BY-LAW NUMBER 1711 S G/Z
For regulating, governing and prohibiting
the operation of motorized snow vehicles
within the municipality.
WHEREAS The Motorized Snow Vehicles Act, 1968 provides
that by-laws may be passed by the Council of a local municipality for
regulating, governing or prohibiting the operation of motorized snow vehicles
within the municipality.
NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED
by the Council of The Corporation of the Township of Pickering as follows:
1. DEFINITIONS
In this By-law:
(a) "Highway" includes a common and public highway,
street, avenue, parkway, lane, place, bridge,
viaduct or trestle under the jurisdiction of
The Corporation of the Township of Pickering
including any part of parts thereof, designed
and intended for or used by the general public
for the passage of vehicles.
(b) "Motorized Snow Vehicle" means a self-propelled
vehicle designed to be driven exclusively on
snow or ice or both.
(c) "Township" means The Corporation of the Township
of Pickering.
(d) "Private Property" means property that has been
clearly marked as such by fences, hedges or barriers
of any kind or property that is a garden or lawn or
property not enclosed on which one or more signs
have been erected by or on behalf of the owner,
occupant or agent of the owner or occupant forbidding
trespassing.

(e) "Park or Parking" means the standing of a
vehicle whether occupied or not.
(f) "Sidewalk" means municipal property that is or
hereafter may be physically set apart or made
available and intended for pedestrian use by
the public as a sidewalk, or that is designated
by Council for use as a park or township side-
walk by by-law or otherwise.
(g) "Roadway" means the part of the highway that is
improved, designed or ordinarily used for vehicular
traffic, but does not include the shoulder, and,
where a highway includes two or more separate
roadways, the term "roadway" refers to any one
roadway separately and not to all of the roadways
collectively.
2. (a) No person shall drive a motorized snow vehicle
along or across any sidewalk or part of a sidewalk
in the Township.
(b) Notwithstanding 2 (a) above where motorized snow
vehicles are permitted to travel on highways within
the Township, a person may drive a motorized snow
vehicle across a sidewalk to enter on or exit from
such a highway provided the person crosses approxi-
mately perpendicular to the sidewalk.
3. No person shall park a motorized snow vehicle on any
highway or part of a highway or any sidewalk or any part
of a sidewalk on which the operation of a motorized snow
vehicle is prohibited thereon.
4. No person shall drive a motorized snow vehicle on private
property without authority from the owner or occupant of
such property.

5. No person shall drive a motorized snow vehicle along or across
any highway or part of a highway under the jurisdiction of the
Township within that part of the Township lying South of Finch Avenue
between the Pickering/Scarborough Town line on the West and the
West Boundary of Pickering Village on the East and within that part
of the Township lying South of the MacDonald Cartier Freeway between
the Easterly boundary of Pickering Village and the Westerly boundary
of the Town of Whitby.
6. No person shall drive a motorized snow vehicle along any roadway or
part of a roadway under the jurisdiction of the Township within that
part of the Township lying North of the MacDonald Cartier Freeway,
between the Easterly Boundary of the Township of Pickering and the
Easterly Boundary of the Village of Pickering on the West and North
of Finch Avenue between the Westerly Boundary of Pickering Village
on the East and the Westerly Boundary of Pickering Township on the
West, provided that any person may cross such roadway at right angles
thereto and in accordance with the regulations made under The Motor-
ized Snow Vehicles Act, R.S.O. 1970, C. 283.
(a) From Sunday to Thursday of any week where a person
may operate a motorized snow vehicle within the Township
in accordance with the provisions of this By-law, such
motorized snow vehicle shall not be operated between the
hours of 11.00 p.m. and 88.00 a.m. the day following.
(b) In all that part of the Township lying south of the north
boundary of the road allowance between the First and Second
Concession, on Friday and Saturday of any week, where a person
may operate a motorized snow vehicle, within the Township in
accordance with the provisions of this by-law, such motorized
snow vehicle shall not operate between the hours of 12 midnight
and 8.00 a.m. the day following.

7. (c) In all that part of the Township lying north of
the north boundary of the road allowance between
the First and Second Concession, on Saturday and
Sunday of any week, where a person may operate
a motorized snow vehicle, within the Township in
accordance with the provisions of this by-law,
such motorized snow vehicle shall not operate
between the hours of 2.00 a.m.and 8.00 a.m..
8. The provisions of this by-law shall not apply to the
operation of motorized snow vehicles in the following
circumstances:
(a) When a motorized snow vehicle is being operated
in an organized nect, rally or race which is held
under the authority and permission of a Resolution
of the Council of the Township.
(b) When such motorized snow vehicle is being operated
in a parade that is held under the authority of a
parade permit from the Council of the Township.
(c) When such motorized snow vehicle is actually
engaged in works undertaken by or on behalf of the
Township.
9. Every person who contravenes any of the provisions of this
by-law is guilty of an offence and on summary conviction
is liable to a fine of not less than $20.00 and not more
than $300.00 (exclusive of costs) for each offence.
10. The driver of a motorized snow vehicle, not being the
owner, is liable to any penalty provided under this
by-law, and the owner of the motorized snow vehicle is also
liable to such penalty unless at the time the offence is
committed, the motorized snow vehicle was in the possession
of a person other than the owner without the owner's consent.

11. By-law Numbers 3939/71 and 4069/71 be and the same
are hereby repealed.
