HomeMy WebLinkAboutBy-law 1350/81THE CORPORATION OF THE TOWN OF PICKERING BY-LAT,V NO. 1350 /81 Being a By-Law to authorize the execution of a Release by the Corporation of the Town of Pickering of Terence James Ryan, from a Demolition Agreement respecting Part Block 3, Plan 353, being all of Lot 97, Plan 1041, Pickering WHEREAS the Corporation of the Town of Pickering and Terence James Ryan, Jr, entered into an Agreement dated August 30th, 1976 and registered February 9th, 1977 as Instrument No. D41969; and WHEREAS it is now deemed expedient to release Terence James Ryan, Jr. from the provisions of the said Agreement; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule "A", between Terence James Ryan, Jr. and the Corpor- ation of the Town of Pickering respecting Part Block 3, Plan 353, being all of Lot 97, Plan 1041, Picker- ing. BY-LAW read a first, second and third time and finally passed this 8th day of September, 1981. PICKFF'I FJ APP;,,VE.[ AS 10 F0 IPt ,LDE=Tllf R E L E A S E I i In consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged, THE CORPORATION OF THE TOWN OF PICKERING hereby releases and forever discharges TERENCE JAMES RYAN, JR. his heirs, executors, administrators, successors and assigns of and from all claims, demands, damages, actions or causes of action which may have arisen, are arising, or may arise as a result of or in any way related to an Agreement dated August 30th, 1976 and registered as Instrument No. D41969 between THE CORPORATION OF THE TOWN OF PICKERING and TERENCE JAMES RYAN, JR. concerning the lands more particularly described in Schedule "A" attached hereto. IN WITNESS WHEREOF the Corporation of the Town of Pickering has hereunto affixed its corporate seal attested by its properly authorized officers this 21st day of September, 1981. SIGNED, SEALED & DELIVERED THE CORPORATION OF THE TOWN OF PICKERING Mayor SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Pickering, in the Regional Municipality of Durham and Province of Ontario and being composed of part of Block 3 of Registered Plan 353 for the Registry Division of Durham and which said parcel may be more particularly described as follows: COMMENCING at a point in the northerly limit of Pine Drive, said point being distant sixty feet (60') measured westerly from an iron bar planted in the easterly limit of said Block 3 where it is intersected by the northerly limit of Pine Drive; THENCE continuing westerly along the northerly limit of Pine Drive a distance of ninety feet (90') to a point where an iron bar has been planted; THENCE North 16 degrees 55' west one hundred and eighty- nine feet (1891) to a point where an iron bar has been planted; THENCE North 73 degrees 5' east ninety-one feet (91') to a point; THENCE South parallel to the easterly limit of Block 3 a distance of one hundred and eighty-nine feet (189') more or less to the place of beginning, Being all of Lot 97, according to Registrar's Plan Number 1041, AS DESCRIBED in Instrument No. D41960.
