THE CORPORATION OF THE TOWN OF PICKERING
BY-LAW NUMBER 1061/79
Being a Restricted Area By-law to amend
Restricted Area By-law 3036, as amended,
to implement the Official Plan of the
Town of Pickering District Planning Area,
Region of Durham, in Part Lots 1 and 2,
Plan 230, Town of Pickering.

WHEREAS THE Council of the Corporation of the Town of Pickering
deems it desirable to recognize a home improvement centre on
the subject property, being part of lots 1 and 2, Plan 230, in
the Town of Pickering;
AND WHEREAS an amendment to By-law 3036, as amended, is therefore
deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:

By-law 3036, passed by the Council of the Corporation of
the Township (now Town) of Pickering on the 3rd day of
August, 1965, and approved by the Ontario Municipal Board
on the 7th day of October, 1966, and amended from time to
time, is hereby further amended only to the extent
necessary to give effect to the provisions of sections 2
and 3 hereof.
TEXT AMENDMENT
(a) Section 2 of the said By-law is hereby further amended
by adding thereto the following subsection:
2.41.1 HOME IMPROVEMENT CENTRE
"Home Improvement Centre" shall mean a building
or part of a building wherein building materials,
hardware or accessories, including lumber, are
displayed or offered for sale
(b) Section 11 of the said By-law is hereby amended by
adding thereto the following subsection:
11.4 EXCEPTIONS
11.4.1 Part of Lots 1 and 2, Plan 230
Notwithstanding the provisions of section 11.1
hereof, the lands designated C1-S on Schedule
"i" to Ey-lax 106 79 and lccated in Part of
Lots 1 and 2, Plan 230, may be used for the
purpose of a home improvement centre as defined
herein, in accordance with the provisions of sub-
sections 11.2 and 11.3 hereof.

3. SCHEDULE "A" AMENDMENT
Schedule "A" to By-law 3036, as amended, is hereby
further amended by altering from Cl to Cl-S the zone
designation of the lands designated "Cl-S" on
Schedule "I" attached hereto.
4. EFFECTIVE DATE
No part of this By-law shall come into force without
the approval of the Ontario Municipal Board but, subject
to such approval, this By-law shall take effect from the
day of passing hereof.

change the use of the subject
land from local commercial to
special purpose commercial.

home improvement centre on the
subject property.
