BY-LAW NO. 3782/91
Being a by-law to authorize the execution of a Release
and Discharge of the Subdivision Agreement respecting
Plan 40M-1306, Pickering.
WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predecessor thereof, The
Corporation of the Town of Pickering and Alastair Mackay entered into an Agreement dated July 4,
1983, Notice of which was registered on Februaz7 17, 1984 as Instrument No. LT197144, respecting the
subdivision and development of Plan 40M-1306, Picketing; and
WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of
the Town;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form
attached hereto as Schedule A, of the Agreement dated July 4, 1983, Notice of which was
registered February 17, 1984 as Instrument No. LT197144, between Alastair Mackay and The
Corporation of the Town of Picketing, respecting the subdivision and development of Plan
40M- 1306, Picketing.
2. Schedule A hereto forms part of this By-law.

RELEASE AND DISCHARGE
WHEREAS the Agreement dated July 4, 1983, Notice of which was registered February 17, 1984, in the
Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT197144,
between,
hereinafter referred to as the "Owner"
THE CORPORATION OF THE TOWN OF PICKERIN~
hereinafter referred to as the "Town",
provided for the subdivision and development of lands affected hereby; and
WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of
the Town with respect to the lands affected hereby;
THE TOWN HEREBY remises, releases and forever discharges the Owner, his heirs, executors,
administrators, successors and assigns, from any and all liabilities, actions, causes of action, debts,
claims or demands of any kind whatsoever which the Owner may have been, is, or may become subject
to pursuant to the provisions of the Agreement.
THIS RELEASE AND DISCHARGE affects the lands described as:
Lots 1-55, inclusive, Blocks 56-65, inclusive, Rive~view Crescent, Fawndale Road and Valley Gate,
Plan 40M- 1306, Town of Picketing, Regional Municipality of Durham.
IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly
authorized officers.
