being a by-law to authorize the construction
of sanitary sewers and watermains on St. Marti_nfs
Drive as local improvements under the provisions
of Sections 8 and 67 of The Local Improvement
Act, R.S.O. 1960 and amendments thereto.
WHEREAS it is expedient that the construction of the
works herein shall be undertaken at the cost hereinafter set
out as local improvements under the provisions of Section 8
of The Local Improvement Act, R.S.O. 1960 and amendments
thereto.
AND WHEREAS the cost of the works is to be levied by
imposing special assessments therefor against lands in a local r
improvement area hereinafter defined, pursuant to Section 67 of
The Local Improvement Act.
AND WHEREAS, pursuant to the said Act, notice of the
intention of Council to construct the local improvements and to
impose a special rate within the local improvement area has been
published.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF PICKERING ENACTS AS FOLLOWS:
1. That sanitary sewers be constructed on St. Martin's
Drive from Radom Street to a point approximately 640 feet Northerly
at a total estimated cost of $9,300.00 as a local improvement
under the provisions of The Local Improvement Act, R.S.O. 1960
and amendments thereto.
2. The entire cost of the said sanitary sewers,
$9,300.00, including debentures, shall be specially assessed
and levied on all rateable property within the local improvement
area set out in Schedule °A° attached hereto which is hereby
defined as a Local Tmprovement Area pursuant to Section 67(1)
of The Local Improvement Act, R.S.O. 1960 and amendments thereto

and to be paid by an annual rate of $1.36 per foot on the lands
specially assessed.
3. That watermains be constructed on St. Martin's
Drive from Radom Street to Bayly Street at an estimated cost
of $10,000.00 as a local improvement under the provisions of
The Local Improvement Act.
4. The entire cost of the said watermains, $10,000.00,
including debenture charges, shall be specially assessed and
levied on all of the rateable property within the local improve-
ment area set out in Schedule °A° attached hereto which was
defined as a Local Improvement Area under paragraph 2 of this
By-law and be paid by an annual rate of $1.46 per foot on the
lands specially assessed.
5. The Engineer of the Corporation is hereby authorized
to make such plans, profiles and specifications and furnish such
information as may be necessary for the making of contracts for
the doing of the work or for carrying out the same by day labour
and the work shall be carried on and executed under the super-
intendence and according to the directions and orders of the said
Engineer.
6. The entire cost of the sanitary sewers and water-
mains is to be paid by the issuing of debentures bearing interest
at the ratr, of 8? per cent per annum and be repaid by the special
assessment over a term of twenty years.
7. The Treasurer of the Township may, subject to the
approval of Council, agree with any bank or person, for temporary
advances of money to meet the cost of the work pending completion
thereof.
8. Any person whose lot is specially assessed may
commute by a payment in cash the special rate imposed by paying
the cost of construction assessed upon such lot without the
interest forthwith after the special assessment roll has been
certified by the Clerk, but may not commute after the debenture

by-law has been passed.

Local Improvement Area.
Those lands fronting or abutting the west side
of St. Martin's Drive between Bayly Street and a point
approximately 725 feet South of the South limit of Bayly
Street and those lands fronting or abutting tho East side
of St. Martin's Drive between Bayly Street and Radom
Street.
