BY-LAW NO. 1404/81
Being a By-Law to authorize an application
to the Ontario Municipal Board for an Order
to dissolve all of the Wards in the Town of
Pickering for the purpose of the election
of those Councillors who are members of both
the Council of the Town of Pickering and the
Regional Municipality of Durham
WHEREAS, pursuant to the provisions of section 3(1)4 of the Regional
Municipality of Durham Act, R.S.O. 1980, chapter 434, the Council of
the Corporation of the Town of Pickering is composed of a mayor, who
is elected by a general vote of the electorate of the municipality,
and of six other members, three of whom are elected by wards as mem-
bers of the Council of the Corporation of the Town of Pickering and
of the Regional Council, and three of whom are elected by wards as
members of the Council of the Corporation of the Town of Pickering
only; and
WHEREAS, on November 16th, 1981, the Council of the Corporation of
the Town of Pickering passed Resolution 89/81, Item 1 of which pro-
vides:
That the Regional Councillors of the Town of Pickering run
at large,
the intention of which is to require that the three members of both
the Council of the Corporation of the Town of Pickering and of the
Regional Council be elected by a general vote of the electorate of
the municipality, and not by wards; and
WHEREAS, pursuant to the provisions of section 3(2) of the said Act,
upon an application of an area municipality authorized by a by-law
of the council thereof, the Ontario Municipal Board may, by Order,
dissolve any or all of the wards in the area municipality and declare
the date when such dissolution shall take effect;
NOW THEREFORE, the Council of the Corporation of the Town of Pickering
HEREBY ENACTS AS FOLLOWS:
1. The Town Clerk is hereby authorized and directed to apply to
the Ontario Municipal Board, on behalf of the Corporation of
the Town of Pickering, for an order to dissolve all of the
wards in the municipality for the purpose of the election of
those members of the Corporation's Council who are both members
of the Council of the Corporation and of the Regional Council,
which dissolution is to take effect for the municipal elections
to be held on November 8th, 1982 and for all subsequent munici-
pal elections.
READ a first, second and third time and finally passed this 16th day
of November, 1981.
