BY-LAW NUMBER 1776/84
Being a by-law to authorize the construction
of a roadway and storm sewer as local improve-
ments.
WHEREAS pursuant to section 7.1(b) of the Local Improvement
Act, R.S.Oo 1980, c. 250, as amended, a by-law may be passed
for undertaking a work as a local imporvement without petition,
on the initiative of the council; and
WHEREAS by Resolution #5/83, Item #6, passed on January 24,
1983, the Council of the Corporation of the Town of Pickering
agreed to construct as a local improvement a roadway and storm
sewer on lands located in Part of Lot 19, Range 3; and
WHEREAS it is deemed expedient that the construction of the
said roadway and storm sewer shall be undertaken at the cost
hereinafter set out as a local improvement under the provision
of section 12 of the Local Improvement Act; and
WHEREAS the cost of the said works is to be levied by imposing
a special assessment against lands frontin~ on Feldspar Court;
NOW THEREFORE the Council of the Corporation of the Town of
Pickering HEREBY ENACTS as follows:

That a roadway be constructed on Feldspar Court
from Brock Road to a point 310 metres west and
north at an estimated cost of $174,400.00 as a
local improvement under the provisions of the
Local Improvement Act.
The entire cost of the above works is to be
specially assessed upon lands abutting directly
on the works and immediately benefiting there-
from. The entire cost, including debenture
charges, shall be assessed and levied on the
ratable property fronting on Feldspar Court and
paid by an annual rate of $4,063.11 per hectare
on the lands specially assessed.

That a storm sewer and appurtenances be con-
structed in accordance with the Engineer's
Report dated August, 1983 at an estimated cost
of $146,600.00 as a local improvement under
the provisions of the Local Improvement Act.
The entire cost of the above works is to be
specially assessed upon lands abutting directly
on the works and immediately benefiting there-
from. The entire cost, including debenture
charges, shall be assessed and levied on the
ratable property fronting on Feldspar Court
and paid by an annual rate of $4,010.06 per
hectare on the lands specially assessed.
The firm of Anderson Associates Limited is hereby autho-
rized to make such plans, profiles and specifications
and furnish such plans and information as may be necessary
for the making of contracts for doin~ the works or for
carrying out the same, and the works shall be carried on
and executed under the superintendence and accordance to
the direction and orders of the Enqineer of the Corpora-
tion of the Town of Pickerina.
The cost of the works, estimated at $321,000.00 is to be
paid by the issuing of debentures bearing interest at the
rate of fourteen (14) per centum and is to be repaid by
the special assessments over a term of ten (10) years.
The Treasurer may, subject to the approval of Council,
agree with any bank or person for temporary advances of
money to meet the cost of the works pending completion
thereof.
Any person whose land is specially assessed may commute,
by a payment in cash, the special rate imposed by paying
the cost of construction assessed upon such land without
the interest forthwith after the special assessment roll
has been certified by the Clerk, but may not commute
after the debenture by-law has been passed.
This by-law shall not come into effect until the approval
of the Ontario Municipal Board to the undertaking herein
is obtained.
