HomeMy WebLinkAboutBy-law 420/76THE' CORPORATION OF THE TOWN OF/P'ICKERING BY-LAW NUMBER / t VG_ Being a by-law of the Corporation of the Town of Pickering to authorize the execution of an offer of Purchase and Sale between the Corporation and J.D.S. Investments Limited (Part of Part 32, Plan 40R-923) WHEREAS by Resolution 166/75 the Council of the Corporation of the Town of Pickering adopted a recommendation of the Executive Committee being Item 9, meeting of November 10th 1975, that the Town of Pickering enter into an agreement of Purchase and Sale with J.D.S. Investments Limited; NOW THEREFORE the Corporation of the Town of Pickering hereby enacts as follows: 1. That the Mayor and Clerk be authorized to execute an Offer of Purchase and Sale between the Corporation of the Town of Pickering and J.D.S. Investments Limited being the most easterly 81.08 feet of Part 32, Plan 40R-923. By-law read a first, second and third time and PASSED this day of itlww , 1976. The Vendor covenants as follows: 1. To do all acts, pass all by-laws and obtain all approvals as may be required under relevant legislation, on or before date of closing, in order to give full force and effect to the within agreement and the resulting conveyance. 2. To produce on or before date of closing satisfactory evidence verifying that all necessary steps have been taken in order to satisfy the requirements of all relevant legislation with respect to the closing of the road of which the real property at one time formed a part and that said real property has been, as required by all relevant legislation, offered to abutting owners for purchase and to produce satisfactory evidence that such abutting owners waived their rights with respect to the real property. The Purchaser covenants to arrange for the preparation, delivery and registration, on or before date of closing, of a Description Reference Plan noting thereon as a part, the real property herein, at its own expense, and in that regard, the Vendor will co-operate with the Purchaser fully, so long as the Vendor is involved in no expense in connection therewith. TENANCY (if any)............ nil This agreement shall be conditional upon the Vendor, at his own expense, complying with the provisions of the Planning Act and any amendments thereto. PROVIDED the title is good and free from all encumbrances except as aforesaid. If within that time any valid objection to title is made in writing to the Vendor which the Vendor shall be unable or unwilling to remove and which the Purchaser will not waive, this agreement shall, notwithstanding any intermediate acts or negotiations in respect of such objections, be null and void and the deposit shall be returned by the Vendor without interest and he and the Agent shall not be liable for any costs or damages. Save as to any valid objection so made within such time the Purchaser shall be emulusively deemed to have accepted the title of the Vendor to the real property.
