BY-LAW NO. 1152/80
Being a by-law to amend By-law 385/76 regulating
the collection and removal by the Corporation of
ashes, garbage and other refuse.
WHEREAS, pursuant to the provisions of section 354
(1) 76 of The Municipal Act, R.S.O. 1970, c.284, as amended,
the Council of the Corporation of the Town of Pickering
enacted By-law 385/76 on April 12th, 1976; and
WHEREAS, it is deemed expedient to amend By-law
385/76 in certain respects;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS:
1. Section 6 of By-law 385/76 is hereby amended by
designating the existing section as subsection (1)
of section 6 and by adding thereto the following:
(2) Notwithstanding the provisions of subsection
(1), where the Corporation of the Town of
Pickering has contracted for the collection and
removal of collectible garbage by means other
than by manual collection from a public road-
way, such collection and removal shall be ef-
fected only if,
(a) such garbage is placed in bins approved for
the purpose by the Director of Public Works;
and
(b) the approved bins are placed in locations
similarly approved.
2. Subsections (a) and (b)of section 14 of the said By-law
are hereby amended by deleting from each the term
"administrator-clerk" and substituting therefor, in each
case, the term "Town Manager".
3. Section 15 of the said By-law is hereby repealed and
the following substituted therefor:
15. Any person who contravenes any of the provisions
of this by-law shall be liable upon conviction
thereof to a fine not exceeding one thousand
dollars ($1,000.00) for each offence, exclusive
of costs, recoverable under the provisions of
The Provincial Offences Act, 1979.
