BY-LAW NO. 1586/82
Being a By-Law to authorize the execution
of a Development Agreement between victor
W. Rudik and Patricia F. Rudik and the
Corporation of the Town of Pickering
respecting Part Lot 30, Concession 1,
Pickering (A 1/82)
WHEREAS the Council of the Corporation of the Town of Pickering has,
by Resolution 30/82, Item 3, dated March 15th, 1982, approved Zoning
By-Law Amendment Application A 1/82, made pursuant to section 39 of
the Planning Act, R.S.O0 1980, chapter 379, subject to a condition
which requires that a Development Agreement be entered into with the
owners of the subject lands;
NOW THEREFORE, the Council of the Corporation of the Town of Pickering
HEREBY ENACTS AS FOLLOWS:
The Mayor and Clerk are hereby authorized to execute a Develop-
ment Agreement in the form attached hereto as Schedule "A" between
Victor William Rudik and Patricia Frances Rudik and the Corpora-
tion of the Town of Pickering respecting the future development
of part of Lot 30, Concession 1, Pickering. (A 1/82)

WHEREAS the Owner is the owner in fee simple o? P,~ct Lo~ ]0, Concession

NOW THEI{EFORE, THIS AGREEMENT WITNESSETH that in consideration of,
(a) the Town approving Restricted Area (Zoning) By-Law Amendment
Application A 1/82; and
(b)
the payment of the

The Owner hereby agrees, that it shall not und~[~ke any develop-
ment or permit any development to be undertaken ¢,~ any nature on
the subject lands (except exterior changes or a,~ditions to the
existing house cr outbuildings or the constr~ct~on of outbuildings
on the subject l,]nds) until a subdivision plan of all of the
sub~('t ].~nds, pr( ..... s~d and appr~ve,~ aft~c ~be date hereof accord-
~ng ~ ~ provls, .... ~ ~,~ the Plan,~ Act~ ~.b~']. 1980, chapter
379, as amended from time to time, or any successor thereto, has
first been registered in the Land Titles Office for the Registry
Division of Durham, and then, the Owner shall undertake such
development or permit such development to be undertaken only in
accordance with such plan and any Subdivision or Servicing Agree-
ment entered into in conjunction therewith.
This Agreement and the terms and covenants contained herein shall
run with the subject land and the Agreement, and everything herein
contained shall enure to the benefit of and be binding upon the
Parties hereto, their heirs, administrators, successors and assigns.
IN WITNESS WHEREOF, the persons comprising the Party of the First Part
have hereunto affixed their hands and seals and the Party of the Second
Part has hereunto affixed its Corporate Seal, duly attested to by the
hands of its respective authorized officers.
