BY-LAW NUMBER
being a by-law to authorize the
construction of a paved road and
watermains on Montgomery Park
Road and a proposed industrial
road as local improvements under
the provisions of section 8 and
68 of The Local Improvement Act,
R.S.O. 1970, and amendments thereto.
WHEREAS it is expedient that the construction of the
works herein shall be undertaken at the cost hereinafter set
out as local improvements under the provisions of section 8
of The Local Improvement Act, R.S.O. 1970 and amendments thereto.
AND WHEREAS the cost of the works is to be levied by
imposing special assessments therefor against lands in a local
improvement area hereinafter defined pursuant to section 68 of
The Local Improvement Act.
AND WHEREAS, pursuant to the said Act, notice of the
intention of Council to construct the local improvements and to
impose a special rate within the local improvement area has been
published.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF PICKERING ENACTS AS FOLLOWS:
1. That watermains be constructed on Montgomery Park P,oad
from Brock Road to a point 1,022 feet east of Brock Road and on
a proposed road through Lot 18 Range 3 running northerly and
easterly from Montgomery Park Road to a point in the east limit
of Lot 18 in Range 3 approximately 1,406 feet north of Montgomery
Park Road at a total estimated cost of $42,200.00 as local
improvements under the provisions of section 8 of The Local
Improvement Act, R.S.O. 1970, and amendments thereto.
2. The entire cost of the said watermains, $42,200.00,
including debentures, shall be specially assessed and levied on
all rateable property within the watermain local improvement
area set out in Schedule "A" annexed hereto which is hereby
defined as a local improvement area pursuant to section 68(1)
of The Local Improvement Act, R.S.O. 1970, and amendments thereto
and be paid by an annual rate of 87 cents per foot on the lands

specially assessed.
3. That a road with granular base and asphalt pavement be
constructed on a proposed road through Lot 18 Range 3 running
running northerly and easterly from Montgomery Park Road to a
point in the east limit of Lot 18 in Range 3 approximately
1,406 feet north of Montgomery Park Road at an estimated cost
of $66,000.00 as a local improvement under the provisions of
The Local Improvement Act.
4. The entire cost of the said road, $66,000.00,
including debenture charges, shall be specially assessed and
levied on all of the rateable property within the pavement
local improvement area set out in Schedule "B" annexed hereto
which is hereby defined as a local improvement area pursuant
to section 68(1) of The Local Improvement Act, R.S.O. 1970,
and be paid by an annual rate of $3.07 per foot on the lands
specially assessed.
5. The Engineer of the Corporation is hereby authorized
to make such plans, profiles and specifications and furnish such
information as may be necessary for the making of contracts for
the doing of the work or for carrying out the same by day labour
and the work shall be carried on and executed under the
superintendence and according to the directions and orders of the
said Engineer.
6. The entire cost of the said watermains is to be paid by
the issuing of debentures bearing interest at the rate of 9 per cent
per annum and be repaid by the special assessment over a term of
tm{enty years and the entire cost of the said road is to be paid
by the issuing of debtntures bearing interest at the rate of
9 per cent per annum and be repaid by the special assessment
over a term of ten years.
7. The Treasurer of the Township may, subject to the
approval of Council, agree with any bank or person for temporary
advances of money to meet the cost of the work pending completion
thereof.

8. Any person whose lot is specially assessed may
commute by a payment in cash the special rate imposed by
paying the cost of construction assessed upon such lot
without the interest forthwith after the special assessment
roll has been certified by the Clerk but may not commute
after the debenture by-law has been passed.
9. This by-law shall not come into effect until the
approval of the Ontario Municipal Boaxd to the undertaking
herein is obtained.

Watexmain Local Improvement Area
ALL AND SINGULAR that certain parcel or. tract of land and
premises situate, lying and being in the Township of
Pickering in the County of Ontario and being composed of
those lands fronting or abutting on both sides of
Montgomery Park Road from the east limit of Brock Road
to a point 1,022 feet east of the east limit of Brock Road,
and those lands fronting or abutting on both sides of a
proposed road through Lot 18 Range 3 running northerly and
easterly from Montgomery Park Road to a point in the easterly
limit of said Lot 18 distant 1,406 feet north of Montgomery
Park Road.

Pavement Loral Improvement Area
ALL AND SINGULAR that certain parcel or tract of land and
premises situate, lying and being in the Township of Pickering
in the County of Ontario and being composed of those lands
fronting or abutting on both sides of a proposed industrial road
through Lot 18 in Range 3 running northerly and easterly from
Montgomery Park Road to a point in the easterly limit of said
Lot 18 distant 1,406 feet north of Montgomery Park Road.
