 4
Pickering, and No. 11 carborough, as then constituted (hereinafter
called the "School Section") was joined with Public School Sections Nos.
7, 8, 9 and 15 in the Township of Scarborough (hereinafter called the
"School Area").
A Petition has been made by certain rate pavers under Section 32
of the Public Schools Act of the Province of Ontario for Separation from
the School Area of that part of the School Area 1?1ing in the Township of
Pickering and for the organization of such part as a new Public School
Section in the Township of Pickering (hereinafter called the "Proposed
School Section").
The following persons were appointed or are authorized under
Section 32 of The Public Schools Act of Ontario to act as arbitrators
to consider if such separation shall be implemented and what compensation
shall be paid: Mr. Robert Forsyth - Senior Judge of the County Court,
County of York: Mr. Arthur Archibald and Mr. Harold A. Halbert -
Public School Inspectors: Mr. W.H. Westney - appointed by the Council
of the Township of Pickering: Mr. Edwin B. Waldock - appointed by the
Council of the Township of Scarborough.
The above named met in 'Vest Hill Public School at 10 A.M., on
February 10th, 1953 to consider the said petition and hereby agree and
award as follows:
1. It is agreed that the Petition for the separation and organization
of the Proposed School Section shall be granted, to take effect on
the 25th day of December, 1953-
2. It would appear from the records of the Scho?l Area and the Township
of Scarborough that the value of the assets of the School Section
at the time it became part of the said School virea was $6,000.00,
more or less. It would also appear that in the year 1,944 the entire
amounts of taxes remitted to the School Section were x533.95 from
the Township of Pickering and '1,003.05 from the Township of
Scarborough. It is agreed that the portion of the aforesaid assets
to be awarded to the Proposed School Section shall be the same

The amount so calculated is

since its formation, the sum of $149,005.77 has been paid on account
of the principal of debentures issued on behalf of the School Area
for the erection of new schools, additions to old schools and other
capital expenditures. It would also appear that on the 1st of
January, 1952, the total assessed value for school tax purposes of
the property lying in the School Area was 07,709,794.00 of which
$309,579.00 was the assessed value of property lying in the
Proposed School Section. It is agreed that the portion of such
capital payments to be awarded to the Proposed School Section shall
be the same proportion of such capital payments as the assessed
value, as above set out, of property lying in the Proposed School
Section bears to the total assessed value, as above set out, of
property lying in the School Area. The amount so calculated is
$5,983.18.
4. The sum of $8,067.57, representing the total awards mentioned
above, shall be paid by the School Area to the Proposed School
Section as follows: $4,000.00 when application is made for such
payment by the Board of Trustees of the Proposed School Section
but not before the 1st day of July 1953, and the balance of
X4,067.57 on the 15th day of January, 1954•
5. Children of school aFe residing in the Proposed School Section
shall be entitled to attend school in the School Area during the
period from January 1, 1954 to the close of school in June, 1954
at a rate to be set by the School Area and based on its net cost
per pupil in the year 1953. Tuition fees as provided herein shall
be payable monthly to the School Area by the Proposed School
Section on submission to the Board of Trustees of the Proposed

School Section of a Statement of the number of such pupils and
the amount due.
6. The costs of the Arbitration shall be paid by the School Area.

"Clause No. 7
The proposed School Section in the Township of Pickering
shall not after January 1, 1954, be liable for any of the
capital liability existing at that time, whether debentured
or otherwise, of the Township of Scarborough or of School
Area No. 2 of the Township of Scarborough in connection with
the purchase of lands for public school purposes, the con-
struction and equipping of any public school property or
public school building located in the Township of Scarborough."
