Being a by-law to amend restricted area
by-law number 2511, as amended
WHEREAS it has not been shown to the satisfaction of the Council
of the Corporation of the Town of Pickering that development in the
Frenchman's Bay - Lake Ontario area of the Town of Pickering will be
desirable, nor adequately serviced, nor in accordance with the Official
Plan, as amended;
AND WHEREAS, therefore, the Council of the Corporation of the
Town of Pickering deems it desirable to amend further the provisions
of By-law Number 2511;
NOW THEREFORE the Council of the Corporation of the Town of
Pickering enacts as follows:
1. Schedule "A" of By-law Number 2511 is hereby amended by
designating as Public and Private Open Space Holding Zone "(H)02"
the following areas:
(a) that area in Lots 23, 24 and 25, Broken Front
Concession, Range 3, Town of Pickering, known
as "Frenchman's Bay" and outlined in red on
Schedule I hereto, and
(b) that area in Lots 22, 23, 24, 25, 26 and 27,
Broken Front Concession, Range 3, Town of
Pickering, being part of Lake Ontario and
outlined in red on Schedule II hereto.
2. (a) The schedules attached hereto and marked "Schedule I" and
Schedule "II", respectively, form part of this by-law.
(b) The provisions of this by-law apply to all areas outlined
in red on each schedule.
3. No person, association, company, corporation or other entity shall
use in any manner whatsoever any area or areas or part or parts thereof
to which this by-law applies for any purpose other than that permitted
in a Public and Private Open Space Zone "02" under the provisions of
By-law Number 2511, as amended.
4. No person, association, company, corporation or other entity shall
add, begin, commence, construct, erect, expand or add to any earthwork,
building, structure or facility of any kind, sort, type or nature in any
way or manner whatsoever in any area or areas or part or parts thereof
to which this by-law applies.
5. No person, association, company, corporation or other entity shall
begin, commence, expand or add to any use to which that person, associa-
tion, company, corporation or other entity is, at the date of passage of
this by-law, putting any area or areas or part or parts thereof to which
this by-law applies.
6. By-law Number 2511 as amended is further amended only to the extent
necessary to give effect to the provisions of this By-law as it applies
to the areas described in section 1.

7. Any person convicted of a breach of any provision of this
By-law shall be guilty of an offence and shall be liable, at the
discretion of the presiding justice, to a penalty not exceeding,
exclusive of costs, the sum of $1,000.00 for each offence,
recoverable under The Summary Convictions Act.
8. This By-law shall come into force and take effect upon being
passed by the Council of the Corporation of the Town of Pickering
subject to the approval of the Ontario Municipal Board.
