BY-LAW NUMBER 892/78
Being a by-law to stop up a part of Sideline
22 from Concession 3 Road north to the Canadian
Pacific Railway right-of-way and to authorize
the sale thereof to the Municipality of Metro-
politan Toronto.
WHEREAS pursuant to the provisions of subsection 1 of
section 443 of The Municipal Act, R.S.O. 1970, c. 284,
the council of any municipality may pass by-laws inter
alia, to stop up a highway or part thereof and to sell
parts of stopped-up highways; and
WHEREAS in section 1 of an Agreement dated February 9,
1978, among the Regional Municipality of Durham, the
Town of Pickering, the Town of Ajax and the Municipal-
ity of Metropolitan Toronto, the Town of Pickering
agreed to stop up and close Sideline 22 from Concession
3 Road to the Canadian Pacific Railway right-of-way and
to transfer ownership of the said lands to the Munici-
pality of Metropolitan Toronto; and
WHEREAS notice of this By-law has been published once
a week for four consecutive weeks and the provisions
of The Municipal Act relating to the stopping up of a
highway have been complied with;
NOW THEREFORE, THE COUNCIL OF THE CORPORATION OF THE
TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS:
1. The lands described in Schedule "A" attached hereto
are hereby stopped up as a public highway.
2. For the purposes of illustration only, a plan
showing the lands described in Schedule "A"
is attached hereto as Schedule "B".
3. (a) The lands described in Schedule "A" attached
hereto shall be offered for sale to the
Municipality of Metropolitan Toronto as
the abutting property owner at a price
of $1.00.
(b) Should the Municipality of Metropolitan Toronto
accept such an offer, then in that event the
Mayor and Clerk are hereby authorized to exe-
cute the necessary documentation to effect the
transfer.
4. Subject to the provisions of subsections 1 and 2 of
section 52 of the Regional Municipality of Durham
Act, 1973, S.O. 1973, c 78, this by-law shall not
take effect until registered in the Registry Office
for the Registry Division of Durham.

September, 1978.

All and singular that certain parcel or tract of land or
premises, situate, lying and being in the Town of Pickering
in the Regional Municipality of Durham and being composed
of that part of the road allowance between Lots 22 and 23
in Concession 3 designated as Part 1 on a plan of survey
of record registered in the Registry Office for the Registry
Division of Durham (No. 40) as Number 40R-4312.
