BY-LAW NO. 778/78
Being a By-Law to regulate the construction
of driveway entrances upon highways under
the jurisdiction of the Town of Pickering
and to repeal By-Law No. 196/75
WHEREAS, pursuant to the provisions of paragraph 3 of section
453 of The Municipal Act, R.S.O. 1970, chapter 284, as amended by
S.O. 1974, chapter 136, by-laws may be passed by the council of
every municipality for placing, or permitting any person to place,
construct, install, maintain and use objects in, on, under or over
sidewalks and highways under its jurisdiction, subject to certain
conditions;
NOW THEREFORE, the Council of the Corporation of the Town of
Pickering HEREBY ENACTS AS FOLLOWS:
1. No person shall construct or cause to be constructed a
driveway entrance upon any highway under the jurisdiction
of the Town of Pickering without first obtaining the per-
mission of the Town therefor.
2. (1) Every application for the permission referred to
in Section 1 shall,
(a) be in writing on a form provided by the
Town;
(b) be submitted by the owner of the prem-
ises to which the proposed driveway
entrance is to provide access;
(c) show the particulars of the place where
the proposed driveway entrance is to be
constructed;
(d) indicate the dimensions and location of
the proposed driveway entrance; and
(e) be accompanied by payment, by cash or
certified cheque, of the amount required
to be paid to the Town, pursuant to the
provisions of Section 3 hereof.
(2) When an application for permission is submitted,
the applicant shall plant two stakes or other
acceptable markers in the ground marking the
location of the proposed driveway entrance,
which stakes or markers shall not be removed
without the Town's consent.
3. The amount required to be paid to the Town for the con-
struction of, and supply of materials for, the proposed
driveway entrance, shall be calculated according to the
provisions of Schedule "A" hereof.

4. In no case shall any driveway entrance be installed upon any
highway under the jurisdiction of the Town of Pickering unless
constructed by the Town or a person authorized by the Director
of Public Works in that behalf.
5. Any person convicted of a breach of any of the provisions of
this By-Law shall be liable to a fine of not more than
$1,000.00, exclusive of costs, for each offence, recoverable
under the provisions of The Summary Convictions Act.
6. By-Law No. 196/75 is hereby repealed.
