BY-LAW NO. 227~86
Being a By-law to amend By-law 2091 and to
exempt Lot 94, Plan 350, Picketing from part lot
control.
WHEREAS Section 2 of By-law 2091 provides, inter alia, that Lot 94, Plan 350,
Picketing is deemed not to be within a plan of subdivision for the purposes of what is
now section 49(3) of the Planning Act, 1983, S.O. 1983, chapter 1, and it is now
desirable to deem that lot to be within a plan of subdivision; and
WHEREAS pursuant to the provisions of section 49(7) of the Planning Act, 1983, S.O.
1983, chapter 1, the council of a munlcipality may by by-law provide that section
49(5) of the Act does not apply to certain lands within a plan of subdivision des-
ignated in the by-law;
NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
Section 2 of By-law 2091 is hereby amended by deleting reference therein to Lot
94, Plan 350, Pickering, so that the 46th line of the Table in Section 2 of that
By-law shall now read as follows:
350 1 to 93 and 95 to 128
2. Section 49(5) of the Planning Act, 1983, S.O. 1983, chapter 1, does not apply
to the lands described as follows:
Lot 94, Plan 350, Pickering
This by-law shall not come into effect until approved by the Regional Municipal-
ity of Durham.
BY-LAW read a first, second and third time and finally passed this 30th day of June,
1986.
