BY-LAW NUMBER 348/76
Being a By-law to declare that certain land is
required for the purposes of the Municipality
and to set aside that property for those
purposes.
WHEREAS, pursuant to The Municipal Affairs Act (formerly The Department
of Municipal Affairs Act), R.S.O. 1970, c. 118, where any part of the
taxes on improved land in the Municipality remains unpaid on the 1st day
of January in the third year following that in which the taxes were
levied, such improved land vests in and becomes the property of the
Municipality upon registration by the Treasurer of a tax arrears
certificate, subject to a right of redemption and the interest of the
Crown;
AND WHEREAS the Municipality may by by-law declare the land to be required
for municipal purposes at the expiry of such period of redemption;
AND WHEREAS
(a) that part of the north half of Lot 31, Concession 4, in the Town
(formerly Township) of Pickering containing by admeasurement 4 acre
more particularly described in Instrument Number 11900 registered
in the Registry Office for the Registry Division of Durham (No. 40)
at Whitby is improved land in the Municipality upon which taxes
levied in 1969, 1970, 1971 and 1972 remained unpaid on the 1st day
of January, 1975; and
(b) the Treasurer registered a tax arrears certificate against the said
land as Instrument Number D 1436 on the 23rd day of January, 1975;
and
(c) the period within which the right of redemption might have been
exercised expired on the 24th day of January, 1976; and
(d) the said land has not been redeemed according to law;
NOW THEREFORE the Council of the Corporation of the Town of Pickering
enact as follows:
1. In this By-law, "land" shall mean that part of the north half
of Lot 31, Concession 4, in the Town (formerly Township) of Pickering
containing by admeasurement 4 acre more particularly described in
Instrument Number 11900 registered in the Registry Office for the
Registry Division of Durham (No. 40) at Whitby.
2. It is hereby declared that the land referred to in section 1 hereof
is required for municipal purposes and the said land is hereby set aside
for such purposes.
By-law read a first, second and third time , and PASSED
thism day of 1976.
