BY-LAW NUMBER 828/78
Being a By-law to authorize the execution
of certain documents relating to the
transfer of part of Block B, Plan M-1007,
being Parts 1 and 2, Plan 40R-4303.
WHEREAS the Corporation of the Town of Pickering is the owner in
fee simple of Block B, Plan M-1007;
AND WHEREAS it is deemed expedient at this time to dispose of
part of Block B, Plan M-1007 to the abutting land owners;
AND WHEREAS pursuant to the provisions of subsection 1 of
section 336 of The Municipal Act, R.S.O. 1970, c. 284, the
Council of a Municipal Corporation may pass by-laws, inter
alia, for selling or otherwise disposing of Municipal lands;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to
execute the following documents:
(a) a Transfer in the form set out in Schedule
"A" hereto by which the Corporation of the
Town of Pickering conveys to John Allan
Flood and Faye Darlene Flood that part of
Block B, Plan M-1007 designated as Part
1 on Plan 40R-4303;
(b) a Transfer in the form set out in Schedule
"B" hereto by which the Corporation of the
Town of Pickering conveys to David Hindley
and Darlene Joanne Hindley that part of
Block B, Plan M-1007 designated as Part
2 on Plan 40R-4303.
2. The Town Solicitor is hereby authorized to make
his affidavit in the matter of subsection 3 of
section 5 of The Land Speculation Tax Act, 1974
with respect to each of the dispositions of land
referred to in clauses (a) and (b) of section 1
of this By-law.
BY-LAW read a first, second and third time and finally passed
this 5th day of June , 1978.
