BY-LAW NO. 2392 /87
Being a by-law to authorize the execution of an
agreement amending the Subdivision Agreement
respecting Plan 40M-1437, Picketing, (Draft Plan
18T-85022; Sandbury/Dekkema)
WHEREAS pursuant to the provisions of the Planning Act, 1983, S.O. 1983, chapter
1, section 50, The Corporation of the Town of Pickering entered into a Subdivision
Agreement dated June 30, 1986 (By-law 2280/86) with Sandbury Building Corporation
respecting the development of what is now designated as Plan 40M-1437 (Draft Plan
18T-85022; Sandbury/Dekkema);
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
The Mayor and Clerk are hereby authorized to execute an agreement in
the form attached hereto as Schedule A amending the Subdivision Agree-
ment dated June 30, 1986 between The Corporation of the Town of Picker-
lng and Sandbury Building Corporation respecting Plan 40M-1437, Picker-
ing (Draft Plan 18T-85022; Sandbury/Dekkema).
BY-LAW read a first, second and third time and finally passed this 16th day of
February, 1987.

SCHEDULE A to
B~-Law Number 2392/87
THIS AGREEMENT made February 19, 1987
BETWEEN:
SANDBURY BUILDING CORPORATION
hereinafter called the "Owner"
OF THE FIRST PART,
- and -
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter called the "Town"
OF THE SECOND PART.
WHEREAS by Agreement dated June 30, 1986, between the Owner and the Town, the
Owner proposed to subdivide and register a plan of subdivision of part of Lots 29
and 30, Range 3, Broken Front Concession, Picketing, now being Plan Number
40M-1437 (Draft Plan 18T-85022); and
WHEREAS, it is deemed desirable to amend that Agreement in certain respects;
NOW THEREFORE, THIS AGREEMENT WITNESSETH, that in consideration of the sum
of Two Dollars ($2.00) paid by each Party to the other, receipt of which by each is
hereby acknowledged, the Parties hereto agree as follows:
The lands affected by this Agreement are all of Blocks 150 to 159, both inclu-
sive, Plan 40M-1437, Pickering.
In this Agreement, the term "Subdivision Agreement" shall mean the Agreement
dated June 30, 1986, between the Owner and the Town, notice of which was
registered December 18, 1986 as Instrument No. LT302907.
The Owner is hound by all the terms and provisions of the Subdivision Agree-
ment, as amended hereby.
4. Section 5 of Schedule A to the Subdivision Agreement is hereby deleted.
5. Section 6 of Schedule A to the Subdivision Agreement is hereby deleted and the
following substituted therefor:
6. CO-ORDINATED DEVELOPMENT - BLOCK 160
Block 160 shall be developed only in conjunction with Block 47, Plan
40M-1442 to provide one dwelling unit, and that development shall be
governed by the provisions of the Town's Subdivision Agreement respect-
ing Plan 40M-1442.
This Agreement and everything contained herein shall enure to the benefit of
and be binding upon the Parties hereto, their successors and assigns.
IN WITNESS WHEREOF the Parties have hereunto affixed their respective corporate
seals, attested by their authorized officers.
