HomeMy WebLinkAboutBy-law 4474/73I THE CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAW *4-7 73 Being a restricted area by-law to implement the Official Plan of the Township of Pickering in Part of Lot 19, Concession 1, Township of Pickering. NOW THEREFORE the Council of the of Pickering enacts as follows: SECTION I: SCHEDULES Schedules "A", "B" and and references shown thereon are of this by-law and are described Corporation of the Township "C" hereto with notations hereby declared to be part as follows: Schedule "A" Highway 2 - Brock Zoning Map Schedule "B" Standards & Provisions Schedule "C" Building & Structure Set-back Provisions. SECTION 2: AREA RESTRICTED The provisions of this by-law shall apply to all lands enclosed by heavy black line on Schedule "A" hereto. SECTION 3: GENERAL PROHIBITION No building or land shall hereafter be used or occupied, no building or part thereof, shall be erected, moved or structurally altered except in conformity with the provisions of this by-law. SECTION 9: DEFINITIONS "Coverage" shall mean the percentage of lot area covered S all b ldings. "Dwelling" shall mean one or more rooms, occupied or capable of being occupied as an independent and separate housekeeping unit containing a separate kitchen and sanitary facilities. "Landscaped Open Space" shall mean that percentage of the lot area not covered by buildings driveways and parking spaces. "Residential-Multiple" shall mean a building divided vertically into 3 or more dwelling units, each having independent external entrances at grade level of the building. "Private Garage" shall mean an enclosed or partially enclosed structure for the storage of one or more vehicles, in which no business, occupation or service is conducted for profit. "Storey" shall mean that portion of a building (including a basement which is less than 50% below ground level) between the surface of any floor and the surface of the floor, roof deck or ridge above it. This shall not include a cellar or attic. continued .... 2 1 - z - "Neighbourhood Park" - is a public park including recreation uses, buildings and uses accessory thereto. SECTION 5: PROVISIONS The performance standards and provisions as set out on Schedule "B" hereto shall apply to the Area restricted by this By-law. SECTION 6: BY-LAW 3036 By-law 3036 as amended is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule "A" hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the provisions of By-law 3036 as amended. SECTION 7: ENFORCEMENT Any person convicted of a breach of any provision of this By-law shall forfeit and pay, in the discretion of the convicting Magistrate, a penalty not exceeding (exclusive of costs) the sum of Three Hundred Dollars ($300.00) for each offence, recoverable under The Summary Convictions Act. SECTION 8: EFFECTIVE DATE This By-law shall come into force and take effect upon being passed by Council subject to the approval of the Ontario Municipal Board.
