OF THE CORPORATION OF THE TOWNSHIP OF PICKERING.
A By-Law to close a certain portion of the original allowance for road
between lots number 24 and 35 in the first range of the broken front con-
cession of the Township of Pickering, in the County and Province of Ontario,
and for the exchange and conveyance of the closed portions to certain of
the owners of abutting lands; and for establishing in lieu thereof as
public highways certain portions of the said lot number 34 in the first
and second ranges of said concession and of a part of the heretofore
closed original allowance for road between the said first and second
ranges of the broken front concession, opposite lot 34.
WHEREAS it is deemed in the public interest to closq, stop up, convey and
exchange a certain portion of the original allowance for road as herein-
after described and to establish as public highways in lieu thereof certain
Rands also as hereinafter described.
AND WHEREAS the closing and exchange of said portion of original allowance
for road and the establishment of highways in lieu thereof has received the
sanction of the owners of the lands abutting said portion of original
allowance for road and of the owners of the lands to be established as
public h#?ways in lieu thereof.
AND WHEREAS the Board of Railway Commissioners for Canada, by an Order dated
December 30th, 1930, and numbered 46052, has authorized the Canadian
National Railway Company to construct and maintain a public crossing on the
proposed diversion of said road, across the right of way of said Company,
on the said lot number 34, providing the portion of the said original
allowance for road that is now occupied by the right of way of the said
Railway Company be stopped up as a public highway and providing that a certain
farm crossing over said right of way on said lot 34 be stopped up as a
public highway and conveyed to the said Company.
AND WHEREAS printed notices of this By-Law have been posted up for four
weeks in six of the most public places in the immediate neighbourhood of
the portion of the said Highway to be closed as aforesaid and of the said
lands to be established as highways, and said notices have been published
for four successive weeks in the Pickering News, a newspaper published in
the said Township of Pickering.
AND WHEREAS the Council has heard in person or by Counsel or Solicitor all
persons whose lands might be prejudicially affected by the passing of this
By-Law who petitioned so to be heard.
NOW THEREFORE the Council of the Corporation of the said Township of
Pickering ENACTS AS FOLLOWS:
1. THAT upon and from and after the passing of this By-Law and the approval
of the same by the County Council of the County of Ontario and by the Lieut-
enant Governor in Council the portion of the original allowance for road
between Lotz-/Numbers 34 and 35 in the first range of the broken front
concession of the said Township of Pickering which extends for its full
width of 66 feet from a point that constitutes the North-Westerly limit
of the right of way of the said Canadian National Railway Company (said
point being distant 402 feet and one inch, more or less, measured southerly
16 degrees and 53 minutes East, along the westerly limit of said road
allowance from an Iron Bar, planted at its intersection with the southerly
limit of the 66 foot road allowance on said lot number 34 in range 2 of
said broken front concession that is known as Chester Hill Road) in a
Southerly direction to the waters edge of Lake Ontario, be and the same is
hereby closed and stopped up as a public highway.
2. THAT the following lands on lot number thirty-four in the first and
second ranges of the broken front concession of the said Township of
Pickering and on the original allowance for road between the aforesaid
first and second ranges of the broken front concession of the said township,

opposite lot number 34, be and the same are hereby established as
public highways that is to say:
(1) All and Singular that certain parcel of land situate, lying and being
composed of part of the said lot number 34 in the second range of the
broken front concession of the said township, which said parcel may be more
particularly described as follows:
COMMENCING at a cut stone monument marking the South-West angle of said
Lot 34;
THENCE North 16 degrees 53 minutes West in and along the Westerly limit
of said lot, a distance of 11 feet 1 inch to an iron pipe, planted, being
the place of beginning;
THENCE North 73 degrees .07 minutes East in and along the Southerly limit
of Chester Hill Road, a distance of 453 feet 52 inches to an iron bar,
marking an angle in said Southerly limit of road;
THENCE North 34 degrees 3 minutes East in and along said Southerly limit,
a distance of 79 feet 1 inch to a point;
THENCE North 55 degrees 38 minutes West, a distance of 66 feetto a stake
planted in the Northerly limit of said Chester Hill Road;
THENCE South 34 degrees 3 minutes West in and along the said Northerly limit,
a distance of 55 feet 11 inches to a stake, planted in an angle in said
Northerly limit;
THENCE South 73 degrees 07 minutes West in and along said Northerly limit
a distance of 430 feet, more or less, to an iron pipe, planted in the
Westerly limit of said loot 34, distant Northerly 66 feet from the place of
beginning;
THENCE South 16 degrees 53 minutes East, in and along the Westerly limit of
Lot 342 66 feet more or less, to the place of beginning.
(2) All and Singular that certain parcel of land on the said lot number
34 in range two of said broken front concession and including part ofthe
closed road allowance between ranges 1 and 2, which said parcel may be more
particularly described as follows:
COMMENCING at a out stone monument marking the South West angle of said
Lot 34 in the 2nd range;
THENCE North 16 degrees 53 minutes West in and along the Westerly limit of
said lot 34, a distance of 11 feet 1 inch to an iron pipe planted in the
Southerly limit of Chester Hill Road;
THENCE North 73 degrees 07 minutes east along the South limit of Chester
Hill Road 453 feet 52 inches to an iron bar, marking an angle in said limit;
THENCE North 34 degrees 3 minutes in and along said Southerly limit 13
feet 1 inch to a stake planted, being the place of beginning;
THENCE South 55 degrees 38: minutes East, a distance of 28 feet 2 inches,
more or less, to the Northerly limit of the right of way of the Canadian
National Railway Company, a distance of 66 feet to a point;
THENCE North 34 degrees 07 minutes East in and along said northly limit of
right-of-way, a distance of 66 feet to a point;
THENCE North 55 degrees 38 minutes West, a distance of 28 feet 4 inches,
more or leas, to a stake planted in the Southerly limit of said Chester
Hill Road;
THENCE South 34 degrees 03 minutes West, in and along said southerly limit
66 feet more or less, to the place of beginning.

lot number 34 in range 2 of said broken front concession and part of the
osed road allowance between said ranges 1 and 2, said parcel being more
,rticularly described as follows:
iMMENCING at the intersection of the Westerly limit of the said lot with the
?rtherly limit of the right-of-way of the said Canadian National Railway

:ENCE North 34 degrees 07 minutes East in and along the said Northerly
mit of the said right-of-way, a distance of 617 feet 5 inches to a pointi
ing the place of beginning;
ENCE South 55 degrees, 38 minutes East a distance of 80 feet, more or less,
a point in the Southerly limit of the said right-of-way;
ENCE North 34 degrees 07 minutes East in and along said Southerly limit,
distance of 66 feet to a point;
ENCE North 55 degrees 38 minutes West, a distance of 80 feet, more or less,
a point in the Northerly limit of said right-of-way, being distant
.sterly 66 feet from the place of beginning;
ENCE South 34 degrees, 1 minute West, in and along the said Northerly limit
the said Canadian National Railway Company, 66 feet, more or less, to the

right-of-way, a distance of 681 feet 10} inches to a stake planted, being

ENCE South 55 degrees 38 minutes East 230 feet, more or less to the water's
ge of Lake Ontario;
ENCE Westerly, following along the water's edge of Lake Ontario, a distance
66 feet, more or less, to a point, being the intersection of said water's
ge with a line drawn on a course of South 55 degrees 38 minutes East through
e place of beginning;
ENCE North 55 degrees 38 minutes West, a distance of 224 feet 6 inches, more
less, to the place of beginning.
THAT the portion of the original allowance for road in the first range of
id broken front concession that is occupied by the right-of-way of the said
nadian National Railway Company by deed shall be sold and conveyed by

change for the portion of land hereinbefore established as a public highway

Southerly direction to the water's edge of lake Ontario, be and the same is
hereby closed and stopped up as a public highway.
2, THAT the following lands on lot number thirty-four in the first and
second ranges of the broken front concession of the said Township of
Pickering and on the original allowance for road between the aforesaid
first and second ranges of the broken front concession of the said township,
