HomeMy WebLinkAboutBy-law 1186/80THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1186/80 Being a By-Law to authorize the execution of an Agreement of Purchase and Sale between William Price ?wilder and Judith Ryrie Wilder and the Corporation of the Town of Pickering respecting part of the east half of the road allowance between Lots 16 and 17, Concession 8 (Parts 2 and 3, Plan 40R-5908). WHEREAS, on May 28th, 1901, the Council of the Corpor- ation of the Township of Pickering enacted By-Law 800 (which By-Law was subsequently approved by County of Ontario By-Law 596) providing, in part, for the stopping-up and sale to adjoining owners of the original allowance for road between Lots 16 and 17, Concession 8; and WHEREAS, the Corporation of the Town of Pickering is the successor to the Corporation of the Township of Pickering in this respect; NOTI THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute an Agreement of Purchase and Sale in the form attached hereto as Schedule "A", between William Price Wilder and Judith Ryrie Wilder respecting part of the east half of the road allowance between Lots 16 and 17, Conces- sion 8 (Parts 2 and 3, Plan 40R-5908). BY-LAW read a first, second and third time and finally passed this 6th day of October , 1980. Purch:ryer agrees that this Offer shall be irrevocable bs him until 11:59 p.m. on the 30th dap of September 9 tiff UU , after which time, if not accepted, this Offer shall be null and soid and the deposit shall be returned to Purchaser without interest or deduction. 5. This Agreement shall be completed on the 15th day of October 19 80 . Upon completion, s'acam possession of the property shall be given to Purchaser unless otherwise provided as follows: 6. Purchaser shall be allowed the 30 days next following the date of acceptance of this Offer to: examine the title to the property at his own expense, to satisfy himself that there are no outstanding work orders affecting the property, that its present use fanning., may be lawfully continued, and that the principal building may be insured against risk of fire. 7. Vendor and Purchaser agree that there is no condition, express or implied, representation or warranty of any kind that the future intended use of the property by Purchaser is or will be lawful except as may be specifically stipulated hereunder. g. Save as to any valid objection so made by such day and except for any objection going to the root of the title, Purchaser shall be conclusively deemed to have accepted Vendor's Title to the property. 10.
