BEING A BY-LAW TO AMEND BY-LAW 1978
AS RMENDED BY BY-LAW 4104/72
WHEREAS By-law 4104/72 passed on the 18th day of September
1972, amends By-law 1978 so as to require a minimum sideyard
setback of twenty-five feet (251) where an Industrial zone
flanks any other zone.
AND WHEREAS Smid Construction Limited has an existing
building in a flanking industrial zone with a ten foot (109)
sideyard setback and has indicated its desire to expand the
existing building with a similar sideyard setback.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF PICKERING ENACTS AS FOLLOWS:-
1. By-law 1978 passed on the 18th day of December, 1953
as amended by By-law 4104, be and the same is hereby
amended by adding the following sentence to Section
8.2.1 thereof:-
"Provided that this exception shall not apply
in respect to the whole of Lots 155 and 156
and part of Lots 154 and 157 on Plan 319, all
of which are shown outlined in red on Schedule
"A" to this By-law."
2. By-law 4247 is hereby repealed.
No Part of this By-law shall come into force without the
approval of the Ontario Municipal Board but subject to such
approval this By-law shall take effect from the date of
passing thereof.
