Being a by-law to license, regulate
and govern vehicles from which
refreshments are sold for comsumption
by the public.
WHEREAS the Municipal Act, R.S.O. 1960, Chapter 249,
Section 401, paragraph 11, as amended, the Corporation of the Township
of Pickering has authority to license, regulate and govern vehicles from
which refreshments are sold for consumption by the public and for revoking
any such licenses.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF PICKERING ENACTS AS FOLLOWS:
1. No person, being the owner of a vehicle or the lessee of a
vehicle rented by the owner thereof from which refreshments
are sold, shall drive or take such vehicle or permit such
vehicle to be driven or taken from place to place or to a
particular place within the boundaries of the Township of
Pickering for the purpose of selling refreshments from such
vehicle without first obtaining a license for that vehicle
under the provisions of this by-law.
2. The fees for a license under this By-law shall be:
$50.00 for each separate vehicle.
3. (a) A license issued under this by-law is valid only
from the date of its issue to December 31st of the
year of its issue and is not transferable.
(b) A license is subject to revocation by the Council
of the Township of Pickering at any time for non
compliance with such regulations as may be passed
by the Council from time to time or by the Medical
Office of Health.
4. A license shall only be issued after favourable recommendation
by the Medical Officer of Health.
5. No person shall, for the purpose of selling refreshments from
a vehicle, park or stop such vehicle within 500 feet of a
lunch counter, snack bar, restaurant, or refreshment booth
licensed by the Township of Pickering.
6. An applicant for a license shall be made to the Municipal
Law Enforcement officer on the appropriate form and the
necessary fee shall be paid to the Treasurer of the said
Corporation.
7. Every person who is required to obtain a license under Section 1
of this by-law shall receive with each license a metal plate
issued by the Township of Pickering bearing an identifying number
and such person shall at all times keep that plate securely and
permanently affixed to the outside of the vehicle in respect of
which the plate was issued. Also that person shall at all times
keep the license obtained under Section 1 of this by-law in the
vehicle for which it is issued.

8. Any person who contravenes aar provisions of this by=law
shall upon conviction be liable to a penalty not exceeding
$300.00 exclusive of costs, recoverable under The Summary
Convictions Act.
9. In this by-law:
(a) "persoit'shall include an individual, association,
firm, partnership or corporation.
10. By-law Number 3815170 is hereby repealed.
