1. John Murphy, 3080 Concession 5, advised that all the concerns stated during
their previous deputation to Council have not been addressed. In the memo
from the Division Head, Municipal Property & Engineering a concern is noted
with respect to possible access of contaminants into the water table. He has
a pond located on his property and occasionally dead fish appear on the
surface which gives him grave concerns. He further noted the proposed
development across the street from this operation and the possible water
problems they may encounter. He questioned why a more current
environmental study has not been undertaken. He requested the Committee
to consider these concerns and whether or not they have been addressed.
2. Margaret Williamson, 3360 Balsam Road, stated that a lot of issues have not
been addressed. The new building which has been erected was to be a one
storey but is two, a second structure was built with chimney stacks which
residents were not aware of, the metal fencing is collapsing, water quality is of
concern and an updated environmental study is required. She questioned
what follow-up will be in place to ensure that the owner complies with the
requirements.
3. Kees Van der Vecht, President of Kinsale & Residents Association,
commented on various issues he has raised before Council over the past
number of years. Street lights at the intersection in Kinsale, dumping of
sewage, illegal dumping site and now Committee is considering legalizing a
business which has operated illegally for the past ten years.

4. Rachel Murphy, 3080 Concession 5, advised that her property is
approximately 1,500' from this operation and the noise of crushing cars is
unbearable. She stated her concern for the proposed development moving
into the area close to this operation and the noise they will experience and
further her concern with not only water quality but also air quality.
5. Richard Lloyd, 3330 Balsam Road, addressed concerns with respect to the
fencing requirements, stating that there is no stipulation for replacing the
fence which is collapsing and also that the height of the new fence is 2 metres
rather than the 2 % metres which is currently there. He questioned the
restrictions for the buffer zone and storage inside. He commented on the
excessive lighting on the exterior of the building which shines onto his
property. He further questioned if consideration has been given to the
surrounding neighbours, will there be restrictions on days and hours of work.
6. Nancy Listro, 3545 Balsam Road, stated her concern with respect to water
quality and commented on the loss of a comfort level previously enjoyed.

division of the subject lands, being Lot 124 and Lot 125, Plan 1051 (known as

by land severance rather than by draft plan of subdivision.
4.
MODIFICATION #1 TO THE PICKERING OFFICIAL PLAN
WHEREAS in May 1997, Pickering Council adopted Modification #1 to the
Pickering Official Plan revising land use designations and policies for lands
known as the East Duffins Area, and requested the Region of Durham to approve
these land use designations and policies; and
WHEREAS Regional Council endorsed these designations and policies in 1999
(with modifications) but because of an unresolved deferral to the Regional Official
Plan (Deferral No.7), the Region of Durham has not issued its Notice of Decision
to approve, as modified, the East Duffins Area; and
WHEREAS the East Duffins Area is divided into two neighbourhoods: Duffin
Heights and Lamoreaux; and
WHEREAS in May 2002, Pickering Council adopted Resolution #29/92 directing
that staff initiate a growth management study for certain lands in Pickering,
including the Lamoreaux Neighbourhood of the East Duffins Area; and
WHEREAS on December 9, 2002, Pickering Council adopted Terms of
Reference for the Growth Management Study, and directed staff to issue a
Request for Proposals for the purpose of hiring a qualified Consulting Team to
undertake the Study; and
WHEREAS Pickering Council does not want to limit or prejudice the work of a
consulting team in undertaking the Growth Management Study;
NOW THEREFORE the Council of the Corporation of the City of Pickering
hereby rescinds its adoption of Modification #1 to the Pickering Official Plan as it
affects the Lamoreaux Neighbourhood; and
THAT staff be requested to fine-tune the land use policies and designations
established for the Duffin Heights Neighbourhood and report to Council on any
further modifications that may be needed for the Duffin Heights Neighbourhood;
and

THAT the Region of Durham be requested not to issue its Notice of Decision to
approve, as modified, the land use designations and policies for the Duffin
Heights Neighbourhood, until further advised by Pickering Council.
