The Council of the Corporation of the Township of Pickerini; ENACTS AS FOLLOWS: PART 1 - DEFINITIONS For the purpose of this by-law:- (a) Commercial Motor Vehicle means a motor vehicle having permanently attached thereto a truck or delivery body and includes an ambulance, hearse, casket wagon, fire apparatus, police patrol, motor bus and tractor, used for hauling purposes on the highways. (b) Coroer means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic. (c) Crosswal!c means that portion of a roadway ordinarily included within the prolongation or connection of the lateral lines of sidewalks or any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings. (d) Gross Weight means the combined weight of vehicle and load. (e) Highway - See Street or highway. (f) Intersection means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines.of two or more roadways which join one another at an angle, whether or not one crosacc the other. (g) Park or Parking when prohibited, means the standing o.-' a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. (h) Pedestrian means a person afoot and invalids and children in wheeled carriages. (i) Roadway means the part of the highway that is improved., designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively. (j) Sidewalk means that portion of a street between the curb lines or the lateral lines of a roadway and the adjacent property lines intended for the use of pedestrians. (k) Stand or standing when prohibited, means the halting of a vehicle, whether occupied,or not, except for the purpose of and while actually engaged in receiving or dischargin passengers. (1) Stop when required, means a complete cessation of movement. - 2 - (m) Stop or Stoppinu,when prohibited, means the halting of a vehicle even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal. (n) Street of Highway includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles. (o) Traffic includes pedestrians, ridden or herded animals, vehicles and other conveyances either singly or together while using any street for purposes of travel. (p) Traffic Control Device means any sign; or roadway, curb or sidewalk marking; or other device erected or placed under the authority of the Council for the purpose of guiding or directing traffic. (q) Traffic Signal means any device manually, electrically or mechanically operated for the regulation of traffic. (r) Vehicle includes a motor vehicle, trailer, traction engine. farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or the cars of electric or steam railways running only upon rails. PART 11 - OBEDIENCE TO TRAFFIC REGULATIONS 1. Police to Enforce B,Z--law The police department shall enforce the provisions of this by-law. PART 111 - PARKING - (Method of Parkin 1. Parallel No person shall park a vehicle on any street other than a one-way street unless on the right-hand side of the street; having reard for the direction in which the vehicle had been proceeding and unless the right-front and right rear wheels or runners of the vehicle are parallel to and distant respectively not more than six inches from the edge of the roadway, provided that this provision shall not apply where angle parking is specifically authorized by by-law. 2. Parkin-, prohibited (1) In Specified Places No person shall park a vehicle in any of the following places;- On a sidewalk In front of a public or private driveway. Within an intersection. Within ten feet of a fire hydrant. On a crosswalk Within twenty feet of a crosswalk at an intersection. On any bridge, or in any subway, or the approaches thereto. - 3 - On any street in such a manner to to obstruct traffic. In such a position as will prevent the convenient removal of any other vehicle previously parked or standing. In front of the entrance to a botel. In front of the entrance to an office building, In front of the entrance to any place where goods or merchandise are regularly delivered or removed. In front of the entrance to a hospital In front of the entrance to a theatre, auditorium or other building while large assemblies are being held in such theatre, auditorium or other building, or for a reasonable time immediately preceding and following such assemblages. On the boulevard of any curbed street, between the curb and the adjacent property line. (2) In Specified Places Where Signs on Display When properly worded signs have been erected and are on display, no person shall park a vehicle in any of the following places:- Within fifty feet of any intersection on any through hi,.hway. Within twenty-five feet of the lot on which a fire hall is located on that aide of the :street on which such fire hall is located or within one hundred feet of such lot on the opposite side of said street. Within eighty feet of any point designated as a bus or coach stop. Between 8:30 A.M. and 4:30 P.M. upon that side of the street adjacent to any school property. (3) Bus and Taxicab Stands (a) No person shall stand or park a motor bus or taxicab upon any street in any business or residential district at any place other than at a bus stop or taxicab stand respectively, except that this provision shall not prevent the driver of any such vehicle from temporarily stopping the vehicle in accordance with other stopping or parking regulations at any place for the purpose of and while actually engaged in loading or unloading passengers. (b) No person shall stop, stand or park a vehicle other than a bus in a bus stop, or other than a taxicab in a taxicab stand when any such stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading or unloading passengers when such stopping does not interfere with any bus or taxicab waiting to enter or about to enter such zone. - 4 - (4) Parking Restrictions on Specified Streers When properly worded si_-Ins have been erected and are on display, no person shall park a vehicle on any street, streets or parts of streets hereinafter set out in Column 1, on the side or sides of the streets set out in column 2, during the period set out in Column 3:_ Column 1 Street Alyssum Street Annland Street Antonio Street (entire length) Balaton Ave. Breezy Drive Brock Road From Krosno Blvd. Liverpool Rd. (b) Where there is no curb or a rolled curb, with the right front and rear wheels parallel to and as near to the right hand limit of the highway as is practicable without stopping or parking over a sidewalk or footpath or over any part of the highway where grass is grown or which is not intended for the use of vehicle's. 11. I 5 PART 1V - OPERATION OF VEHICLES 1. TURNS (a) When properly worded signs to that effect have been erected and are on display, no person operating a vehicle in the direction hereinafter nave' in Colin 1 shall turn such vehicle to the left at the intersection named in Column 2 during the period between 3:30 p.m. and 5:30 p.m. Monday to Friday. COLUMN 2 INTERSECTION Sandy Beach Road and Parkham Crescent Sandy Beach Road and Alyssum Street Sandy Beach Road and Drava Street The driver of a vehicle emerging from a driveway, lane, lot or 'uuilding shall stop the vehicle immediately prior to driving onto the sidewalk and shall not enter the roadway until he can do so in safety. Funeral and Other Processions (a) No person shall intersect a funeral or other properly authorized procession while it is in motion except under the direction of a police officer. (b) The driver of a vehicle in a funeral or other procession shall drive as near to the right-hand edge of the road- way as practicable and follow the vehicle ahead as close as is practicable and safe. PART V - PENALTIES 1. Any person violating any of the provisions of this by-law shall be subject to a penalty of not more than Ten Dollars ($10.00) for the first offence and not more than Twenty-five Dollars ($25.00) for every subsequent offence, exclusive of costs, and all such penalties shall be recoverable under the Ontario Summary Convictions Act. EA&T V1 1. ONTARIO HIGMAY TRAFFIC ACT TO GOVERN The provisions of this By-law shall be subject to the provisions of The Highway Traffic Act and ammendments thereto. 2. By-laws Repealed By-Law Numbers 1909, 2517, 2575, 2599, 3065, 3107, 3220, 3304, 3509, 3528, 3580, 3625, 3658, 3876, 3897 and 3957 of the Township of Pickering are hereby repealed. 3. This By-Law shall not become effective until approved by the Department of Transportation and Communication and until the signs referred to herein have been erected and are on display.
