BY-LAW NO. 1932 /84
Being a by-law to determine the hours of closing
of certain classes of shops
WHEREAS, pursuant to the provisions of section 211(5) of the Municipal Act, R.S.O.
1980, c. 302, the council of a town may by by-law require that during the whole or
any part or parts of the year all or any class or classes of shops in the municipality
shall be closed and remain closed on each or any day of the week at and during any
time or hours between 6 p.m. of any day and $ a.m. of the next following day;
NOW THEREFORE, the Council of the Corporation of the Town of Pickering hereby
enacts as follows:
In this by-law, the term,
(a) "drive-through restaurant" means a member of that class of shops com-
prised of unlicensed food service facilities where goods are offered for
sale by retail to persons in motor vehicles;
(b)
"food service facility" means a building or part of a building, booth, stall
or place where goods, comprised of food or drink or both food and drink,
are offered for sale by retail for immediate consumption;
(c)
"motor vehicle" includes an automobile, motorcycle, motor assisted bicycle
and any other vehicle propelled or driven otherwise than by muscular
power; and
(d)
"unlicensed" in respect of a food service facility, means for which a li-
cence or permit has not been issued pursuant to the provisions of the
Liquor Licensing Act, R.S.O. 1980, chapter 244, as amended from time to
time, or any successor thereto, whether or not such a licence or permit
is required.
During the whole of the year, each drive-through restaurant within the bound-
aries of the Town shall be closed and remain closed on each day of the week
during the first five hours of the day.
Every person who is an operator of a drive-through restaurant that is not
closed or that does not remain closed in accordance with the provisions of
section 2, above, is guilty of an offence and upon conviction is liable to a fine
of not more than $2,000.
4. This by-law shall come into effect on January 1st, 1985.
