THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO, 1945/84 Being a by-law to stop up parts of the road allowance between Lots 20 and 21, Concession 2 (Parts 1, 2, 3, 4, 5 and 6, Plan 40R-I~.~[ ), as public highway (Valley Farm Road - part) WHEREAS, pursuant to the provisions of sections 298(1) of the Municipal Act, R.S.O. 1980, chapter 302, the council of any municipality may pass by-laws to stop up a highway or part thereof; and WHEREAS, notice of this by-law has been published once a week for four consecutive weeks and the provision of the Municipal Act relating to the stopping up of a highway have been complied with; NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: Those parts of Valley Farm Road comprising part of the road allowance between Lots 20 and 21, Concession 2, more particularly described in Schedule A at- tached hereto, are hereby stopped up and closed to vehicular and pedestrian traffic. The conveyance of the lands described in Schedule A, attached hereto, to the abutting owner to the west, at a nominal sum, is hereby authorized. ON READING the Notice of Application filed, the Affidavit of Jonathan Curtis Barker, sworn the 17th day of :January, [986, and the e×h[b[ts referred to therein, and upon inspecting the Certificate of the Supreme Court of Ontario certifying that the Applicant had paid to the credit of this action in the Supreme Court of Ontario $[00.00 as security loc costs, in the presence of counsel for the Applicant, no one appearing for the Respondent, although properly served as appears from the material flied: 1. THIS COURT ORDERS that By-law No. 19~5/8t4 passed on the 21st day of January, 1985, by the municipal council of the Corporation of the Town of Picketing and entitled "a by-law to stop up parts o~ the road allowance between -2- Lots 20 and 21, Concession 2 (Parts l, 2, 3, ~, .5 and 6, Plan ~$0R-8.sSl) as public highway (Valley Farm Road - part) be quashed. 2. THIS COURT ORDERS that the sum of $100.00 paid into Court by the Applicant to the credit of this action be paid out of Court to the Applicant. 3.
