BY-LAW NUMBER 3 S 70)
A By-law for licensing and requiring the
registration of dogs and for the control
of dogs within the Corporation of the
Township of Pickering and to repeal
By-law Number 3323.
WHEREAS the Corporation of the Township of Pickering has
pursuant to The Municipal Act, Section 379(1), paragraph 1, and
Part 1 of The Dog Tax and Live Stock and Poultry Protection Act,
authority to enact this By-law.
NOW, THEREFORE, the Council of the Township of Pickering
hereby enacts as follows;-
1. (a) "Dog" means a male or female dog, over the age of
12 weeks.
(b) "Owner" of a dog includes any person who possesses
or harbours a dog and "owns" or "owned" have a
corresponding meaning.
(c) "Animal Control Officer" includes the person or
Association who has entered into a contract with the
Corporation of the Township of Pickering to control
dogs and to maintain a dog pound and any servants
or agents of such person.
2. Every owner of a dog shall, on or before the 15th day of
February in each and every year, or upon becoming the owner
of a dog after the 15th day of February, register such dog
with the Corporation of the Township of Pickering and procure
a license and dog tag for each dog owned by him.
3. Every dog shall be inoculated with an anti-rabies vaccine
and the Township of Pickering may require an owner to produce
a certificate signed by a practising veterinarian that the dog
has been inoculated within a period of Twenty-four (2.4) months
of the date of application for the license and if required
to do so the owner shall produce such certificate.

4. Every dog tag shall bear the serial number and the year in
which it was issued and a record shall be kept by the
Corporation of the Township of Pickering showing the name
and address of the owner and the serial number of the tag.
5. The owner shall keep the dog tag securely fixed on the dog
at all times,
6. No person shall allow his dog to become a nuisance nor
permit it to howl or bark excessively. Any person so
aggrieved may appear before a Justice of the Peace and swear
out an Information on charging the owner with a breach of
91 this section,
7, The fee charged for the replacement of lost dog tags shall
be 25 cents.
8. Every person who fails to comply with Sections 2 or 4 of
this by-law or who uses a dog tag upon a dog other than that
for which it was issued is guilty of an offence and on summary
conviction is liable to a fine of not more than Ten Dollars
($10.00), exclusive of costs.
9. Every license issued pursuant to this by-law shall expire
on the 31st day of December of the year in respect of which
it was issued and the license fee to be paid to the Corporation
of the Township of Pickering at the time of the issuing of the
license shall be as follows:-
(a) license fee for first male dog ..............$5.00
license fee for a second male dog in a
household ...................................$7.50
license fee for each additional male dog
over two in a household ....................$15.00
(b) license fee for first female dog............ $8.00
license fee for a second female dog in a
household ..................................$15.00
license fee for each additional female dog
over two in a household ....................$25.00

10. The owner of a kennel of dogs that are pure-bred shall pay
an annual tax of $25.00 to the treasurer of the Corporation
of the Township of Pickering as a tax upon the kennel, and
he is not liable to pay in respect of such pure-bred dogs any
license fee under Section 9 of this by-law.
11. (1) No owner of a dog shall allow the dog to run at
large within the limits of the Corporation of the
Township of Pickering.
(2) For the purposes of this section, a dog shall be
deemed to be running at large when found elsewhere
than on the property of the owner and not under the
control of a competent and responsible person.
(3) Any person shall be entitled to take charge of any
dog found running at large and deliver the same to
the Animal Control Officer of the Township of Pickering.
(4) If the animal control officer is unable to seize any
dog found to be at large contrary to this by-law, and
the owner of such a dog is known to the animal control
officer,the owner shall be required to pay a pound
fee of Five Dollars ($5.00) to the animal control
officer within seven days of notification by the
animal control officer of the offence committed under
the by-law.
12. (1) Subject to Sub-section (4) of this section, a peace
officer or animal control officer may,
(a) Seize and impound any dog found running at large,
and,
(b) Restore possession of the dog to the owner thereof
where,
(i) The owner claims possession of the dog within
three days (exclusive of Statutory holidays
and Sundays) after the date of the seizure,

(ii) The owner pays to the peace officer or animal
control officer a pound fee of Five Dollars
($5.00) for a dog seized and impounded plus
a maintenance sum of One Dollar ($1.00) for
each day subsequent to the day of seizure
that the dog remains impounded.
(iii) Any female dog in heat found to be running
at large shall be seized and impounded until
no longer in heat, but in any case no longer
than 21 days; and the pound fee and maintenance
sum set out in sub-paragraph (ii) of paragraph
(b) of sub-section 1 of this Section shall apply.
(iv) Where a dog is seized and impounded, the owner,
if known, and whether the dog is claimed from
the pound or not, shall be liable for the pound
and maintenance fees prescribed, and shall pay
all fees on demand by the animal control officer.
(v) No dog shall be returned to the owner unless it
has been licensed in accordance with the pro-
visions of this by-law and any owner of a dog
without a license or a dog tag and any purchaser
of a dog without a license or a dog tag shall
obtain a license and a dog tag for the current
year before delivery is made.
(vi) Where a dog is seized and impounded, the owner
shall, prior to the release thereof, have the
dog inoculated with an anti-rabies vaccine or
produce a certificate signed by a practising
veterinarian that the dog has been inoculated
with an anti-rabies vaccine within the previous
Twenty-four (24) months.

(2) Where, at the end of the said three days, possession
of the dog has not been restored to the owner under
Sub-section 1 of this Section, the animal control
officer may sell the dog for such price as he deems
reasonable.
(3) Where the owner of a dog has not claimed the dog
within three days after its seizure under Sub-section (1)
of this Section and the dog has not been sold, the
animal control officer may kill the dog in a humane
manner or otherwise dispose of the dog as he sees fit
and no damages or compensations shall be recovered on
account of its killing or other disposition.
(4) Where a dog seized under Sub-Section (1) of this Section
is injured or should be destroyed without delay for humane
reasons or for reasons of safety to persons or animals,
the peace officer or animal control officer may kill the
dog in a humane manner as soon after seizure as he
thinks fit without permitting any person to reclaim the
dog or without offering it for sale and no damages or
compensation shall be recovered on account of its killing.
13. (1) Notwithstanding any other provisions of this by-law,
every person who contravenes any of the provisions of this
by-law is guilty of an offence and on summary conviction
is liable to a fine of not more than Fifty Dollars
($50.00), exclusive of costs, and every such fine is
recoverable under The Summary Convictions Act.
(2) Notwithstanding the provisions of Sub-section (1) of
Section 13 or the provisions of Section 2 of this by-law,
any person may, upon presentation of a summons issued
pursuant to this by-law alleging commission of an offence
under this by-law, pay out of Court within five days

from the date of issue of the said sum.ins
(exclusive of Saturday, Sunday and holidays), the
sum of Five Dollars ($5.00), if the summons provides
that such sum may be so paid out of Court, and upon
such payment no further proceedings are to be taken under
this by-law in respect of the said offence alleged in
the summons.
14. By-law Number 3323 is hereby repealed.
