BY-LAW NUMBER 1580/8~
Being a Restricted Area By-law to amend
Restricted Area By-law 3036, as amended,
to implement the Official Plan of the
Town of Picketing District Planning Area,
Region of Durham, in Lot 13, Registered
Plan 538, and in Part Lot 14, Registered
Plan 329, in the Town of Pickering.
WHEREAS the Ministry of Municipal Affairs and Housing deems it
desirable to revoke Ontario Regulation 19/74 as it applies to
certain lands within the Town of Picketing;
AND WHEREAS the Council of the Corporation of the Town of Picketing
deems it desirable to recognize development that is not in
compliance with the provisions of Zoning By-law 3036;
AND WHEREAS an amendment to By-law 3036 as amended is therefore
deemed necessary;
NOW THEREFORE THE COUNCIL OF %HE CORPORATION OF THE TOWN OF PICKERING
HEREBY ENACTS AS FOLLOWS:
Section 9 ONE-FAMILY DETACHED DWELLING THIRD DENSITY ZONE,
of By-law 3036, as amended, is hereby further amended by
adding thereto the following subsection:
9.3.3.4 Lot 13, Plan 538
Notwithstanding the provisions of Section 9.2.3
the minimum side yard requirement for a detached
dwelling on that parcel of land in the Town of
Pickering in the Regional Municipality of Durham,
being composed of Lot 13 as shown on a plan
registered in the Land Registry Office for the
Registry Division of Durham (No. 40) as Number
538, shall be 3 metres on one side and 1.2 metres
on the other side.
Section 7.5 EXCEPTION, of By-law 3036, as amended is hereby
further amended by adding thereto the following subsection:
7.5.8 Part Lot 14, Plan 329
Notwithstanding the provisions of Section 7.2.1
the minimum front yard requirement for a detached
dwelling on that parcel of land situate in the
Town of Pickering in The Regional Municipality of
Durham, being composed of that part of Lot 14,
according to a Plan registered in the Land Registry
Office for the Registry Division of Durham (No. 40)
as Number 329 more particularly described as follows:
Beginning at a point in the easterly limit of the
said Lot 14 where the same is intersected by a
line drawn parallel with the northerly limit of
the said Lot distant 17 feet measured southerly
perpendicularly thereto;

Thence westerly in and along the said parallel
line a distance of 75 feet to a point;
Thence southerly parallel with the easterly
limit of the said Lot and a distance of 283
feet to a point in the southerly limit of the
said Lot;
Thence easterly in and along the said southerly
limit of the said Lot a distance of 75 feet to
the southeasterly angle of the said Lot;
Thence northerly in and along the said easterly
limit of the said Lot a distance of 283 feet to
the place of beginning, shall be 7.5 metres.
This By-law shall take effect from
hereof, subject to the approval of
Board, if required.
