BY-LAW NO. 1324/81
Being a By-Law to authorize the execution of
a Release by the Corporation of the Town of
Pickering of Mildred May Smith from a Special
Sewer Agreement pertaining to Part Lot 28,
Plan 274 and Part Lot 246, Plan 283, Pickering
WHEREAS the Corporation of the Township of Pickering and
Mildred May Smith entered into an Agreement dated May 20th,
1971 and registered May 26th, 1971 in the Registry Office
for the Registry Division of Durham as Instrument No.
209373; and
WHEREAS the Corporation of the Town of Pickering is the
successor to the Corporation of the Township of Pickering;
and
WHEREAS it is now deemed expedient to release Mildred May
Smith from the provisions of the said Agreement;
NOW THEREFORE, the Council of the Corporation of the Town of
Pickering HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a
Release, in the form attached hereto as Schedule "A"
between the Corporation of the Town of Pickering and
Mildred May Smith respecting Part Lot 28, Plan 274
and Part Lot 246, Plan 283, Pickering.
BY-LAW read a first, second and third time and finally passed
this 6th day of July , 1981.

in consideration of the sum of Two Dollars ($2.00) paid to
it, receipt of which is hereby by it acknowledged,

hereby releases and forever discharges
MILDRED MAY SMITH
her heirs, executors, administrators, successors and assigns
of and from all claims, demands, damages, actions or causes
of action which may have arisen, are arising, or may arise as
a result of or in any way related to an Agreement dated May
20th, 1971 and registered on May 26th, 1971 as Instrument No.
209373 between its predecessor

and

concerning the lands more particularly described in Schedule
"A" attached hereto.
IN WITNESS WHEREOF the Corporation of the Town of Pickering
has hereunto affixed its corporate seal attested by its

SCHEDULE "A"
ALL AND SINGULAR that certain parcel or tract of land and
premises situate, lying and being in the Town of Pickering,
in the Regional P1uniciuality of Durham (formerly Township
of Pickering in the County of Ontario) and Province of
Ontario and being composed of Part of Lot 28 as shown on a
plan filed in the Registry Office for the Registry Division
of Durham as Number 274, and of a hart of Lot 246 as shown
on a plan filed in the Registry Office as Number 283, which
parcel may be more particularly described as follows:
COMMENCING at the north-east angle of said Lot 28;
THENCE Southerly along the westerly limit of Dyson Road,
sixty feet (60');
THENCE Westerly in a straight line, two hundred and ninety-
five feet five inches (295'5") to a point in the westerly
limit of said Lot 28, distant eighteen feet eight and one-
half inches (18' 8-1/2") measured southerly thereon from
the north-west angle of the said lot;
THENCE continuing westerly along the production of the
said straight line, thirty-nine feet (39') more or less to
the westerly limit of said Lot 246, Plan 283;
THENCE Northerly along the said westerly limit, thirteen feet
six inches (13'6") more or less to the northerly limit of
said Lot 246;
THENCE Easterly along the said northerly limit forty feet
(40') more or less to the north-east angle of said Lot 246;
THENCE continuing easterly along the northerly limit of said
Lot 28 three hundred and nineteen feet eight and one-half
inches (319' 8-1/2") more or less to the place of beginning.
