Carried Unanimously The applicant requests relief from Zoning By-law 8149/24, to permit: • a minimum front yard of 7.6 metres, whereas the By-law requires a minimum front yard of 12.0 metres; • a minimum flankage side yard of 1.1 metres, whereas the By-law requires a minimum flankage side yard of 12.0 metres; and • a minimum of 20 parking spaces for an Emergency Service Facility, whereas the By-law requires a minimum of 44 spaces (3.5 spaces per 100 square metres of gross leasable floor area). In support of the application, the applicant identified that due to the nature of the project, a Fire Station, all requirements for turning of the fire trucks into the site will not work due to the limited size of the site. Setbacks on the Front Yard, Flankage Side Yard, cannot be met if access to the site, sufficient parking and utilities must be met. Diana Poida, Monifa Charles and Del Cordeiro, agents, were present to represent the application. No further representation was present in favour of or in objection to the application. The agents made a brief presentation in support of the application. In response to questions from Committee members, the agents replied with the following: there is a 15.0 metre side yard buffer to accommodate sidewalks with the - 5 - Committee of Adjustment Hearing Minutes June 10, 2026 4 future road widening of Bayly Street; the occupant load is 8 for this building, the firefighters work in 2 crews of 4; there has been collaboration between the City and the Region on the best design of the site, the proposed site plan provides sufficient space for maneuvering of the fire trucks, along with cleaning and servicing. A Committee member commented that the requested front and side yard flankage applies to a small portion of the building, the requested minimum 20 parking space is reasonable for the site as it is located in a high density area with other means of transportation. The agent commented that the property currently has two parking spaces. The ADU is in the main dwelling and will not change the characteristics of neighbourhood. The application did not receive any negative public or agency comments and will provide much needed housing in the area. In response to a question from Committee members, the agent commented that the ADU is not recognized yet, they are going through the permit process and this is part of that step. They are looking for a tenant without a car, but if they did, they have one dedicated parking space available, there are public transit routes in the area. A Committee member commented that there is no way to police the owners of the ADU from housing anyone with a car. A Committee member commented that this is vehicle dependent area because it is relatively new, as per the report a bus stops by every 30 minutes. The applicant requests relief from Zoning By-law 8149/24 to permit a maximum building setback of 215.0 metres from the street line, whereas the by-law requires a maximum setback of 4.0 metres from the street line. The applicant requests approval of this variance to obtain a demolition permit for the south wing of the Shops at Pickering City Centre mall. The agent stated they are seeking approval of a technical variance to address the setback to the south for the refacing of the facade, demolition and creation of side road. In response to a question from a Committee member, the agent stated that pending site plan approval and building permits, the plan is to start construction later this year for six months, the site will be maintained throughout the construction process. The applicant requests relief from Zoning By-law 8149/24 and 3037 to permit up to two parking spaces to be a minimum of 2.45 metres in width and 4.7 metres in length, whereas the by-law requires parking spaces to be a minimum of 2.6 metres in width and 5.3 metres in length. The applicant requests approval of this variance to legalize two existing parking spaces within an underground parking garage. Carried Unanimously 6.5 MV 35/26 - 1874 Fairport Road A. Jaffery Omar Ha-Redeye declared a conflict on this item. ( Omar Ha-Redeye declared an indirect pecuniary interest for MV 35/26. ) The applicant requests relief from Zoning By-law 8149/24, to permit: • maximum dwelling depth of 28.7 metres, whereas the by-law requires a maximum dwelling depth of 20.0 metres; and • minimum front yard setback of 3.0 metres, whereas the by-law requires a minimum front yard setback of 10.55 metres. The applicant requests approval of this minor variance application to construct an addition on the front and rear of the existing dwelling. - 9 - Committee of Adjustment Hearing Minutes June 10, 2026 8 Input from other sources were received from the Applicant, City’s Engineering Services Department, the City’s Building Services Section, the Toronto & Region Conservation Authority (TRCA), and three area residents. In support of the application, the applicant submitted a Planning Rationale in support of this application. Please contact the City Development Department to receive a copy at citydev@pickering.ca. Sajjad Jaffery, agent, was present to represent the application. One area resident was present in objection to the application. In order to avoid a tie vote, Sean Wiley recused himself from voting on this application. In support of the application the agent commented that the proposal is for a front and rear addition to the existing dwelling, trees not within construction zone will be protected, as per the arborist report they are not within the tree protection area. This is a reasonable expansion to an existing family dwelling, the use remains residential. The application meets all four tests of the Planning Act. An area resident made a brief presentation in objection to the application, sharing concerns regarding the rear expansion that will result in loss of privacy due to tree loss. The neighbourhood is within the tree protection area. The Secretary-Treasurer advised members that the front yard and portion of the front of the dwelling is within the tree protection area. In response to a question from a Committee member, the agent stated that the roof deck will have a privacy wall to the north and the clients are open and willing to work with any neighbours to minimize privacy impacts. A Committee member commented that four items do not meet the guidelines of the attached Urban Design Guideline, Appendix A to the staff report. After reading the staff report, noting the impact on privacy, making a site visit and considering public comments, this application does not conform to the intent of Zoning By-law, Denise Rundle moved the following motion: Moved By Denise Rundle That application MV 35/26 by A. Carried 6.6 MV 36/26 - 1158 Caliper Lane H. Patel The applicant requests relief from Zoning By-law 8149/24 to permit stairs to a porch to encroach 0.9 metres into the required interior side yard setback, resulting in a minimum setback of 0.3 metres from the interior side lot line, whereas the by-law permits stairs to a porch or deck to encroach within 0.6 of a metre of an interior side lot line. The applicant requests approval of the variance to obtain a building permit to construct a side yard entrance for an additional dwelling unit. Input from other sources were received from the Applicant, City’s Engineering Services Department, and the City’s Building Services Section. In support of the application, the applicant identified that the subject property municipally known as 1158 Caliper Lane is developed with a townhouse dwelling within a compact residential subdivision in the Seaton community. The applicant proposes to construct an exterior side entrance staircase to provide independent access to the basement. Relief is required from the City of Pickering Zoning By-law 8149/24, which permits exterior stairs to encroach into a required side yard provided they maintain a minimum setback of 0.6m from a lot line. The proposed staircase is located 0.3 m from the side lot line. Shivang Tarika, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. The agent stated they have reviewed the staff report and condition and have no objections. Chair Assistant Secretary-Treasurer - 12 - Report to Committee of Adjustment Application Number: MV 60/24 Date: July 8, 2026 From: Isabel Lima Principal Planner, Development Review Subject: (Tabled at the August 13, 2025 Committee of Adjustment Hearing) Committee of Adjustment Application MV 60/24 100117575 Ontario Inc. 1238 Bayview Street Application The applicant requests relief from Zoning By-law 8149/24, to permit: •a minimum rear yard depth of 7.0 metres, whereas the By-law requires a minimum rear yard depth of 7.5 metres; •a maximum lot coverage of 46.5 percent, whereas the By-law requires a maximum lot coverage of 45 percent; and •a maximum building height of 9.0 metres, whereas the By-law requires a maximum building height of 7.5 metres. The applicant requests approval of this minor variance application to obtain a building permit to construct a two-storey detached dwelling. Recommendation Based on the application and supporting documentation submitted, the City Development Department has reviewed the proposal in accordance with Section 45(1) of the Planning Act. Staff consider the requested variances to be minor, desirable for the appropriate development of the land, and consistent with the intent of the Official Plan and Zoning By-law. Notwithstanding this review, the applicant is responsible for demonstrating the justification for the relief sought and for establishing that the statutory tests are met. After considering all public and agency input, should the Committee find merit in this application, the following condition is recommended: 1.That these variances apply only to the proposed detached dwelling, as generally sited and outlined on the applicant’s submitted plans (refer to Attachments 2, 3, 4, 5, and 6). Background On October 9, 2024, the Committee of Adjustment considered Land Division Application LD 15/24, along with the associated Minor Variance Applications MV 60/24 and MV 61/24. - 13 - Report MV 60/24 July 8, 2026 Page 2 The applicant proposed to sever the existing lot for one additional residential lot. At the Committee hearing, the applicant requested that the applications be tabled due to revisions to their initial proposal. In July 2025, the applicant withdrew the tabled Land Division Application LD 15/24 and Minor Variance Application MV 61/24 due to revisions to the proposal. The applicant wishes to proceed with the construction of one detached residential dwelling on the lot. The application was heard at the August 2025 hearing, which was tabled again to address comments from the Toronto and Region Conservation Authority (TRCA). In June 2026, the City was advised that TRCA comments have been addressed. Comments Provincial Planning Statement, 2024 The Provincial Planning Statement, 2024 (PPS) is a policy statement issued under Section 3 of the Planning Act, R.S.O. 1990, which provides direction on matters of provincial interest related to land use planning and development. Decisions of the Committee of Adjustment are required to be consistent with the PPS. Official Plans are intended to be kept up to date with the PPS. However, where a planning authority is required to make a decision before its Official Plan has been updated to reflect the most recent PPS, the decision must nevertheless be consistent with the PPS in effect at the time of the decision. The subject property is located within the Settlement Area, where the PPS supports development that promotes efficient land use and appropriate development patterns. The requested variances facilitate development that is compatible with the existing and permitted use of the property. Staff is satisfied that the proposed variances are consistent with the PPS. Conforms to the Intent and Purpose of the Official Plan As of January 1, 2025, following changes made by Bill 23, applicable parts of the Durham Regional Official Plan are now deemed to be part of Pickering’s Official Plan. Under the Regional Plan, the subject property is designated “Urban System – Community Areas”. This designation permits a wide range of uses, including residential uses. The Pickering Official Plan designates the subject property as “Urban Residential Areas – Medium Density Area”, which is intended to accommodate a range of uses, including residential. Staff is of the opinion that the requested variances maintain the general intent and purpose of the Official Plans. Conforms to the Intent and Purpose of the Zoning By-law The subject property is zoned “X30(S-SD-1)” under Zoning By-law 8149/24. - 14 - Report MV 60/24 July 8, 2026 Page 3 Rear Yard Setback and Lot Coverage The applicant is proposing a rear yard setback of 7.0 metres and a lot coverage of 46.5 percent, whereas the Zoning By-law permits a minimum rear yard setback of 7.5 metres and a maximum lot coverage of 45 percent. The intent of these provisions is to regulate the size, scale, and placement of buildings to ensure that adequate space remains available for rear yard landscaping, private outdoor amenity areas, drainage, and privacy protection for abutting properties. The property retains sufficient outdoor amenity space within the front and rear yard. The requested variance does not appear to adversely affect drainage or the use and enjoyment of adjacent properties. The proposed building footprint is considered appropriate for the lot size and is not anticipated to adversely impact surrounding properties. Building Height The applicant is proposing a building height of 9.0 metres, whereas the Zoning By-law permits a maximum height of 7.5 metres. The intent of the height provision is to ensure that new development remains compatible with surrounding properties and to mitigate potential shadowing, overlook, and privacy impacts. The proposed dwelling is two storeys in height, which is consistent with the built form of neighbouring detached dwellings. Staff is satisfied that the proposed building height will not result in unacceptable impacts on adjacent properties. Staff is of the opinion that the requested variances maintain the general intent and purpose of the Zoning By-law. Desirable for the Appropriate Development of the Land and Minor in Nature The proposed dwelling maintains sufficient separation and open space on the lot to mitigate potential privacy and overlook impacts. The requested variances for rear yard setback and lot coverage are considered minor as the proposal does not encroach into the required front or side yards and maintains an appropriate separation distance from the rear lot line. Although the proposed building height exceeds the maximum permitted height, the height of the windows (on the second storey) do not exceed 6.85 metres from grade, which is below the permitted maximum building height of 7.5 metres. This helps ensure that the privacy of neighbouring properties is maintained. The proposed height is also consistent with the neighbouring property to the east and is not anticipated to result in a built form that towers over adjacent properties. As such, staff has no concerns regarding privacy or overlook impacts. Staff is of the opinion that the requested variances are desirable for the appropriate development of the land and minor in nature. The applicant requests approval of this minor variance application to permit the outdoor storage of rental vehicles associated with a truck rental business (U-Haul) as an accessory use to an existing convenience store (refer to Attachment 2). Summary of Findings The City Development Department recommends that Minor Variance Application MV 37/26 be Tabled to allow the applicant to address the concerns raised by the City’s Municipal Law Enforcement Services regarding potential overflowing of vehicle storage. Background The City’s Municipal Law Enforcement Services have reviewed the proposed variance and expressed concern that the storage of rental vehicles associated with U-Haul’s operation may result in overflow parking beyond the six vehicles requested through this variance application (refer to Input from Other Sources below). In support of the requested variance, staff have requested additional details regarding U-Haul’s operations on the subject site to address these concerns and to assess whether appropriate measures are in place to prevent overflow vehicle storage. This information is required to ensure that the proposed U-Haul operation does not adversely impact other site functions or neighbouring properties. It appears that there is no ability for the individual business to control the number of vehicles dropped off at a location which results in more vehicles than permitted being parked in spots that are not designated for this purpose. The City receives and is required to investigate complaints related to this, without a mechanism to clearly limit the number and location of vehicles, MLES cannot support approval of the U-Haul rentals from convenience stores. The requested variance facilitates development that is compatible with the existing and permitted use of the property. Staff is satisfied that the proposed variance is consistent with the PPS. Conforms to the Intent and Purpose of the Official Plan As of January 1, 2025, following changes made by Bill 23, applicable parts of the Durham Regional Official Plan are now deemed to be part of Pickering’s Official Plan. Under the Regional Plan, the subject property is designated “Urban System – Community Areas”. This designation permits a wide range of uses, including residential. The Pickering Official Plan designates the subject property as “Urban Residential Areas – Low Density Area”, which is intended to accommodate residential uses, including additional dwelling units and associated parking. Staff is of the opinion that the requested variance maintains the general intent and purpose of the Official Plans. Conforms to the Intent and Purpose of the Zoning By-law The subject property is zoned “X295” –Exception Zone 295 (SD) under Zoning By-law 8149/24. The intent of the maximum driveway width provision is to ensure that sufficient landscaped area is maintained to support grading and drainage functions, provide an appropriate balance between hard and soft surfaces, and preserve the established streetscape character. The subject property currently contains two required parking spaces for the principal dwelling, and one additional parking space is required for the additional dwelling unit (ADU), for a total of three spaces. It appears that the driveway may have already been extended, or at minimum, the area proposed for widening is currently paved with concrete or asphalt and is being used for parking. The proposed widening would accommodate the additional parking space associated with the ADU. While the proposed driveway width exceeds the maximum permitted by the Zoning By-law, the property continues to maintain an adequate amount of landscaped open space. The applicant has also submitted vehicle maneuvering drawings demonstrating that vehicles can safely access and utilize the parking spaces on-site. Given that the area is already paved and functioning as a parking space, and considering the maintained landscaping and demonstrated parking functionality, the proposed increase in driveway width is not anticipated to result in adverse impacts on neighbouring properties. Staff is of the opinion that the requested variance maintains the general intent and purpose of the Zoning By-law. - 31 - Report MV 39/26 July 8, 2026 Page 3 Desirable for the Appropriate Development of the Land and Minor in Nature The proposed widening will provide the additional parking space required for the ADU, allowing the site to meet the By-law’s parking requirements. The increase in width is modest and does not reduce the landscaped area below the minimum. The proposal is not expected to create adverse impacts on adjacent properties and remains consistent with the surrounding neighbourhood. Staff is of the opinion that the requested variance is desirable for the appropriate development of the land and is minor in nature. The intent of the provisions to permit a porch and associated stairs to encroach to within 0.6 of a metre from an interior side lot line is to maintain an adequate buffer space between structures and to accommodate pedestrian access, utility, and residential services. The proposed porch has a three-step crossover design allowing pedestrian access from the front to rear yards. The proposed encroachment maintains sufficient separation from the lot line and is consistent with similar encroachments in the area. Staff is of the opinion that the requested variances maintain the general intent and purpose of the Zoning By-law. - 36 - Report MV 40/26 July 8, 2026 Page 3 Desirable for the Appropriate Development of the Land and Minor in Nature The proposed porch will provide access to the additional dwelling unit and represents the only feasible location for the entrance, as the opposite side yard is significantly narrower and cannot reasonably accommodate the required access. The proposed porch and stairs are not expected to create any significant visual or functional impact on adjacent properties or alter the overall character of the neighborhood. Staff is of the opinion that the requested variances are desirable and appropriate for the development of the land and are minor in nature. Input From Other Sources Applicant • The owner is looking to use the existing stairs to basement as the access to basement as he is proposing to finish basement as a ADU. We are creating a new side entrance door and would need three steps to get to it. It is a detached house so we will still have access to the backyard from the other side. The stairs which we are creating is only three steps and we will have the steps on the other side to avoid blocking access to the backyard from this side too. This will leave us with 0.36m side setback instead law permitted 0.6m setback. Engineering Services • No comments have been received as of the date of writing this report.
